On this week's episode of Lever Time, Julia Rock and Frank Cappello speak with environmental lawyer Julia Olson to discuss a recent historic win for young climate activists who she represents in Montana. This past Monday, a judge in Montana ruled that young people are entitled to a “clean and healthful” environment. The case, known as Held v. Montana, included 16 plaintiffs ages 5 to 22, who testified that the state government's pro-fossil fuel policies were unconstitutional. Held v. Montana was the first of several youth-led U.S. climate lawsuits to make it to trial. Olson is the executive director and lead counsel for Our Children's Trust, a nonprofit public interest law firm that represents plaintiffs in a number of these youth-led state climate cases as well as in a federal lawsuit, Juliana v. United States. Julia and Frank spoke with Julia Olson about this historic win, how the case's legal strategy can be applied across the country, and why the Biden administration is attempting to prevent other youth-led climate lawsuits from going to trial. Things do not look good for Joe Biden and the Democratic Party right now. Polls show that nearly 3/4 of Americans, including a staggering 94% of people under 30, do not want Biden to run for reelection. Biden's prospects look slightly better when people are asked if they prefer him or Donald Trump, and for Biden that's apparently enough. The New York Times says the president has a favorite aphorism: "Don't compare me to the Almighty, compare me to the alternative." (This is the worst aphorism ever.) "The alternative to us is Christian Fascism" might be a platform that allows some Democrats to squeak back into office. After all, the existing alternative is Christian Fascism. But what kind of agenda could actually produce lasting majorities and enthusiastic public support? What would a real alternative to the GOP, one that put forward a positive and transformative set of ideas, look like? To answer this question, we are today joined by Alan Minsky, Executive Director of Progressive Democrats of America (PDA), and Professor Harvey J. Kaye, author of The Fight for the Four Freedoms and Thomas Paine and the Promise of America. In a recent series of articles for Common Dreams, Kaye and Minsky have laid out the case for a 21st-century Economic Bill of Rights. They argue that if Democrats want to win, they should formally embrace the principles of the Economic Bill of Rights, which would make it clear to Americans exactly what people would be voting for when they are asked to vote. Sam and Emma host Harvey Kaye, professor emeritus of democracy at the University of Wisconsin, Green Bay, and Alan Minsky, executive director of the Progressive Democrats of America, to discuss their recent mission statement published in Common Dreams, the 21st Century Economic Bill of Rights. However, Emma and Sam first dive into yesterday's mass shooting at an elementary school in Texas, walking through the mass boom in gun sales over the past two years, the common link between mass shooters and violence against women, and the ahistorical neoliberal view that gun control is a revolutionary concept in the US. Then, they're joined by Professor Harvey Kaye and executive director Alan Minsky as they dive into the history of economic bills of rights, first proposed in the US by FDR as a centerpiece to his 1944 State of the Union, built on his economic declaration of rights and his concept of the four freedoms (speech, worship, freedom from want, freedom from fear), and looking to support the rights people wanted to see enumerated after World War II, seeing healthcare and jobs, particularly, as central to defeating the constraints of need. These concepts were then picked up by the democratic party under Truman, and even framed as the party platform in 1960 ahead of JFK's candidacy. Next, Kaye and Minsky walk through the 10 rights present in the 21st Century Declaration, including universal healthcare, the right to education and the internet, affordable and accessible housing, a clean environment, support at birth and in retirement, a fair justice system, sound financial services, and a right to recreation and participation in democratic life, all of which, as they walk through, are tied to current legislation supported by Bernie Sanders, the squad, and other progressives. Next, they dive into the rhetorical element of this fight, perhaps the one in which we have the longest to go, first looking at the relationship between liberty and governing powers, before diving into what a productive future for a progressive left in the US would look like, both in terms of changing the conversation and building on the CPC's existing role in the Democratic Party. And in the Fun Half: Emma and Sam talk with John from San Antonio as he dives into the more hopeful elements of the state of our politics, from unionization to Jessica Cisneros' continued hope, before they address Nancy Pelosi's robocall in support of an anti-choice anti-gun-control candidate, the massive Georgia turnout, and how we could see a positive drive for Democratic turnout in the midterms. David from Grand Junction discusses corporate America's refusal to hire amid their mindless drive for efficiency, teacher Lauren calls in on rising COVID rates in schools, and Isaac has an extensive conversation on Saudi Arabia's conflict in Yemen. Suzi talks to Alan Minsky and Harvey Kaye about the 21st Century Economic Bill of Rights, which they see as both a campaign platform and governing program to rescue and renew American democracy. This is more than a to-do or must-do list for progressives, but in their words, a compelling and transformative unifying project, a manifesto to advance democracy. We ask whether they think this program is feasible and realizable given the configuration of our political winner take all system?We then turn to the recent election in France, where incumbent Emmanuel Macron won with a 17% margin over Marine Le Pen. The period leading up to this election was far more uncertain. The contest had been narrowed from 12 parties in the first round, held April 10th, to the top two vote-getters, the centrist neoliberal Macron, and the far rightist Le Pen. Le Pen edged out the leftist Jean-Luc Mélenchon by a very narrow margin. The day before the election, we spoke with Sebastian Budgen, author of a recent article in the New Left Review blog, about the big question leading up to the election: Where would Mélenchon's votes go in the second round? Though a decisive number seemed to have held their noses to vote for Macron, 26% of the electorate stayed home—in effect abstaining. An insignificant 2% of voters either nullified or turned in a blank ballot. Budgen gives an analysis of the state of the French electorate that holds lessons and warnings for the future.
