ST. PETERSBURG, FL - ICA (Intelligent Communication Assistant), a communications security and AI assistant platform, took center stage at the Cloud Communications Alliance's Cloud Connections 2025 event with a solution aimed at eliminating robocalls, scams, and fragmented branded calling experiences. Michael Gough, founder of ICA, presented during the event's inaugural product showcase and outlined how the platform leverages artificial intelligence to identify unwanted or fraudulent communications in real time. “There are more than 40 billion robocalls, 20 billion scam texts and a trillion phishing attempts annually,” said Gough. “We're at an inflection point. ICA brings together voice, text, email and branded calling into one AI-powered framework.” Gough explained that ICA works similarly to navigation apps like Waze, learning from user behavior across a distributed network. When a robocaller or scammer contacts one ICA user, the behavior is analyzed and logged so that future calls from the same entity can be blocked systemwide. Unlike existing solutions such as STIR/SHAKEN, which Gough noted cannot cover all traffic types or legacy systems like TDM, ICA uses behavioral fingerprinting and network metadata to make real-time determinations about the legitimacy of a call or message. For calls from known and trusted sources such as a school or hospital, ICA allows communication to pass through without interruption. Beyond fraud detection, ICA also serves as a digital assistant, with features such as calendar-aware call handling, automated appointment scheduling, and adaptive call routing based on user preferences. Gough said ICA is currently available via licensing partnerships and is seeking additional partners, such as service providers, CPaaS platforms, and branded calling vendors. “We're here to complement and enhance the systems they already have in place,” he said. Does your nonprofit want to build power and amplify its impact by engaging in robocalling and texting campaigns? Would it surprise you to find out that while this type of advocacy can effectively boost your reach and put you in touch with thousands (even millions) of supporters, it also comes with rules related to opt-out requirements, mandatory disclaimers, prior consent, and more? On this episode, we'll introduce you to our new Robocalling guide and walk through several of the issues your nonprofit needs to think about before you pick up the phone or click send on a robocall or robotext campaign.     Attorneys for this Episode  Monika Graham  Melissa Marichal Zayas  Natalie Ossenfort    Robotext and Robocall Campaigns  Federal Communications Commission (FCC), Federal Trade Commission (FTC), and Federal Election Commission (FEC) each regulate robocalls and robotexts  For example, the Telephone Consumer Protection Act (TCPA), enforced by the FCC, strictly limits when organizations can make robocalls and robotexts. Violations of TCPA can result in stiff fines, so know the rules before you launch your next campaign.  Keep in mind that many states also have their own rules on these communication methods.  Federal Restrictions on Robocalls / Robotexts  What are robocalls and robotexts? Calls or texts made with an autodialer or using an artificial or pre-recorded voice.   Under federal law (the TCPA), a nonprofit organization must obtain an individual's “prior express consent” to: (a) send a call or text to a cell phone using an autodialer, a prerecorded voice, or an artificial voice, or (b) to send more than three prerecorded or artificial voice calls to a landline in a 30-day period.  Express consent requires:  The person gave permission to be contacted at their cell phone number.  The call is within the scope of the consent given.  The person hasn't revoked their consent.  Prior express consent is not the only consideration you need to think about before engaging in robocall or robotext campaigns. Identification, opt-out, and disclaimer requirements are going to be relevant too.  For example, federal law requires that all pre-recorded voice telephone messages to cell phones or landlines must include a specific identification disclaimer. Disclaimer must:  Clearly state at the beginning of the message the official registered name of the organization initiating the call, and  The telephone number of the organization (not the number of the vendor who placed the call, a 900 number, or a number for which charges exceed normal local or long-distance transmission charges).  Disclaimers may also be required if a non 501(c)(3) organization expressly advocates for or against a federal candidate or solicits contributions in relation to a federal election --> triggering federal campaign finance law, which is enforced by the FEC.  This type of disclaimer should not apply to 501(c)(3)s which are prohibited by the Internal Revenue Code from supporting or opposing candidates for public office.  Likewise, the IRS may require a disclaimer if fundraising solicitations are made by non-501(c)(3)s reminding the potential donor that contributions are not tax deductible.    Remember: State Law Matters Too!  Many states restrict certain types of calls, like robocalls. When they do, they often apply to both cell phones and landlines.  In many instances, state laws are similar to the federal rules, but variations between state and federal law do exist, and some states restrict calls that would otherwise be allowed under federal law.  Consult with counsel before launching your campaign because common state law requirements include:  Notification or self-identification requirements  Time restrictions  Geographic limits  Permit requirements  Prohibitions on caller ID blockers  And more!  State law may also require lobbyist or campaign finance registration and reporting in some instances.    FAQ New Robocalling guide contains a handy FAQ, where you can find answers to common questions like:  What are the best ways to collect cell phone numbers for these types of campaigns?  Are landlines treated differently than cell phones?  What happens when a cell phone number is reassigned to someone other than the person who provided consent?    Resources  Robocalling Rules: Before You Pick Up the Phone, Hold That Call. Combatting robocalls has been and continues to be an important area of enforcement for State Attorneys General, as we have previously reported. This Day in Legal History: Welfare ReformOn August 22, 1996, President Bill Clinton signed the Personal Responsibility and Work Opportunity Act into law, marking a significant overhaul of the American welfare system. This legislation introduced strict work requirements for welfare recipients, imposed a lifetime limit of five years on receiving benefits, and replaced federal welfare entitlements with block grants to states, allowing them to set their own eligibility criteria. While the act aimed to encourage self-sufficiency and reduce dependency on government aid, it also had profound and often harmful consequences. The law disproportionately affected low-income families, particularly single mothers, by forcing them into low-wage jobs without adequate support for child care or job training. The five-year cap on benefits led many to exhaust their aid without securing stable employment, pushing them deeper into poverty. Additionally, the block grant system gave states significant discretion, leading to disparities in welfare assistance across the country and often resulting in reduced support for the most vulnerable populations. While the act succeeded in reducing welfare rolls, it did so at the cost of increasing economic insecurity for many families, highlighting the complex and often punitive nature of welfare reform in America.Following the U.S. Supreme Court's 2023 ruling that banned affirmative action in college admissions, the Massachusetts Institute of Technology (MIT) saw a significant drop in the racial and ethnic diversity of its incoming freshman class. The percentage of Black, Hispanic, Native American, and Pacific Islander students fell to 16% from 31% in previous years. In contrast, the proportion of Asian American students increased from 41% to 47%, while the percentage of white students remained stable.MIT President Sally Kornbluth acknowledged the decrease in diversity as a consequence of the court's decision and stated that despite the class's overall excellence, it lacks the broad racial and ethnic representation that the institution has historically aimed to achieve. MIT and other colleges have been revising their admissions strategies to comply with the ruling, but these efforts have not fully mitigated the impact on underrepresented minority groups. In response, Stone recently signed a 30-year contract with Walden Renewables to convert his polluted farmland into a solar energy site, marking a reluctant but necessary shift to survive financially. Maine has developed innovative strategies, including prioritizing PFAS-contaminated farms for renewable energy projects, to help affected farmers like Stone. The state aims to meet its renewable energy goals while offering a lifeline to farmers whose lands have been compromised by PFAS.Despite the solar option providing some relief, it's not the first choice for most farmers, who initially respond with grief and anger to the loss of their agricultural livelihoods. Moreover, only certain properties are suitable for solar energy, limiting the number of farmers who can benefit. While Maine's approach is seen as a potential model, more comprehensive solutions are needed at the federal level to address the widespread issue of PFAS contamination and its impact on farmers.Maine's Solar Incentive Helps Farms Spoiled by Forever ChemicalsLingo Telecom has agreed to pay a $1 million fine for transmitting AI-generated robocalls that falsely imitated President Joe Biden in an effort to dissuade New Hampshire voters during the Democratic primary election. The robocalls, orchestrated by political consultant Steve Kramer, used voice-cloning technology to spread disinformation. The Federal Communications Commission (FCC) initially proposed a $2 million fine but settled at $1 million, requiring Lingo to implement stricter compliance with caller ID authentication rules.Kramer, who worked for Biden's challenger, U.S. Representative Dean Phillips, and admitted to paying for the calls, now faces additional charges and a proposed $6 million fine from the FCC. The incident has heightened concerns in Washington about the potential for AI-generated content to mislead voters in the upcoming elections. Finding a solution to stop spam calls to you, your family, or your business isn't easy. We may not win this war, but we don't want the government making this decision for us. We can make it more manageable in the meantime. Today's guest is Aaron Foss. After winning the FTC Robocall Challenge in 2013, Aaron started Nomorobo. Since then, Nomorobo has stopped billions and billions of unwanted robocalls and spam texts from reaching our phones, and it was acquired by Applause group in August 2023. Aaron has been featured in The New York Times, Wired, CNN, CNBC, Fox News, and countless other media outlets. He has testified in front of Congress, not once, not twice, but three times. Show Notes: [1:14] - Aaron shares his background as a serial entrepreneur in the intersection of technology and business. [3:57] - At the beginning, Aaron didn't even know what a robocall was. [6:47] - Robocalls have this negative connotation. They can actually be good. But there are many that are unwanted. [8:13] - There are different types of robocalls and there is a differentiation between spam and scam calls. [10:08] - Aaron explains why spam emails are easier to block than robocalls. [12:20] - There are some robocalls that are necessary and helpful for some people. That is one reason why not all robocalls can be blocked. [13:40] - Not answering the phone is not a plausible solution. [15:50] - Nomorobo is basically a series of bots talking to other bots. [16:50] - Aaron describes caller ID and how spoofing a number is possible. [19:42] - This is such a big problem because the barrier of entry is low. [21:08] - It is amazing that we can call anyone in the world. But that also means that scammers can, too. [22:53] - This is a complicated problem, and the future solution is a combination of government regulation, companies like Nomorobo, and AI. [26:29] - We are never going to win the war, but we can keep it manageable. [29:45] - What is the role of the carriers when it comes to robocalls? [31:47] - Keeping scammers on the phone does not make the problem go away. [33:52] - Some scams are seasonal and some are evergreen, like Medicare calls. [36:26] - Aaron explains the different ways these scams can be done and the range of damage they can do. [39:56] - At best, this is an annoyance. But there are people in our lives that are vulnerable and less protected. [44:42] - Sometimes, Nomorobo users have to turn it off for specific reasons and specific calls they're waiting for. [47:56] - This problem is an example of “death by a thousand papercuts.” [49:30] - There are some red flags and things you might notice if you answer robocalls that could indicate that they are scams. [50:46] - This seems like an easy problem to solve, but it is far more complicated than most people think. [52:00] - Aaron describes what it was like to testify in front of Congress. Telemarketing calls have become both annoying and hard to avoid – but these days, that voice on the phone calling you at dinner time might not even be human. More and more, marketers, political activists, and scammers are using AI deepfakes to make their robocall messages even more convincing by simulating the voice of celebrities, politicians, and even your own family. The technology is so powerful that the messages can even integrate personal information about you, your interests, and your family that has been sourced online. Some scammers even record the calls to capture enough samples of your voice that they can train an AI to sound like you – so always be careful about how much you say to telemarketers, and never say the word ‘yes' as it can be played back to hack phone banking and other systems. Calls directed to you at work may be targeting you because of your job description, your approval powers for financial transfers, or your influence on other company executives. Don't be afraid to just hang up – and then pick up the phone to verify whether the caller was who they said they were. Earlier this year, the Federal Communications Commission declared AI voice cloning robocalls to be illegal, and the agency is in the process of formalizing rules that will force companies to tell you if their robocall is AI generated, and offer ways of protecting you from such calls.
