The Commonwealth saved one of its most direct challenges to Lindsay Clancy's account for its final rebuttal witness. Dr. Gregory Saathoff, a forensic psychiatrist who has worked with the FBI's Behavioral Analysis Unit for three decades, compared what Lindsay told him with her medical records, digital searches, Patrick Clancy's account and the physical sequence of events on the day she killed her children. His testimony does not negate the serious mental illness described throughout this trial, and it does not decide the case by itself. The Lindsay Clancy trial is difficult to watch because nearly every discussion has centered on Lindsay's mental health, her treatment and whether she was experiencing psychosis. Meanwhile, her children, Cora, Dawson and Callan are feeling like footnotes in the case, even though they are the reason everyone is in that courtroom. I think we can recognize that Lindsay was seriously ill without losing sight of what happened to her children. This episode looks at the Commonwealth's claim that she deliberately created time alone with them, what the defense says psychosis did to her ability to understand and control her actions, why this case did not end with a negotiated resolution, and what choices the jury may actually have when deliberations begin.I also want to compare Clancy's case with John du Pont, James Holmes, Jeffrey Dahmer and Jared Lee Loughner, all of whom had serious mental-health problems but were still held criminally responsible. That does not make these cases equal, and it does not settle Lindsay's case. It helps explain why proof of mental illness is only part of what this jury must consider. We also need to remember that the jurors heard the 911 call and saw medical evidence that people watching remotely did not. The Lindsay Clancy trial has moved into the psychiatric care she received before she killed her three children, and the testimony is raising difficult questions about fragmented treatment, repeated medication changes, telehealth and what people mean when they accuse a patient of “doctor shopping.” In this episode, I lay out how many providers were involved, what Lindsay may have been seeking, what the treatment history gives the defense and what it does not prove about criminal responsibility. I also examine defense attorney Kevin Reddington's aggressive cross-examination of Dr. Jennifer Tufts, including the disputed notation about “not hyper” and “pressured speech.” Was Dr. Tufts changing her explanation, or did the defense turn a poorly written line into something far larger than the evidence supports? Michael O'Brien was 33 years old, a father of two young daughters, a lifelong cyclist, and a corporate executive chasing the next version of success when a distracted driver in a Ford Explorer crossed into his lane and hit him head-on at 40 miles per hour in New Mexico. His trauma team had no idea how he survived. His first surgery took 13 hours. He needed 36 units of blood. Why can two people walk through the same place and notice completely different warning signs? In this special Profiling Evil episode, we'll draw on lessons from law-enforcement and behavioral-analysis alongside a fascinating peer-reviewed study by Robert A. Chaney, PhD, Alyssa Baer, MPH, and L. Ida Tovar, MPH. The researchers asked 571 college students to examine campus walking environments under changing conditions of lighting and entrapment. Women tended to focus more on bushes, darkness, and areas outside the path, while men tended to focus more directly on the path ahead.Those differences don't tell us that one gender is naturally better at detecting danger, nor does the study measure actual victimization or predict who would avoid an attack. What it gives us is a useful way to think about our environment and the blind spots that increase our chances of being victimized. We'll explore how offenders take advantage of location, situation and circumstances to get the upper hand on their intended victims and we'll talk about how simple choices can lower exposure without surrendering your freedom. Days seven and eight of the Lindsay Clancy trial brought the jury toxicology results, DNA findings, testimony from the children's former nanny, friends and relatives, and deeply difficult medical evidence concerning the murders of Cora, Dawson and Callan Clancy. In this episode, I explain what that testimony added to the prosecution's case, what it may have handed to the defense, and why the emotional force of this trial may become as important as the legal arguments over criminal responsibility. I also examine a harder question of whether a public murder trial is the best available form of justice when nobody disputes who killed these three children, but the parties sharply disagree about whether their mother was legally responsible because of psychosis. Finally, I look at the decision to have two women prosecute this case and why it would be irresponsible to assume that female prosecutors, or female jurors re naturally less sympathetic to postpartum mental illness. The Tyler Robinson preliminary hearing is less about dramatic testimony and more about the fight over what the judge, the public, the media, and eventually a jury pool should be allowed to hear before trial. Investigators testified about the investigation after Robinson turned himself in, Robinson's roommate and his statement and whether it will be admitted into evidence. Prosecutors wanted the audio played in open court and the defense is fighting it because they believe it contains statements the state will later characterize as confessions. Erika Kirk, victim Charlie Kirk's widow is pushing for full transparency and asked the court to allow the evidence to be made public for the world to see.It seems the court will bind Robinson over for trial, the evidence has been overwhelming that he was on the campus, in proximity of where the shot was fired from and recorded fleeing the area with something that could be considered a weapon in his hands after the shot. So why is this judge being so cautious? Is it concerns of later appeals, the fact this is happening on a global scale or is he simply being a judge and considering whether public trust, media coverage, conspiracy claims, and the defendant's rights are balanced. Agent Hull's testimony in the Tyler Robinson preliminary hearing gave us a much better look at how prosecutors are trying to move this case forward. The judge is not deciding guilt at this stage, instead he's trying to determine if there is reasonable cause to bind Tyler Robinson over for trial in the shooting death of Charlie Kirk at Utah Valley University. Pay attention to the way investigators place Robinson on the UVU campus multiple times on the morning of the shooting, first in shorts and a red shirt, later with a blue backpack, and then later again in different clothing while walking with what Agent Hull described as “a gait or a limp.” Prosecutors used the video evidence to track the person they identify as Robinson moving toward the rooftop where he allegedly laid prone at the corner of the roof before the shot was fired. Then, he ran with something in his hands to the corner of the rooftop where he scaled down the building and ran into a nearby wooded area. He didn't take the stairs, and the video supports the claim that the clothing matched that worn by Tyler Robinson when he was seen going to the rooftop. The important question for today is not whether every issue has been proven for trial. It's whether the state showed enough reasonable cause to move this case forward to a trial. This powerful testimony may also support the prosecution's larger argument about planning, preparation, premeditation, flight, and eventually a possible death penalty case. Day one of the Tyler Robinson preliminary hearing in Utah was exactly what I expected it to be, slow, procedural, and at times rather painful. This was not opening statements in a trial. This was the prosecution beginning the process of showing the judge that there is enough probable cause to send the aggravated murder case against Tyler Robinson forward to trial in the shooting death of Charlie Kirk at Utah Valley University. Let's examine the first day of testimony that included the presence of Charlie Kirk's widow and family. We heard from the officer who discovered the shooters “sniper pad” and saw and heard from video, graphic evidence and parts of the autopsy report. The defense scored a win when the judge refused to admit a prosecution-created video compilation because it had been altered with zooms, red circles, and other edits.We'll also look at what the prosecution seems to value the most right now in the form of video, geography, line of sight analysis and a careful chain from the shooting scene to the suspected escape route. I also want to discuss what the state seemed to avoid on day one, including deeper motive evidence, DNA, ballistics, etched rounds, and any full discussion of alleged admissions. You'll be surprised with the number of defense objections in this first day of testimony when they argued repeatedly against photos, videos and even written statements. The Tyler Robinson preliminary hearing is underway in Provo, Utah, and this could give the public its first real look at the evidence in the Charlie Kirk murder case.
