POPULARITY
The extent to which a victim/survivor-centered approach (VSCA) should be incorporated into data protection remains an emerging issue for accountability actors. What does a VSCA look like when collecting data through open-source channels, for example? On a technical level, it means having processes in place to secure and govern data. On a human level, it means recognizing the rights of victims/survivors, building trust among historically marginalized and undervalued communities, and mitigating risks to individuals whose data is entrusted to our care. In this post, part of a new series on Cybersecurity and data protection in humanitarian action, IIIM-Syria Associate Legal Officer Rayyan Ghuma and Information and Evidence Officer Birhane Wossen Reta delve into areas of concern at the intersection of victim/survivor-centeredness, data protection, and open-source collection. They ultimately draw upon the IIIM experience to continue an ongoing conversation about data protection and the VSCA in inclusive accountability.

Richard Edney and Kate Ballard address the issue of how to punish offenders who have a mental disorder. The understanding of what mental conditions can be treated as matters in mitigation has tended to change over time. What appeared to be settled was that personality disorders could not be used on behalf of an offender to mitigate an otherwise just and proportionate sentence. In Episode 13 of our Employment Law for the Time Poor podcast, Professor Andrew Stewart and Emily Haar consider consider four recent cases on the vexed issue of whether a worker is an independent contractor or an employee. As the cases reveal, there are two competing views as to how the multi-factor test is to be applied: does the Court need to look at the substance and reality of the relationship, or do the contractual arrangements reveal the parties’ true intentions about the relationship? To what degree does the “contractor” have to be running a business of their own to legally be an independent contractor? Professor Andrew Stewart and Emily Haar consider the viability of the “Odco” system of treating labour hire workers as contractors and whether the High Court will be tasked to determine which of the two competing views is the correct method of applying the multi-factor test. This is an area that is rife with risk for organisations, and knowing the current state of the law is a must-do. There was no express term that R would own the properties on behalf of the partners, or provision of liability of one partner for a co-partner’s dealings; references to “the project” were not indicia of partnership; and references to “partners” in early drafts of the document had been removed in the final version: [164 – 170]

Corporate oppression and wine in a can! Hooray! (Lots in this one. Broad brushstrokes only, I’m afraid.) An Australian co, ACo, sells wine in a can. A Japanese co, JCo, produces cans. One of JCo’s subsidiaries, JSub, competes with ACo, especially in China and Japan. In 2012, JCo bought 60% of the shares in ACo. JCo entered into an agreement with the other ACo shareholders including a good faith term. JSub continued to compete with ACo. ACo asserted JSub was required to pay it licence fees for its wine tech. ACo’s financial performance slackened. Tensions rose. Relationships broke down. A deadlock emerged. JCo commenced proceedings seeking to wind up ACo. The other shareholders in ACo commenced a s232 oppression suit seeking a share sale. First instance: oppression suit dismissed, including on the basis that the good faith term was not breached. On appeal the oppression point was pressed. Held: a majority shareholder can be found to have acted oppressively, even if it does not breach any agreement: [142]. However, the Court distinguished the facts from an analogous 1950s decision about rayon manufacturing: [147]. On foundations including that above, the conduct was found not to be commercial unfair; not oppressive: [154]. The appeal was dismissed.
