The police tactic of stop-and-frisk is back in the news and has become a campaign issue in the 2023 elections in Philadelphia. Some candidates for mayor and for city council have suggested that escalating its use against pedestrians in the city should be on the table as a public safety measure. For 12 years, the ACLU of Pennsylvania and co-counsel from the law firm Kairys Rudovsky Messing Feinberg and Linn have been enforcing a settlement in a 2010 lawsuit against the city over the aggressive, illegal, and unconstitutional use of stop-and-frisk by Philadelphia police. In this episode, we hear from the Rev. Mark Tyler of POWER, Yahaira Galarza, a community ambassador for ACLU-PA, and Mary Catherine Roper, former deputy legal director of the ACLU of PA. Thankfully, both police officers are doing well and have been released from the hospital. Kathy Barnette—former Candidate for U.S. Senate—joins the show to discuss a group of nine Pennsylvania Republicans who have created a super PAC supporting Democrat nominee for governor, Josh Shapiro. Supporters of the PAC are referring to themselves as “Never Mastriano.” Barnette believes inter-party opposition is a major mistake and emphasizes Doug Mastriano's competitive polling despite being substantially outspent by Shapiro's campaign. Barnette adroitly asks, “What has Shapiro done that isn't partisan? What has he done to bring our state together?” City Council President Darrell Clarke has suggested that Philadelphia should consider re-adopting “stop and frisk” policies to help combat the city's unmitigated gun violence, emphasizing that it would need to be done in a “constitutionally” acceptable way. While speaking with reporters, Mayor Jim Kenney stated that he would likely not be in favor of stop and frisk policies being enacted.

Join The Gist of Freedom Sunday June 10th at 8pm~ Listen to Constitutional Law Professor, Gloria Browne-Marshall as she lectures on Stop and Frisk and gives us an update on Zimmerman's latest arrest and Trayvon's Road to Justice. On May 16, a federal judge granted class Action Lawsuit (certification in a lawsuit) challenging the New York Police Department's stop-and-frisk practices as unconstitutional and racially discriminatory. The ruling will allow all persons unlawfully stopped and frisked since January 2005 to be plaintiffs in the lawsuit. The plaintiffs are represented by the Center of Constitutional Rights (CCR), and the law firms of Beldock, Levine, and Hoffman and Covington & Burling, LLP. Gloria J. Browne-Marshall received the Ida B. Wells-Barnett Justice Award for her work with civil rights and women's justice issues. A former civil rights attorney, Browne-Marshall is an Associate Professor at John Jay College of Criminal Justice (CUNY) teaching Constitutional Law, Race and the Law, and Evidence. She is a member of the Gender Studies faculty of John Jay College as well as a member of the bar of the Supreme Court of the United States. A free-lance journalist and an award-winning playwright, her most recent play is titled "Diversity" and examines marriage choices.
