Attorney Todd Marquardt talks about choosing a trustee and more on this edition of Talk Law Radio! Today's episode is all about deciding who the trustee of the trust you created should be. You might nominate a person, like a family member, friend, accountant or attorney to be the trustee; or you might nominate a bank or a Trust Company. Before we go into detail about factors and issues to consider when deciding on who should be trustee, let's define what a trust is from the perspective of the IRS and the perspective of the Social Security Administration. We will talk about initial trustees, successor trustees, co-trustees, incapacity trustees, investment trustees, distribution trustees, and beneficiary trustees. Then, we will open our Bibles to Matthew 25:14 to see how the managers in the parable of talents is an example of one of the duties that a trustee has. Along the way, we will talk about sinners, saints, and legacy. Plus, I'll give a short review about God Bless the USA Bible that can be purchased at https://leegreenwood.com. In this episode of The Rainmaker Podcast, host Gui Costin, Founder and CEO of Dakota, sits down with Allen Gray, Managing Director at Silvercrest Asset Management Group. With decades of experience in institutional sales and marketing, Allen shares insights into his career, leadership philosophy, and the evolving landscape of institutional investing.Allen begins by discussing his career journey, which started at Kidder, Peabody & Company despite having no formal business education. He quickly adapted, completing accounting courses and participating in a management training program. After the firm's acquisition by General Electric, he sought partnership opportunities and co-founded Radnor Capital Management, growing assets from $10 million to $1.6 billion in six years before selling to U.S. Trust Company. Later, at Osprey Partners, he helped expand assets from $800 million to $4.2 billion in just two and a half years. At Silvercrest, Allen was tasked with building an institutional business from the ground up. When he joined in 2008, the firm had $6.5 billion in ultra-high-net-worth assets but only $100 million in institutional assets. Through strategic acquisitions and disciplined growth, Silvercrest now manages $10 billion in institutional assets, with top clients averaging over $400 million each. The firm has expanded investment capabilities, adding growth and international strategies.Allen's sales strategy emphasizes process over volume. His teams are structured into small, specialized silos with dedicated investment, client service, and business development professionals. He stresses relationship-building over transactional sales, ensuring long-term partnerships. Silvercrest also leverages subadvisory relationships, allowing distribution through larger platforms without engaging in retail sales.Communication and transparency are essential to Allen's leadership. Silvercrest tracks an "actionable pipeline", focusing on opportunities likely to close within six months. His trust-based leadership allows experienced professionals the freedom to execute their responsibilities while maintaining accountability. He prioritizes hiring skilled individuals, providing them with the right tools, and minimizing bureaucracy. For young professionals entering the fundraising business, Allen advises deep investment knowledge beyond sales materials. Understanding market dynamics, analyzing performance data, and maintaining transparency in tough times are key to success. He highlights industry challenges, including increased competition from consulting firms offering multi-manager funds, making direct institutional outreach more crucial.

When should you rebrand? In the changing marketplace, you may want to rebrand at a different time now than you would have wanted to in the past. Listen as Paula and Derek Slayton explain when you should consider rebranding and if your current brand promise is still achievable. Paula and Derek also discuss the language of branding, how PR and advertising can work together and why you should continue investing in marketing or the relationships you have, even when money is tight.     3:26 – Derek explains how his career started at printing companies and a newspaper.   4:44 – Paula talks about her career path, from getting a teaching degree to nursing and psychology.   5:51 – Paula describes Trampoline's competitive edge by putting employees first.   9:18 – Derek shares the best times to rebrand.   11:27 – Derek gives an overview of the language of branding.   20:49 – Paula explains why it is important to continue investing in marketing during a recession.  24:26 – Derek talks about stock versus custom photography.  27:19 – Paula describes the difference between being excited to sell and being desperate to sell.   29:50 – Derek shares how PR and advertising can work together to achieve marketing goals.   31:29 – Paula and Derek share some resources that have helped them.     Quotes   “I think that traditionally, a lot of times, the situation comes up where there's a leadership change or a transition. There are times when a new service or product is offered that maybe takes the company to a different position in the marketplace. Those are typically times that you'd see a rebrand happening to reflect that, but I think now with social being so prominent and the marketplace being so different, so finicky, it's more like when your audience is not talking about you...” – Derek Slayton    “…I would add to that, you really have to look inward because the truth is your brand is your promise, and then your ability to deliver on that promise. You have to keep looking inward to make sure that the promise you're making that you say you can do still holds water a year later, two years later, three years later and are you able to deliver on that?” – Paula Slayton    Links:   2Bobs Podcast: https://2bobs.com/   How I Built This with Guy Raz: https://podcasts.apple.com/us/podcast/how-i-built-this-with-guy-raz/id1150510297     About the guests:      Paula Slayton brings more than 20 years of business management to her work at Trampoline. You'll learn incredible insight into getting a feel for a neighborhood and developing expertise in a niche market in this interview with Wendy Berger, principal of WBS Equities, LLC. For more than 30 years, Wendy has been involved in the real estate business as a developer, lender, property manager, broker, and investor. She began her career at American National Bank and Trust Company of Chicago in commercial lending. Wendy also spent several years as a principal with Berger Realty Group, an 80-year-old family-owned real estate business, where she focused on residential and industrial property management and development. She was responsible for managing 3,000 apartment units, 200,000 square feet of commercial space, and 250,000 square feet of industrial space. Wendy has also paired her decade of experience in technology startups with her real estate knowledge for successful outcomes. Wendy grew up in a family that was involved in the real estate business in Chicago and has memories of playing at construction sites as a child. She vividly recalls riding through the same neighborhoods repeatedly, as her relatives observed trends in the area and looked for indicators that change was coming. This background helped her establish the value of getting on the ground to find opportunities. “You cannot buy or build real estate sitting at your desk,” she says. After spending time in the technology space, Wendy spotted a real estate investment project and purchased an older hotel in Chicago, which she renovated both physically and digitally. Taking advantage of the rising trend in online bookings, she successfully marketed the hotel and increased the number of rooms rented. She went on to sell the property in early 2007 and applied the lessons she learned to her next deals. Through her connections, Wendy was given an opportunity to oversee the construction of a pizza manufacturing facility. After completing the project successfully, she realized a great opportunity in building food manufacturing and food distribution facilities. She has formed a team of experts to help carry out these projects which often involve long-term commitments. She actively invests alongside her partner and keeps terms simple to make returns easy for everyone involved. Wendy serves on the board of directors for Green Thumb Industries and has branched into the cannabis space in recent times. Today Wendy regularly mentors young women who are interested in the real estate industry and encourages other to make courageous career moves. “Think big and don't worry about whether it's possible or not,” she says. “Big thinking precedes great accomplishments.” You can connect with Wendy at LinkedIn or at her website WBS Equities, LLC. This is Garrison Hardie with your CrossPolitic Daily News Brief for Tuesday, March 28th, 2023. We start today with the heartbreaking situation that unfolded in Nashville TN, Three children and three staff members were gunned down at a private Christian school in Nashville on Monday before the shooter, a heavily armed 28-year-old woman, was killed by police, authorities said. The shooting unfolded at The Covenant School on Burton Hills Boulevard where officers "engaged" the attacker, described by Metropolitan Nashville Police Chief John Drake as a woman who appears to be a former student at the school. Nashville School Shooting: Police chief provides update- Play 0:05-2:42 https://www.nbcnews.com/news/us-news/school-shooting-tennessee-leaves-multiple-injured-shooter-dead-officia-rcna76841 Shooting at Nashville Christian school leaves at least 3 children and 3 adults dead, officials say The shooter was identified as Audrey Hale, a Nashville resident, three law enforcement officials briefed on the matter told NBC News. The shooter was killed on the school's second floor, a police spokesperson said. She had two "assault-type rifles and a handgun," according to the official. Students of the school, which serves preschool students through sixth graders, were being bused to Woodmont Baptist Church, two miles away, to be reunited with their parents. Police said they first got calls about the shooter at 10:13 a.m. CT and Nashville firefighters first reported their personnel were responding to an “active aggressor” at 10:39 a.m. CT. "The police department response was swift," police spokesperson Don Aaron told reporters. Five police officers came upon the shooter and two opened fire on her, Aaron said. The shooter entered the school through a "side entrance" on the first floor, he added. It was not clear how the shooter gained access to the school. One officer was hurt by shattered glass, officials said. The names and ages of the victims have not been released. The chief said the families of all six victims had been notified. Please lift that school, and those affected families in your prayers. https://www.washingtonexaminer.com/policy/education/republicans-introduce-resolution-scrap-student-forgiveness Republicans announce resolution to scrap Biden student loan forgiveness plan Rep. Bob Good (R-VA) and Sen. Bill Cassidy (R-LA) announced legislation Monday to scrap President Joe Biden's student loan forgiveness program. Under the resolution, Congress will express disapproval of the student loan cancellation plan to overturn the program, which is stuck in limbo amid a court battle. The resolution will need a simple majority to clear the Senate and is expected to draw a veto from Biden. On the Senate side, Sens. John Cornyn (R-TX) and Joni Ernst (R-IA) are backing the Congressional Review Act resolution alongside Cassidy, the ranking member of the Senate Health, Education, Labor, and Pensions Committee. Biden unveiled the student loan forgiveness plan last August to much fanfare from progressives. Under the initiative, borrowers with an annual income of $125,000 or less can have up to $10,000 in federal student loans canceled, while those who received Pell Grants during their schooling can have up to $20,000 wiped out. The program stems from the 2003 HEROES Act, which grants the executive power to relieve student loan debt in times of national emergency or war. Critics have pointed out that Biden deemed the COVID-19 pandemic was "over" in a 60 Minutes interview last year. The pandemic was used as justification for using the HEROES Act. Last November, a lower court in Texas halted the program amid pending legal challenges. The Supreme Court is expected to rule on the program's legality by June or July. The White House says it has amassed roughly 26 million applications and approved 16 million for relief, but cancellation has not yet taken place amid the legal wrangling. Biden used his veto power for the first time last week to reject a resolution that would've nixed a Labor Department rule permitting retirement plans to take into account environmental, social, and governance considerations in investment decisions. https://www.foxbusiness.com/markets/fdic-first-citizens-bank-reached-deal-purchase-silicon-valley-bank FDIC says First Citizens Bank has reached deal to purchase Silicon Valley Bank The Silicon Valley Bank finally has a buyer. On Sunday, the Federal Deposit Insurance Corporation (FDIC) announced First-Citizens Bank & Trust Company of Raleigh, North Carolina entered a purchase agreement for all deposits and loans of Silicon Valley Bridge Bank, National Association. "The 17 former branches of Silicon Valley Bridge Bank, National Association, will open as First–Citizens Bank & Trust Company on Monday, March 27, 2023," the FDIC said in a statement. "Customers of Silicon Valley Bridge Bank, National Association, should continue to use their current branch until they receive notice from First–Citizens Bank & Trust Company that systems conversions have been completed to allow full–service banking at all of its other branch locations," the statement continued. Depositors of the Santa Clara, California-located bank will automatically become depositors of First–Citizens Bank & Trust Company, according to the statement, and all deposits will be assumed and insured by First–Citizens Bank & Trust Company, up to the insurance limit. The FDIC said: "As of March 10, 2023, Silicon Valley Bridge Bank, National Association, had approximately $167 billion in total assets and about $119 billion in total deposits. Today's transaction included the purchase of about $72 billion of Silicon Valley Bridge Bank, National Association's assets at a discount of $16.5 billion." In addition, approximately $90 billion in securities and other assets will remain in the receivership for disposition by the FDIC. According to the statement, the FDIC and First–Citizens Bank & Trust Company entered into a "loss–share transaction" on all commercial loans it purchased from Silicon Valley Bank (SVB). The FDIC estimated SVB's failure cost approximately $20 billion, although a cost will be more accurately determined when the FDIC terminates the receivership, it said. The FDIC created Silicon Valley Bridge Bank after the California Department of Financial Protection & Innovation closed Silicon Valley Bank on Friday, March 10. All of the deposits—both insured and uninsured—were transferred to the bridge bank. Alps Precious Metals Group THE PAST WEEK HAS BROUGHT SOME “EXCITEMENT” TO THE MARKETS. BANK RUNS. STOCK COLLAPSES.
