This week in Nova Scotia and Canadian legal news, the biggest story is the early resignation of RCMP Commissioner Brenda Lucki. Commissioner Lucki was under fire for her performance during the Freedom Convoy, as revealed in the Emergencies Act Inquiry. As well, she was featured in some controversial moments in the Mass Casualty Commission in Nova Scotia. I argue that she was made a scapegoat in that scenario. The next Commissioner is going to have a difficult job to do, potentially being tasked with a re-imagining of the RCMP as an entity. The NS Court of Appeal released their decision on the Crown appeal of the acquittal of Colin Tweedie regarding the death of a young girl he struck with his car near Sydney. The Court said that the trial judge failed to apply the proper laws on impaired driving, and also failed to consider the issue of willful blindness as to whether he had struck a person rather than a deer, as he claimed. In Kentville, two Town Councilors were in court over a property deal on Main Street. One Councilor had bought the property to build apartments, but when constructions deadlines were not met, the Town voted to revert the property back to Town ownership. The Councilor who wanted to develop the property alleged that another Councilor who also owned apartments should not have voted. The NS Supreme Court disagreed. Finally, I review the closing arguments in the William Sandeson jury trial. As I recorded this, the judge was giving the jury instructions before the go off to deliberate. I analyze the closing submissions, and give some predictions for what the jury may decide.

While RCMP commissioner Brenda Lucki has been in the hot seat all summer, facing an inquiry into the mass shooting that struck Nova Scotia in 2020, she's also been quietly working on another project with a huge impact on Canadian Jews. For the first time in the history of the RCMP, Jewish members and cadets will be permitted to wear a kippah while on duty. It began with a request—which was denied—from a Jewish officer in B.C. to wear the Jewish head covering. B'nai Brith's human rights arm got involved, snowballing into an official move by the federal police to match what they'd already done for turbans and hijabs: pay for the design and creation of a regulation RCMP kippah. While we won't see it for a while, in the interim, Jewish staff can bring their own. Marvin Rotrand, the director of B'nai Brith Canada's League for Human Rights, joins to discuss what went on behind the scenes of this groundbreaking move for Canada's national police. The MCC proceedings continued to focus today on the leadership of the RCMP, featuring continuing testimony from the now-retired former Commanding Officer for the RCMP in Nova Scotia, Lee Bergerman, and the current national Commissioner of the RCMP, Brenda Lucki. The contrast in leadership style and competence between the two was on stark display, and it was not a contrast that favoured Ms. Bergerman. Some of the same questions that were asked of Ms. Bergerman yesterday about RCMP culture, ability to change, and her knowledge and understanding of the events of the mass casualty were also asked of Comm. Lucki. Where Ms. Bergerman gave short, vaguely worded answers, and claimed time and time again not to have asked questions or been informed about the RCMP's operational response to the active shooter, Comm. Lucki gave long, detailed, and specific answers, and appeared to be engaged in the details of operational and policy shortcomings.

Roy L Hales/ Cortes Currents - It has been a week since the Federal Court of Canada condemned RCMP Commissioner Brenda Lucki for her failure to respond to the Civilian Review and Complaints Commission (CRCC). The case revolved around an interim report from 2017, but in her Judgement and Reasons Associate Chief Justice Jocelyne Gagné pointed to numerous other cases where the RCMP had acted in the same high handed manner. “It is in the public interest to have a police oversight institution that functions properly and is unobstructed.” she wrote. One of the organizations applauding the Court's Decision to hold the police accountable is the Union of BC Indian Chiefs. “The recent decision calls into question and challenges the integrity of the highest ranking RCMP official in the land, Brenda Lucki, in regard to her complete lack of accountability,” explained Grand Chief Stewart Phillip. On January 12th, Lucki issued a press release stating, “I respect the Federal Court's decision that the RCMP's response to the British Columbia Civil Liberties Association (BCCLA) matter was not provided as soon as feasible, as per the RCMP Act. In the past there had been delays in responding to CRCC interim reports due in part to the number of interim reports issued, the scale and complexity of the cases and the volume of relevant material to be analyzed … A 2019 Memorandum of Understanding between the CRCC and RCMP commits us to improving our service standards by providing a written response to CRCC reports within six months. We have made significant progress; in November 2021, we cleared our backlog of responses to CRCC interim reports and since April 1st, 2021 all new interim reports have been responded to within the agreed upon six-month time frame.” This response did not address the concerns of the Union of BC Indian Chiefs. “Indigenous people are alarmed that the escalating militarization of the RCMP. There was a time when the RCMP were given a very strong mandate to keep the peace, but we all know that that has transitioned into a very dark place where the RCMP are finding themselves as the enforcement arm of resource development, extractive industries, oil, and gas pipelines, mines, and they're coming down harshly and with pronounced measure of police brutality in regard to the citizens of this province of this country that simply seek to protect the integrity of the environment, the watersheds of riparian systems, wild salmon, and so on and so forth,” said Grand Chief Phillip. “We saw that demonstrated at ferry Creek where the RCMP were brutally assaulting the people that were standing there in opposition to old-growth logging, which the Horgan government promised to stop when they ran for the last election. And with respect to the Wet'suwet'en it's far darker in terms of the full military assaults on the peaceful encampments of Wet'suwet'en people who are simply carrying out their rights in regard to the declaration on the rights from indigenous peoples, the Delgamuukw-Gisday'wa case. All of these high court decisions have given them every right to protect their homelands from the predation of the industrial corporations that are out there, wreaking havoc.” He added that the RCMP care carrying their assaults out in a manner that is virtually indistinguishable from military operations. “Governments need to be held to account as well as the RCMP itself. That's why the union of BC Indian shoots applauds the court decision that calls into question Brenda lucky and her very racialized execution of her campaign against indigenous peoples and the environmental movement or who simply seeking to protect the integrity of the environment.”

RCMP Commissioner Brenda Lucki joins National Chief Perry Bellegarde to address the ongoing issue of racism and police brutality towards First Nations people, especially in light of the recent killing by police of a First Nations woman, Chantel Moore, in New Brunswick, the use of an RCMP vehicle to run-over and apprehend a man in Nunavut, and the dashcam video showing RCMP officers tackling and beating Athabasca Chipewyan Chief Allan Adam over an expired vehicle license. Commissioner Lucki and the National Chief look at ways to shift racist culture in the force and move forward towards an effective, inclusive, community based form of policing.Brenda Lucki was born and raised in Edmonton, Alberta, and joined the RCMP in August 1986. The Roy Green Show Podcast - Five former Canadian attorneys general wrote an open letter to RCMP Commissioner, Brenda Lucki, calling for an investigation into interference by the Prime Minister's Office/Justin Trudeau with former federal attorney general, Jody Wilson-Raybould, concerning criminal charges laid against SNC-Lavalin. Meanwhile, according to a poll by Ipsos, Justin Trudeau now has a lower approval rating than Donald Trump, with the Tories way ahead. Trudeau appears to have suffered more damage from the SNC-Lavalin scandal than U.S. President Donald Trump has from the Russia collusion investigation.  If the Canadian federal election were held today, the new PM would be Andrew Scheer.  The Alberta election crosses into April and closes in on the big day. A leading Alberta political science professor, Duane Bratt, offers his reviews of the various party campaigns, the mood and what the intentions of the electorate are.  Former Alberta Prosecutor and executive officer of the Canadian Police Association, Scott Newark gives his perspective on multiple criminal law cases evolving here in Canada – such as Joshua Boyle's criminal trial, the SNC-Lavalin case, what is happening with Admiral Mark Norman, and the information that Correctional Service Canada is releasing high risk offenders. Quebec Premier Francois Legault is pressing ahead with his party legislation which bans the wearing of religious symbols by any public servant in the province. He argues that the legislation enshrines the secular nature of Quebec society, but Federal political leaders have all denounced the law, with the exception of the Bloc Quebecois. Julius Grey is a human and civil rights lawyer in Montreal who represented the Sikh student who argued in court that it was his right to wear a kirpan to school.
