President-elect Donald Trump has made it clear he wants the FBI headquarters to stay in the District. There's a possibility he could reverse the decision made last year to move the FBI to Prince George's County. Prince George's County Council Chair Jolene Ivey joined us to discuss.Plus, a Senate committee moved legislation forward that would give D.C. control of the R-F-K Stadium site at no cost for the use of the land. It's a step towards building a new football stadium and luring the team back to D.C.from Prince George's County. That's concerning for Council Chair Ivey, who'd like to keep the team where it is. She said she's recently talked with the team about staying put, touting the potential for development and noted the team already owns the land where the current stadium sits."But of course, that was before Congress put their thumb on the scale, and right now, it looks possible they could be getting the land for free. And that's really not fair," Ivey said.Army veteran Eugene Vindman won his race earlier this month to represent Virginia's 7th Congressional District. Congressman-elect Vindman joined the show to talk about his victory, legislative priorities, and navigating a Republican-controlled House. And as someone who had run-ins with Trump, does he have concerns about possible retribution?Plus, President-Elect Donald Trump announced that he tapped tech billionaire Elon Musk and businessman Vivek Ramaswamy to head a Department of Government Efficiency.The goal is to cut federal spending, which would leave many federal workers in our region wondering what will become of their  jobs under the incoming Trump administration.Vindman aid he recognizes a need to trim the federal budget but that there are certain areas where he will not compromise."There are gonna be some realities that those appointed to conduct these activities are gonna run into. They're related to national security realties, economic realities, political realities. Kat McCay Stanley discussed her extensive restaurant ventures, including the recent rebranding of Holy Mackerel in Prince George County, Virginia, to The Salty Siren, which offers a seafood-heavy menu. "When Holy Mackerel hit my radar, there was no turning back. The potential there, the view, the building... So I thought, 'Is this crazy? This is pretty crazy,'" she said about her plan to revamp the restaurant along the James River near the Benjamin Harrison Memorial Bridge. "But I also knew in the back of my mind that if I was willing to chase that craziness, I knew the absolute most dynamite person who would be interested in chasing it with me. So I actually have a 50% business partner there, by the name of Jessica Pilout, and she is the other half of The Salty Siren." McCay Stanley also owns Old Towne's Alibi, a Petersburg dive bar known for its community involvement and zero staff turnover in three years. During her Eat It, Virginia interview, McCay Stanley highlighted her community's efforts after Hurricane Helene, organizing multiple relief trips with trailers and trucks filled with supplies to both North Carolina and Virginia communities impacted by the storm. He was a board member for the National Pentecostal Evangelical Association for 40 years, treasurer for 18 years and chairman for 12 years. He was also the Principal and Founder of Massanova Christian Academy for 30 years.Rev. Savage was a member of the National Partnership for Educational Access for 50 years as well as board member of Free Gospel Bible Institute in Export, PA for 12 years. He was also board member for Holiness Heritage Literature for several years and guest speaker at countless camp meetings and conventions nationally. TRUST COMPANY, AS CERTIFICATE TRUSTEE ON BEHALF OF BOSCO CREDIT II TRUST SERIES 2010-1, ET AL. (Record Number 181307)   From   Circuit Court of Prince George County; W. Tomko, Judge.   Counsel   Henry W. McLaughlin (The Law Office of Henry McLaughlin, P.C.) for appellant.   Daniel K. Eisenhauer for appellee.   Assignments of Error   1. The Circuit Court of Prince George County, Virginia (“the trial court”) erred in its oral ruling on July 24, 2017 that the claim of the appellants, Thomas Janis and Kimberly O. Janis (“the Janises”) for an injunction based on usury failed because their claim of usury was based on averred improper charges that were de minimus. This was error, even though the trial court noted that injunctions are not to be granted liberally, because of the following:   A. The Janises sought an injunction to prevent a foreclosure of their home based on usury in a subsidiary mortgage loan based on Va. Code Ann. Section 6.1-330.72 (“Section 6.1- 330.72”).   B. Section 6.1-330.72, at all relevant times, provided what charges are allowed in subsidiary mortgage loans, and stating, in pertinent part (excluding certain charges otherwise allowed by such statute not applicable to this case) “No other charges of any kind shall be imposed on or be payable by the borrower either to the lender or any other party in connection with such loan ....”   C. In Garrison v. First Federal Savings and Loan, 402 S.E. 2d 25 (1991) this Court held that any charge not attributable to principal or all allowed charge for collateral services is interest. Therefore, if the lender in this case imposed charges on the Janises that were neither towards principal or allowable collateral charges, such imposed charges were 2 interest and any such interest disallowed by Section 6.1-330.72 constituted disallowed interest and therefore usury.   D. The Janises’ complaint (“the complaint”) verified by Kimberly O. Janis under oath, plausibly set forth that the lender imposed on the Janises two usurious charges -one for $1 as an overcharge of the recordation fee and the other for $158 for a claim of payment of a charge owed by the Janises which was tendered but not completed and not refunded to them.   E. There is no de minimum [sic] exception to the usury prohibition in Section 6.1-330.72.   F. Under the provisions of Va.Code Ann. Section 6.2-304 (“Section 6.2-304”) because the subject loan was usurious, no interest was owed on the loan.   G. In their complaint, vertified [sic] by the Janises under oath, because they owed no interest on the subject loan (pursuant to Section 6.2-304) they had satisfied the loan in full because they had paid more than the $26,000 of the principal of the loan.   H. Because the Janises had satisfied the loan in full, it was error for the trial court on July 24, 2017 to rule against their plea for an injunction to prevent foreclosure of their home on July 25, 2017.   2. The trial court erred in its written order entered on July 25, 2017 denying injunctive relief as to Count One of the complaint. This was error for the reasons set forth in Assignment of Error No.1, in Assignment of Error No.1 [sic], including subsections A thorugh [sic] H of that assignment of error.   3. The trial court erred in that part of the final order entered on July 9, 2018 which dismissed the complaint with prejudice. This was error because:   A. The final order thereby dismissed that part of the complaint which prayed that the trial court appoint a special commissioner with instruction to mark the deed of trust as satisfied on grounds, avrred [sic] in the complaint, that (a) the loan was usurious; (b) as a result of such usury, no interest was due on the subject mortgage loan; and (c) with interest removed, the Janises had paid the loan in full.   B. The final order thereby dismissed that part of the complaint which sought a declaratory judgment that the Janises were not responsible for the lender’s foreclosure costs related to scheduling a foreclosure for July 25, 2017.   C. The loan was usurious because the lender imposed on the Janises as to the secondary mortgage loan at issue in this case a $1 charge claimed for a recordation charge paid to the clerk’s office but not actually so paid and not among the charges for a secondary mortgage oan [sic] under the provisions of Section 6.1-330.72. 3   D. The loan was also usurious because the lender imposed a $158 charge for a claim of payment of an amount owed by the Janises which was tendered but not completed and not refunded to them.   E. Because the loan was usurious, pursuant to Section 6.2-304 no interest was due on the subject loan.   F. Because no interest was due on the subject loan, the Janises had paid the loan in full.   G. Seven out of nine Supreme Court Justices rule that the Bladensburg Peace Cross in Prince George County, Maryland should remain standing. The majority opinion acknowledges that the memorial’s age makes it a part of the community. Learn more at FirstLiberty.org/Briefing. It may have been a long time coming, but the freedom First Liberty Institute secured in The American Legion v. AHA is significant.  You will recall that at issue in the case was the Peace Cross, a World War I monument Gold Star Mothers erected to remember 49 sons of Prince George’s County, Maryland who died in the Great War. That idea came in 1919 and The American Legion dedicated it in 1925. Everything was fine until 2013 when someone decided they were offended at the presence of a cross on public property, ignoring the surrounding memorials to other wars in what is known as Memorial Park.  In June of 2019, the Supreme Court of the United States handed down its decision.  Seven of the nine Justices wrote an opinion, making the decision somewhat difficult to decipher.  But the clear majority of seven Justices ruled that the memorial should stay right where it is. The majority opinion, written by Justice Samuel Alito, explained the fact that the memorial bears religious symbolism does not mean the memorial must be destroyed or moved to private property.  That is all the more true when memorials age and become a central part of the community itself. “The passage of time,” Justice Alito wrote, “gives rise to a strong presumption of constitutionality.” In our next episode, we will explore what this “strong presumption of constitutionality” means today. 027 - The Murder of Kanika Powell

Kanika Powell was a brilliant twenty-eight year old woman living in Prince George County, Maryland. After a tour of service in the Army, she came out and began work as a security contractor. Much to her delight, she found work at the Johns Hopkins University Applied Physics Laboratory in Laurel, Maryland. After two years working as a contractor, she was hired on as a full time employee. Her work required a top secret classification and she was involved in securing projects related to National Security and in conjunction with the Department of Homeland Security. The nature of her work has never been revealed for public consumption, and though the Lab did confirm that she worked there, they would not release even what her job title was. On Saturday, August 23rd, 2008, Kanika had a frightening experience where a man posing as an FBI agent had tried to gain access to her apartment. He knew her name, and approached her door, but Kanika was intelligent enough to not allow him inside. She later called the police to report the incident and sent out an email to family and friends telling them the strange story. Four days later, a different man showed up, claiming to have a package for her. Again she did not open the door. She called her mother about the second incident, took the day off from work and ran some errands. When she arrived back at her apartment at approximately 11:50am, someone was waiting in the hallway and shot her multiple times. Kanika never regained consciousness and passed away as a result of her injuries the next day. Police were baffled by the seemingly motiveless crime and didn't have so much as a single suspect. Three months later, Sean Green, a thirty one year old man working in as an IT professional for a National Security contractor was shot nine times while sitting at a red light. The attack took place just twenty-five miles from where Kanika had been murdered, and the similarities didn't end there. Many have speculated that both Kanika and Green were murdered by the same individual, or possibly for the same reason. Why was Kanika Powell murdered? Was it simply a random act of violence? Was the murder perpetrated by someone she knew? Is she a yet unproven victim of the "Mother Daughter Killer" Jason Thomas Scott? Was her murder part of a larger plan which also targeted Sean Green or was Kanika the victim of a murder for hire scheme?
