Today, Hunter was joined by Bob Kolstad, Maggie Bott, and Olivia Henstein to discuss why they are pushing Minnesota Public Defenders to create a new, independent union. In the past few years, the current union, organize under Teamsters, was able to secure massive salary raises for Public Defenders around the state. However, that strike threat was built without much help or support from the leadership of the Teamster's union. As a result, rank and file members, public defenders and the staff of the offices, are considering starting their own public defender lead union.   Guest Bob Kolstad, Public Defender, Hennepin County, Minnesota Maggie Bott, Public Defender, Hennepin County, Minnesota Olivia Henstein, Paralegal, Hennepin County, Minnesota   Resources: Check out UDAM Here https://uniteddefenseadvocatesminnesota.org/   Email Bob bob@robertkolstad.com Email Maggie mabott95@gmail.com Email Olivia olhenstein@yahoo.com     Contact Hunter Parnell:                                 Publicdefenseless@gmail.com  Instagram @PublicDefenselessPodcast Twitter                                                                 @PDefenselessPod www.publicdefenseless.com  Subscribe to the Patreon www.patreon.com/PublicDefenselessPodcast  Donate on PayPal https://www.paypal.com/donate/?hosted_button_id=5KW7WMJWEXTAJ Donate on Stripe https://donate.stripe.com/7sI01tb2v3dwaM8cMN Trying to find a specific part of an episode? I hear a lot about sending love to humans, being kind and appreciative and compassionate to teachers, loved ones, friends…even enemies. I hear less about sending love to the earth. Yet of all beings (if the earth is a being, and isn't she?), doesn't the earth deserve love, too? Doesn't she deserve appreciation, and for once, instead of extracting from her, for us to give her our best, our love, our kindness, every good thing we've got? Seem like it's the least we can do.

In this episode, Ann shares real-world stories of paralegal mistakes (including her own!) and more importantly, how to recover, rebuild trust, and grow stronger from them. Key quote from Ann: One mistake doesn't define you. And if you did get fired for a single mistake? That says more about the firm than it does about you! Key Takeaways: Why learning from your mistakes can be a career accelerator rather than a career-ender. What NOT to do when you make a mistake is just as important as what to do. Signaling that we're mindful, whether we're speaking, writing, posting, or messaging, is simple. There's no lying, denying, or blame. There's no harm done. We're remembering that what we say and do, matters. We're not gossiping, just sharing what's needed. And everything we say is kind. It's simple, but maybe not easy.  If it were, I feel like more of us would be mindful, whether we're talking to friends or planning a campaign. It's not easy, but it seems to me like a better standard of care, and a better Signal to the world, than the one we have now.

Show Notes for Daily Perspektiv Episode 70 Episode Title: How We Helped Clients Navigate Divorce Challenges Today Host: Tim Blankenship, Divorce661.com Episode Overview: In today's episode of the Daily Perspektiv, Tim Blankenship discusses the consultations, new clients, and challenges handled at Divorce661. From correcting misinformation about amended petitions to helping clients remove attorneys and streamline their cases, this episode covers a range of divorce-related insights. Key Stats for Today: Consultations this week: 16 New clients today: 3 New clients yesterday: 4 Total new clients this month: 57 Divorce cases approved in January: 27 Topics Covered in This Episode: New Sacramento Client from Prior Consultation Client first reached out two years ago but was not amicable at the time. Now in agreement and moving forward with their divorce case. Filing a Divorce Case Same Day Client from a prior consultation (where one spouse moved out of state) hired us today. Successfully eFiled their case with the court to get the process started. San Bernardino County Case—Issues with Other Paralegal Firms Clients previously hired a paralegal firm that caused unnecessary delays. The firm refused to communicate with both parties, leading to conflict. They hired us today to take over and finalize their case. Date of Separation Consultation (Los Angeles County) Explained how the date of separation is determined. No proof required if both spouses agree—can be based on moving out, sleeping separately, or the filing date. Default with Agreement Divorce (Los Angeles County) Married just over 5 years, so not eligible for summary dissolution. No assets, debts, kids, or spousal support. Expected to be finalized within a week, with the judgment filed at the 30-day mark. El Dorado County Case—Issues with Marital Settlement Agreement Templates Clients filed and served their own paperwork but needed help finalizing. They asked about using online marital settlement agreement templates. Explained why generic templates lead to court rejection and how we create customized agreements. Frustration with Missed Consultation A client scheduled a consultation but did not answer any of the three calls. Sent straight to voicemail after one ring each time. Expressed frustration as this takes time away from other clients. Spouses Who Hired Attorneys but Didn't Need Them Clients were in agreement but thought attorneys were required. Attorneys had done nothing in three months besides filing the petition and response. Advised them to file substitution of attorney forms so they could move forward without delays. Incorrect Advice About Amending Divorce Petition (Los Angeles County) Clients were told by an attorney to amend their petition unnecessarily. Explained that minor details can be handled in the marital settlement agreement. Avoided unnecessary amendments, saving time and effort. Contested Divorce Inquiry—Company Policy Explained A client in a contested divorce wanted us to review their paperwork. Explained that we only take over full cases and don't review documents piecemeal. Policy ensures we can fully review and correct any potential errors in the case. Key Takeaways: Always work with a neutral third party for amicable divorces. The date of separation can be agreed upon without needing to prove it. Default with agreement cases are a fast and cost-effective alternative when possible. Be cautious with legal advice—some attorneys recommend unnecessary steps that add delays. Missed consultations take time away from other clients—reschedule if you can't make it. Call to Action: Need help with your divorce in California? Michael Mulligan from Mulligan Defence Lawyers joins us to untangle the intricate web of legal challenges sparked by personal entanglements within the courtroom. Imagine a scenario where a defence counsel's paralegal is romantically involved with the Crown counsel during a sexual assault trial. This isn't a plot twist from a legal drama, but a real-life case from Courtenay that led to a mistrial application, questioning the boundaries of professional ethics and the accused's right to know. We navigate through the complexities of this case, drawing parallels with precedents from Canada and the UK, and ponder the judge's authority to declare a mistrial post-conviction.Shifting our focus to Vancouver's courthouse, we confront the grim reality of operating in a neighbourhood plagued by violence and open drug use. Despite the Crown Counsel Association's plea for relocation, Attorney General David Eby's decision keeps the courthouse at its precarious location, raising concerns for all who walk its halls. The need for heightened security measures and the pressing call for addressing underlying social issues become glaringly apparent. As we wrap up, a seemingly trivial lawsuit over a $90 lens coating teaches us a valuable lesson about weighing the cost of legal battles. Michael Mulligan offers his perspective on exercising sound judgment before entering the legal fray, emphasizing the importance of picking one's battles wisely.Follow this link for a transcript of the show and links to the cases discussed.

In this episode, guest host Linda Odermott delve into regulatory reforms in the legal profession. Linda discusses significant changes, including the introduction of regulatory sandboxes in states like Arizona, which allow for innovative legal services to be tested in a controlled environment. The episode highlights Arizona's initiatives to improve access to justice through alternative business structures and the creation of licensed paraprofessionals. These reforms aim to diversify legal service providers and enhance the availability of legal support, particularly in underserved areas.   Key Takeaways: There is a push for legal regulation reform due to high costs and limited access to legal services, with federal regulations estimated to cost around $2.1 trillion annually. Arizona introduced a "regulatory sandbox" allowing businesses to operate with reduced regulations for a set period to encourage innovation while maintaining consumer protection. After the trial, lawmakers evaluate what worked. Arizona's LP program allows non-attorney professionals to provide specific legal services, such as document preparation, giving legal advice, and court appearances, in limited practice areas like family law, civil law, administrative law, and misdemeanor criminal law. Two-thirds of Arizona counties are considered "legal deserts," with fewer than one lawyer per 1,000 residents, further necessitating reforms to improve access to legal assistance. Alternative Business Structures allows legal practice entities to be owned or managed by non-lawyers, provided only licensed lawyers practice law. LegalZoom, for example, has entered Arizona's legal market through an ABS license. Additional areas for LPs to practice, such as juvenile dependency and adoption, are under consideration, indicating ongoing evolution in Arizona's approach to legal service delivery.
