Welcome to episode 229 of the Grow Your Law Firm podcast, hosted by Ken Hardison. In this episode, Ken sits down with John M. Cooper, Founding partner at Cooper Hurley Injury Lawyers and a veteran of Virginia personal injury law practice, to delve into the complexities of railroad worker injury cases governed by FELA and the challenges of dealing with railroad companies like Norfolk Southern and CSX. They highlight the importance of expert witnesses, early legal representation, and understanding the specific rules of railroad injury law to secure fair compensation for injured workers. John M. Cooper is one of the founding partners at Cooper Hurley Injury Lawyers and a veteran of Virginia personal injury law practice. A native Virginian, he was raised in Norfolk and Virginia Beach by parents who practiced law. After graduating from the University of Virginia School of Law in 1988, John returned home to work for a federal judge in the U.S. District Court for the Eastern District of Virginia, Norfolk Division, which launched his passion for and career in personal injury law. What you'll learn about in this episode: 1. Filings claims under the Federal Employers Liability Act (FELA): - Railroad worker injury cases governed by the Federal Employers Liability Act (FELA) offer unique challenges due to the complex laws involved. - FELA allows employees of major railroads like Norfolk Southern and CSX to sue for damages, requiring specialized legal expertise for fair compensation. 2. Expert Witnesses and Railroad Injury Law: - Expert witnesses are crucial in proving liability and dealing with railroad companies' claims departments. - It is essential in these cases to deal with slow responses from Amtrak and understand the specific rules and procedures of railroad injury law. 3. Legal Representation Crucial for Injured Workers: - The adversarial relationship between railroad companies and injured workers necessitates early and robust legal representation. - Amtrak's high duty of care to passengers and potential obstacles posed by mandatory arbitration clauses make legal representation crucial. 4. Legal Complexities and Nationwide Practices in Railroad Crossing Accidents: - Visibility issues at railroad crossings leading to accidents often place responsibility on the driver, creating further legal complexities. - Navigating the nationwide practice of railroad injury cases is facilitated by remote communication options and in-house investigators. 5. Strategic Venue Selection in Amtrak Injury Cases for Optimal Jurisdiction: - Venue options in railroad injury cases can be creative and strategic, allowing for flexibility in choosing the most advantageous jurisdiction. - Amtrak cases present additional complexities in venue selection, where representing clients across different states can be managed effectively for their best interests. Personal injury lawyers are master marketers. They know that clients don't care that the law firm is the biggest or number one in the area. What clients want to hear about are personal stories. They want to hear about people that are just like them being helped by the lawyer. Real estate agents should use the same techniques with real estate consumers. The consumer does not care if you are "Number 1 in Elgin" or the Number 1 Team. They want to hear real stories about how you helped people just like them. Serial entrepreneur and personal Injury lawyer, Hamid Kohan, from Los Angles explains how real estate agents could learn from lawyer advertising. He also discusses technology, and a host of other big topics.Don't forget to like us and share us!Gary* Gary serves on the South Carolina Real Estate Commission as a Commissioner. Today we are going to take a deep dive into OTT advertising for personal injury lawyers. We will cover the basics of what OTT advertising is, how much it costs, how to get started, and some tips on making effective OTT campaigns for personal injury lawyers. What is OTT Advertising? Basically, OTT advertising means having an ad on a streaming service. Over-the-top refers to the delivery of video content in a way that bypasses traditional television channels. The OTT platforms are generally streaming services or apps. While there are over 350 independent OTT some of the biggest names are: Hulu Amazon Prime Video Netflix Disney Plus Peacock Paramount+ Apple TV and more Benefits to OTT Advertising: People are watching. I would place a conservative guess that at least half of our listeners have canceled their cable subscriptions. At our house, we have Hulu, Amazon Prime Video, Disney+, ESPN, Peacock, and pretty much everything other than cable. So, people are watching. Also, since people go in and hand pick what they want to watch, fewer viewers are flipping channels during commercial breaks. Audience targeting. What is really cool about advertising through these streaming platforms is that you have much more control over who is watching. Unlike traditional cable ads that go to everyone across the nation who is watching a show, you can pinpoint your target market by location, age, interests, demographics, etc. This is huge. HUGE! Think about it…if you want to target more bike accidents, you can create commercials that are all about how to help bike accident victims and have them directly go to people who have a noted interest in cycling. Or pair a motorcycle accident ad with people who like to watch shows about tricking out their choppers. If done right, the possibilities are endless. If done wrong, the investment is pointless. So please, please don't invest in a blanket personal injury video and blast it out to all of America and expect to get cases. Analytics. Another benefit of OTT advertising is that you can get some detailed analytics and reporting to track your ad performance. Most platforms offer metrics on impressions, completion rates, and click-though rates (if you enable interactive ads). This can help you evaluate your ads and make data-driven decisions for future campaigns. How Much Does OTT Advertising Cost? Since many of the streaming services are individual entities, they are naturally all at different price points. Also, the more you define your target market, the higher the cost of running the ad. OTT ads are priced on a cost per thousand impressions basis. This is generally noted as CPM. So, if an ad has a CPM of $10, you are paying a penny every time someone views the ad. Hulu tends to be the among the most expensive with rates falling between 20-40 CPM. Their ad inventory is relatively limited, and their audience tends to be more engaged than other services, so they can charge a premium price. YouTube TV has a lower CPM, typically between 10-20 CPM, even though they still have a large audience. Other streaming services like Sling TV, Roku, and others with smaller audiences might have even lower CPMs while still being able to target your selected campaign demographics. Another factor that can influence the cost can include how long the video ad is – the standard is 15-30 seconds. As a broad generalization, a 15 second ad can be 5-25 CPM where a 30 second ad might fall between 10-50. Also, on some platforms you can enhance your ads by making them non-skippable or interactive. You can also select whether your ad plays, before, during or after the tv program. These choices naturally impact the cost of the ad. How to Start OTT Ads for Personal Injury Lawyers: If you are seeking a done-for-you solution for OTT advertising, contact us today and we'll connect you with an OTT advertising provider, if possible.

What successfully onboarding a client looks like and where to invest in your firm - after SEO.Key takeaways: Onboard your clients. Once intake is complete, the client journey has just begun. The onboard process should be streamlined, consistent, and documented in standard operating procedures. Send automated welcome videos so clients have a better understanding of your firm. Resumes should not be the bottom line when hiring. Most hard skills can be learned, but soft skills that align with your firm's values - like friendliness - can not be taught. Build a team with your desired soft skills. To stand out in any market, reviews are critical. Make reviews part of the client journey and watch your practice grow. The ads are ubiquitous. The slogans annoying. Personal injury and car crash lawyers often get a bad rap. Sometimes deservedly so. As widespread as those billboards, radio ads and other assaults on the senses are...they are meant to address something almost all of us has experienced, or been touched by - a car accident. When those accidents produce injuries, the "PI" lawyer is suddenly needed. How do you find a good one? Does a bad ad make for a bad lawyer? Does no ad make for a good lawyer? Let's find out as Bob interviews Kevin Fine, a PI lawyer and a wellness advocate. As you listen, mull these stats over from drivingtests.org:In 2019, there were 6,756,000 police-reported motor vehicle crashes, including 1,916,000 crashes involving injury and 33,244 crashes involving death. (NHTSA, 2021) In 2010, the economic cost of traffic crashes (both reported and unreported) was estimated to be about $242 billion, plus an additional $594 billion in societal costs resulting from the effects of these crashes on the victims, for a total cost of $836 billion. This total cost represented about 5.6% of the US Gross Domestic Product (GDP) in 2010. (NHTSA, 2017) (Source: https://driving-tests.org/driving-statistics/)Around 2 million drivers in car accidents experience permanent injuries every year. (Driver Knowledge, 2019) (Source: https://driving-tests.org/driving-statistics/)About 10 million or more crashes go unreported each year. (National Highway Traffic Safety Administration, 2018) (Source: https://driving-tests.org/driving-statistics/)

Discussed in this episode: · How a “terrible” rock band led to a career in marketing · From law school to entrepreneur and startup growth expert · Mastering the nontraditional attorney career path · How a law degree enhances marketing skills · How to put together an actionable marketing plan Have you defined your practice's brand? Are you wondering how your law degree can help in marketing? Kevin Tully, Zinda Law Group's CMO, has the answer. In this episode, Kevin will detail his dynamic professional journey, discuss how law school made him a better marketing professional, and offer tips for personal injury lawyers who are trying to build their practices and reach more clients. “You all have your hearts in the best places when it comes to helping your clients,” Kevin said. “That was an easy mental shift for me to make to see at the end of the day we are serving people in need. That felt really good. That was a reason to get out of bed and come to work every morning.” From rock band to marketing master It's safe to say that Kevin Tully's journey as a marketer has been anything but dull. When he started playing in an amateur rock band in college, he never would have dreamed of becoming a lawyer turned expert marketing executive. “Playing in bands is where I first started to be a marketer. We were promoting our shows and making band fliers and stickers and all that sort of stuff,” Kevin said. After college graduation, Kevin worked at Atlantic Records in New York City in the age of Napster. “I was there, I was working in the marketing department, working in the A & R department. I realized my coworkers were packing up their desks and leaving for other opportunities outside of the music business because it just wasn't headed in the right direction at the time.” The law school journey “There was a guy who'd show up and he would talk to my boss, and he wore a suit, and he looked like he was doing well for himself. So, I picked his brain. I said, ‘Hey, what do you do? Will you take me to lunch and tell me all about it?” From there, Kevin pursued a law degree. Exposure to intellectual property law inspired Kevin to start his own company in the music industry. “Through that I learned digital marketing, ecommerce, and a lot of skills that are still in play for me today.”Mastering the nontraditional attorney pathKevin's legal experience has served him well as a marketer on a nontraditional post-law school path. “I stepped off the path, and I haven't ever tried to go back to becoming a practicing attorney,” Kevin said. “I think that would be a little intimidating at this point, and I'm happy where I've ended up.” “A law degree is a means to an end and not an end itself,” Jack added. “I see a lot of attorneys who are unhappy in the practice of law they're working in…and they feel stuck.” How a law degree enhances marketing skills “It taught me how to think critically, it taught me how to problem solve. I think issue spotting is something that I use every day in all of the different companies that I've worked for,” Kevin said. “I think that's the big difference between lawyers and nonlawyers is the ability to boil something that is complex down to the crux of the issue.”Kevin eventually shifted gears from working with Indeed and Siete Foods to leading the marketing team at Zinda Law Group. “I just felt like this was going to be a great group of people who were really driven, really smart, highly motivated, and I wanted to be in that kind of space again. I felt like it was going to make me better as a person,” Kevin said. “It's funny, once people come work for us and other personal injury law firms, they see what a great calling this area of the law can be,” Jack added. “But it has such a tough stigma from people on the outside that it can be tough to convince people to give us a shot.” Kevin admitted that marketers in personal injury law fight the same battle. Still, he admits that overcoming that starts with the personal injury firm itself and its focus on helping people in need. How to put together an actionable marketing plan “I'm a big believer that frameworks are helpful starting points,” Kevin noted. “Anytime I've ever had to learn anything, the ‘ah-ha' moments have been seeing the frameworks others have used.” He also emphasized the importance of marketing funnels. At the wide end, you have your awareness-level marketing. This lets people know that you are “out there.” As consumers make their way through the funnel, they slowly provide information, engage you, have a great experience, and build loyalty. “Using that framework, we think about how that maps to who the client is, getting that persona down, and understand how you can be helpful to them as you go through that process. If you're not providing value to them in that marketing, you're doing it wrong,” Kevin said. The whole point of legal marketing is getting clients to a good place and solving their problems. Kevin discussed lessons learned from StoryBrand, a book about brand building for today's marketer. For lawyers, building a strong brand requires positioning oneself as the client's guide. This week, your hosts Steve Lowry and Yvonne Godfrey interview Jonathan Marko, the Detroit Bar Association's Civil Rights Chair and founder of Marko Law (https://markolaw.com/). Remember to rate and review GTP in iTunes: Click Here To Rate and Review Episode Details: Jonathan Marko, the Detroit Bar Association's Civil Rights Chair and founder of Marko Law, shares how he secured justice for Lisa and Cedric Griffey, a husband and wife who suffered racial discrimination in the workplace. A probation officer for the Michigan Department of Corrections who worked in an all-white office, Lisa was called "mammy" and "the black one," and she was the victim of numerous racially derogatory remarks. Lisa's multiple attempts to file discriminatory harassment complaints through the proper channels were sabotaged, and no action was taken. After Lisa filed suit, Cedric's boss received a copy of Lisa's lawsuit and retaliated against Cedric, alleging that the 2017 Corrections Professional Excellence Award winner did not properly administer discipline. Cedric was forced to resign as deputy warden, ending his 29-year career with the Michigan Department of Corrections. In September 2019, a jury returned the largest employment discrimination verdict in Genesee County, Michigan history, awarding the Griffeys over $11.67 million in economic and non-economic damages. As a little boy, he was always being told by his teachers and authority figures to use his inside voice because he was too loud; to not argue with opinions that he didn't agree with; and to always follow the rules, even if they didn't make any sense. These traits that got Jon in so much trouble when he was younger, are what make him a great attorney today. Jonathan grew up in Grand Rapids, Michigan. He attended Aquinas College, a small Catholic liberal arts school for his undergraduate studies, where he obtained a bachelor's in history. After undergrad, Jon set his sights on Washington, D.C. He attended American University for law school, where he was active in the trial advocacy program and graduated in the top 10 percent of his class. While in Washington, D.C., Jonathan had the honor to clerk for well-respected Maryland Circuit Court Judge Michael Mason, where he cultivated his passion for trial advocacy and honed his trial skills. Jonathan also had the opportunity to work on Capitol Hill. There he lobbied for clients, especially the interests of Michiganders. After graduating law school, Jonathan was invited to work under the Chief Justice of the Michigan Supreme Court, Marilyn Kelley. At the Supreme Court, Michigan's highest appellate court, Jonathan worked exclusively on appeals. Although the cloistered environment of the Michigan Supreme Court did not involve the trial advocacy that Jonathan desired, it was there that he was able to pursue intellectual legal issues and help shape and form the law of the state of Michigan. Jon's appellate experience gives him a unique background in his practice today. After working for the Michigan Supreme Court, Jonathan worked under renowned trial attorneys Geoffrey Fieger and Ven Johnson. It was here, that Jon was finally able to practice his life-long dream of being an attorney in the trenches of the courtroom. Jonathan is the principal attorney at Marko Law, located in Detroit Michigan. The firm has a diverse practice helping clients, including injured persons, businesses, civil rights issues, employment litigation, and injuries caused by defective products, and other litigation related matters. If your case is outside of our practice area, we are able to connect you with an extremely capable attorney specializing in the area that you need. Jonathan has been recognized by local and national news outlets for his work in the legal field. He has been on the front page of the Detroit News, he has been featured in the Detroit Free Press, and has been in the New York Times several times. He has been awarded the honor of being named a “Rising Star” by Super Lawyers magazine for the past eight years, and has been named one of the top ten personal injury attorneys in the state of Michigan by the National Academy of Personal Injury Lawyers based out of Washington, D.C. Premier John Horgan and Attorney General David Eby announced major changes to the ICBC, the largest since ICBC was created over four decades ago. One of the major changes announced this morning is a shift to a no-fault insurance. No-fault insurance will mean people involved in vehicle crashes can no longer sue each other for damages — except in cases involving court convictions for offences like negligence, street racing, impaired driving, as well as in cases of faulty manufacturing, botched repairs and the over-service of alcohol by a business.
