Premier John Horgan and Attorney General David Eby announced major changes to the ICBC, the largest since ICBC was created over four decades ago. One of the major changes announced this morning is a shift to a no-fault insurance. No-fault insurance will mean people involved in vehicle crashes can no longer sue each other for damages — except in cases involving court convictions for offences like negligence, street racing, impaired driving, as well as in cases of faulty manufacturing, botched repairs and the over-service of alcohol by a business. A court judgment released Thursday by B.C. Supreme Court Chief Justice Christopher Hinkson ruled that the government limits on expert reports was unconstitutional because it violated the exclusive powers of a court's control over its processes. The NDP government is now scrambling to deal with the ramifications of a court ruling that struck down a key part of its auto insurance reforms and could blow a hole in the provincial budget. A cap set by Attorney General David Eby on the number of expert reports allowed in auto insurance lawsuits was unconstitutional because it violated the exclusive powers of a court to control its own processes. The immediate effect was an approximately $400 million financial hit for ICBC that Finance Minister Carole James has warned could swamp her thin $179-million projected budget surplus. Conservative Leader Andrew Scheer promised to hold a national public inquiry if elected. The B-C government called a public inquiry into money laundering last spring after three independent reports found illegal money was distorting the provincial economy, driving up house prices and fueling the overdose crisis. Attorney General David Eby says he's pleased money laundering has become an issue of debate during the federal election campaign. But at the meeting of the Union of BC Municipalities, Eby has been hearing that municipalities would like more help when it comes to dealing with the problem of money laundering. Unsurprisingly, David Eby (Attorney General of BC and MLA for Vancouver-Point Grey) is a very busy person. He agreed to forty five minutes on the mic, so I decided to ask some hard hitting questions about the new property taxes that will be impacting BC and Vancouver residents. The BC NDP passed a raft of new taxes designed to address two problems with our housing market: affordability and money laundering. David Eby and BC Finance Minister Carole James suggest that laundered money funded $5.3B in BC real estate purchases in 2018, contributing to BC’s staggeringly high home prices. However, there has been some criticism with the roll out of these new taxes, and as a BC homeowner, I had some questions myself. Are these taxes actually preventing foreign purchases? Can we accurately detect who the speculators are? In this episode, David Eby fields questions about the speculation tax, the school tax, and the foreign home buyer tax. He also talks about the public registry, and what it means for beneficial ownership.

Global News has learned the RCMP opened a file on B.C. Liberal MP Joe Peschisolido after confidential police informants alleged the veteran politician had been knowingly associating with Chinese organized crime figures through his former real estate law practice in Richmond, B.C.   Global News learned of these allegations while investigating whether Peschisolido's law firm was involved in secretive B.C. real estate development deals that involved an alleged Chinese “drug boss” in one case, and also a construction tycoon from China alleged to have been involved in a “transnational money laundering” probe in B.C. Lottery Corp. casinos. These transactions at Peschisolido's law firm involved so-called “bare trusts” — a controversial service that is legal, but has harmed B.C.'s housing market because the trusts can allow money launderers to anonymously invest in real estate assets, according to critics including B.C.'s Attorney General David Eby. Peschisolido has acknowledged that lawyers at his former law firm — which was taken over to be wound down by the B.C. Law Society this year — did complete bare trust deals. However Peschisolido has insisted these lawyers were independent contractors and that he never oversaw or personally completed any bare trust real estate deals.   Guest: Sam Cooper Global News Investigative Reporter

The BC Government calls a public inquiry to look into widespread money laundering in the B.C. economy. BC Supreme Court Justice Austin Cullen has been appointed to head the inquiry. Premier John Horgan says the depth of the money laundering issue was far greater than his government ever thought and that is why the inquiry is coming. The government is asking for an interim report in 18 months, and a final report by May 2021. B.C.'s next election is scheduled for October 2021. The BC government has announced a public inquiry to get to the bottom of how money laundering has seeped into real estate, gaming and the luxury car market. Attorney General David Eby has appointed BC Supreme Court Justice Austin Cullen to lead the inquiry. Eby has given Cullen full power to order individuals to testify at hearings and force witnesses to turn documents over. Refusal to cooperate can result in contempt charges. At an “urgently called” press conference this morning, Attorney General David Eby announced a shocking finding from the ongoing report on money laundering in this province by  retired RCMP officer, Peter German… As part of the chapter released on Monday, German is advising the B.C. government that the RCMP team assigned to deal with anti-money laundering is more than three-quarters unstaffed. German found the only RCMP resources dedicated to anti-money laundering investigations within B.C. are provincially funded or operate under the provincial policing agreement. ICBC reported last week, that it has posted a net loss of $582 million for the first six months of the current fiscal year (April 1 to Sept. 30, 2018). According to a statement from the Crown insurer the loss is “reflective of the continued pressure ICBC is under from the rising number and cost of claims”. Attorney General David Eby went on to say that the primary reasons are higher bodily injury costs, as well as claims taking longer to resolve, which often result in higher claims costs. A key driver of these costs is a growing trend toward plaintiff lawyers strategically building the value of the claim – costs which have to be paid for by ICBC ratepayers. The Canadian Taxpayers Federation has spoken out about their concern over the fact that these losses at ICBC will lead to more money out of the pockets of British Columbians, who already pay approximately $1700 a year for car insurance.
