Hello and welcome to Episode 280 of the People Powered Business Podcast.In this episode we're unpacking a recent Fair Work Commission decision that has seen a worker based in the Philippines being deemed to be an employee of an Australian based business, and what that means for those engaging offshore workers.In the case, the worker, based in the Philippines, was working for a Brisbane based business. Her tasks were to work as a Paralegal. She worked from her home, and was required to work Australian hours – 8:30am to 5pm QLD time.Her engagement was terminated by the business (because she allegedly copied company data onto a personal computer drive – an allegation she denies).Upon termination she felt wronged and unprotected. She felt unprotected by Philippines workplace law because of how her engagement was set up, but also wasn't sure she was covered by Australian workplace law, but because she felt like she was acting just like an employee – she would make an unfair dismissal claim with the Fair Work Commission.The company of course argued that she wasn't in Australia, and therefor was a contractor, not an employee, and as a result not eligible to make the claim.However, the worker pointed out that the Fair Work Act does not in fact state that you need to be physically in Australia for this to make such a claim.The outcome? In the past few years, the current union, organize under Teamsters, was able to secure massive salary raises for Public Defenders around the state. However, that strike threat was built without much help or support from the leadership of the Teamster's union. The video went viral, and yet ANOTHER career was born! Drawing on her growing up near Yonkers Racetrack, she knew gamblers, and the gambler mindset. Now in agreement and moving forward with their divorce case. Filing a Divorce Case Same Day Client from a prior consultation (where one spouse moved out of state) hired us today. Successfully eFiled their case with the court to get the process started. San Bernardino County Case—Issues with Other Paralegal Firms Clients previously hired a paralegal firm that caused unnecessary delays. The firm refused to communicate with both parties, leading to conflict. They hired us today to take over and finalize their case. Date of Separation Consultation (Los Angeles County) Explained how the date of separation is determined. No proof required if both spouses agree—can be based on moving out, sleeping separately, or the filing date. Default with Agreement Divorce (Los Angeles County) Married just over 5 years, so not eligible for summary dissolution. No assets, debts, kids, or spousal support. Expected to be finalized within a week, with the judgment filed at the 30-day mark. El Dorado County Case—Issues with Marital Settlement Agreement Templates Clients filed and served their own paperwork but needed help finalizing. They asked about using online marital settlement agreement templates. Explained why generic templates lead to court rejection and how we create customized agreements. Frustration with Missed Consultation A client scheduled a consultation but did not answer any of the three calls. Sent straight to voicemail after one ring each time. Expressed frustration as this takes time away from other clients. Spouses Who Hired Attorneys but Didn't Need Them Clients were in agreement but thought attorneys were required. Attorneys had done nothing in three months besides filing the petition and response. Advised them to file substitution of attorney forms so they could move forward without delays. Incorrect Advice About Amending Divorce Petition (Los Angeles County) Clients were told by an attorney to amend their petition unnecessarily. Explained that minor details can be handled in the marital settlement agreement. Avoided unnecessary amendments, saving time and effort. Contested Divorce Inquiry—Company Policy Explained A client in a contested divorce wanted us to review their paperwork. Explained that we only take over full cases and don't review documents piecemeal. Policy ensures we can fully review and correct any potential errors in the case.
