Spotify suddenly deletes comedy albums: Could it be sued for $100 million-plus? (Talking Trends)

Welcome to the latest episode of Talking Trends, the weekly podcast from Music Business Worldwide – where we go deep behind the headlines of news stories affecting the entertainment industry. Talking Trends is supported by Voly Music. This week on Talking Trends, MBW founder, Tim Ingham, explains why Spotify deleted a swathe of comedy albums from its service over the Thanksgiving weekend – and why it might be at the mercy of big-money lawsuits in the weeks and months ahead.Ingham (pictured) explains that two prominent companies now operating in the world of comedy royalty collection and administration – Word Collections and Spoken Giants – are each respectively run by two music industry veterans who are experts in the intricacies of licensing in the US: Jeff Price (Word Collections), the founder of Audiam and TuneCore; and Jim King (Spoken Giants), a former senior figure at US collection society BMI.Spotify has suddenly removed comedy albums by stand-ups ranging from Kevin Hart to Tiffany Haddish, Jim Segura and Robin Williams – as Jim King accuses the streaming company of knowing "they don't have all the rights in place to serve this content".That's a reference to the rights to the underlying lyrical content of each piece of performed stand-up. Spotify has the licenses to the recordings, but possibly not this underlying right – the equivalent of the publishing right in music. In music, such rights are now covered by the Mechanical Licensing Collective (MLC) in the United States, ensuring that Spotify has cleared rights to every song on its platform from the get-go.But this wasn't always the case: In 2016, Spotify was sued by songwriters such as Melissa Ferrick and David Lowery for hundreds of millions of dollars in damages, having allegedly not obtained the mechanical licenses required to host their music. (Spotify eventually settled in a class action case against these and other songwriters, via a $43 million fund.)Comedy routines are not currently covered by the MLC.On Talking Trends, Ingham wonders aloud if Price and King may have spotted an "opportunity or injustice" to discuss a similar settlement with Spotify for these analogous rights in comedy. If a party could prove "wilful copyright infringement" by Spotify on this score, Ingham notes, the streaming company could be on the hook for up to $150,000 in damages for every comedy 'track' infringed.Says Ingham: "The fact that Jeff Price has been able to raise $3.5 million in investment for Word Collections in the in the past few weeks doesn't surprise me. Maybe opportunity knocks here, and his investors can see that."Ingham further suggests that this story could have ramifications for Spotify far beyond comedy: "Jim King's company [Spoken Giants] defines itself as representing rightsholders who make 'spoken word content' – not just comedy content. And spoken word content, whether that's podcasts or the more obvious analogous world of audiobooks, is a big part of Daniel Ek's future strategy for Spotify. "

Consumers buy these products to use on something that they enjoy — their vegetable garden, their flowers, or the lawn their kids play on. That's why ScottsMiracle-Gro's purpose is to bring goodness to every person and every patch of the Earth. This applies to the next generations of gardeners, too: ScottsMiracle-Gro is encouraging childrens' love for the outdoors through gardening programs in an effort to nurture future stewards of the environment. If you've listened this month, you know that we're celebrating Dads here in June and, specifically, we're talking with folks who were greatly influenced by their fathers. This week's guest is particularly intriguing because it can be fascinating when a son or daughter decides to follow in his or her father's footsteps...especially when that's in the media.Jim King was a legendary journalist, working for the Chicago Tribune and then a couple of radio stations before eventually helping to launch WQAD-TV up in the Quad Cities area -- and he had a couple of interesting stops in the middle. For nearly 40 years, Jim King's oldest son, Kris Ketz, has been a fixture at KMBC-TV and two of Jim's grandsons -- Kris' sons -- have followed in his footsteps...one in radio and one in TV.In case you're not familiar with Kris, here's part of his credentials: he is an Emmy-award winning anchor and investigative reporter, having captured a Midwest Emmy for best anchor in 2008. He also won in 1991 for an in-depth report on the influence of the Ku Klux Klan in the Kansas City area. He was nominated for a 2003 Emmy for best anchor, and nominated for a 2011 Regional Emmy award for “general assignment reporting.” In 2015 he was one of four local news anchors chosen to interview President Barack Obama in a one-on-one interview.Kris is a graduate of St. Ambrose University in Davenport, Iowa. He began his broadcasting career at the age of 18 as a weekend news anchor for radio station WQUA in Moline, Ill. He progressed to afternoon and morning anchor, until he became the station's news director. And in 1998, about a year before Jim King died unexpectedly, Kris and Jim co-anchored the Father's Day edition of KMBC 9 News at 10.Kris takes a swing at our Pregame Batting Practice and then discusses his dad's legacy, following in his footsteps, and being the father of two in the media. And much more.LINKS:For more information about the C-10 Mentoring & Leadership program for high school students, including the application process for current high school freshmen and sophomores, visit our website. For all episodes of the C-10 podcast and ways you can listen, click here.If you'd like to make a comment, have a suggestion for a future guest, or your company would like to help underwrite this podcast, please visit our contact page.

Holly Street runs north-south through metro Denver. I've always lived within walking distance of Holly, but miles south of 34th and Holly in Park Hill. I knew about the Holly Shopping Center from growing up in Denver, and from working as a Denver prosecutor for sixteen years.    Julian Rubinstein has authored The Holly: Five Bullets, One Gun, and the Struggle to Save an American Neighborhood. It's a compelling story about former gang member Terrence Roberts and the history of Park Hill, Denver, gangs, cops and USA. There's never been a book quite like this about Denver.   Bill Buckley was a legendary Denver Chief Deputy DA who prosecuted for 26 years and showed me some ropes. Buckley reminisces about mean streets of Denver, including his responding to the 12-10-75 murder of DPD Homicide Detective Don DeBruno on Broadway. We talk about Denver crimes back in the day.   Buckley prosecuted 56 murder cases including the United Bank Massacre (Father's Day 1991), also on Broadway. Ex DPD Sgt. Jim King was put on trial and acquitted but Buckley still argues King's guilty. James Lowe was found guilty of horrible 6-26-79 murder on West Quincy Avenue at Pinehurst CC in Denver, a case Buckley brings to dramatic life.    Troubadour Dave Gunders sings sweet sad song about leaving one's homeland, chased out by events. Louisiana Goodbye speaks of lost communities and struggles to reclaim homes. Some seek to reclaim history. We discuss The Alamo and whole lot more. Key to history is to get the facts straight.   Peter Boyles rarely gets his facts straight. In a further takedown of this bad historian, we play sound of Boyles claiming governmental treatment of Christian baker Jack Phillips is Nazi-like. But Boyles lies. His views are skewed. We've got the sound.   Rundown -   Julian Rubinstein - 02:25   Bill Buckley in Craig's Lawyers' Lounge - 01:00:34   Dave Gunders - 02:12:49   Craig takes on Boyles' bigotry - 02:34:22
