Three Cases Dismissed Because of Suit Against an Insurer who Did Not Insure the Plaintiff Texas Law Firm McClenny, Moseley & Associates (MMA) has had serious problems with the US District Courts in Louisiana and what appears to be an effort to profit from what some Magistrate and District judges indicate may be criminal conduct to profit from insurance claims relating to hurricane damage to the public of the state of Louisiana. In April and May several cases have been the subject of motions for Summary Judgment from insurers who were sued by MMA who was sanctioned by the District Courts and new lawyers took over the cases only to find the plaintiffs had no right to sue since they were not insured by the insurer defendants. For a representative sample note the information from the following three cases: In Ave Duruisseau v.  Farmers Property & Casualty Insurance Co, No. 6:22-CV-03860, United States District Court, W.D. Louisiana, Lafayette Division (April 26, 2024) Summary Judgment was granted because there was no genuine issue of material fact for trial because Farmers did not insure Plaintiff's property. In Hester Cole v.  Foremost Insurance Company Grand Rapids Michigan, No. 2:22-CV-03514 United States District Court, W.D. Louisiana, Lake Charles Division (April 26, 2024) the court granted Summary Judgment because there was no genuine issue of material fact for trial because Foremost did not insure Plaintiff's property on August 27, 2020. In Terry Ramirez v. Atlantic Casualty Insurance Co, No. 2:22-CV-04797, United States District Court, W.D. Louisiana, Lake Charles Division (May 7, 2024), James D. Cain, Jr. United States District Judge, dealt with a Motion for Summary Judgment filed by defendant Atlantic Casualty Insurance Company (“Atlantic Casualty”). The motion was unopposed. The details were a little different. The suit dealt with alleged damage to a residence located at 2026 7th Avenue, Lake Charles, Louisiana, in Hurricane Laura, which made landfall in Southwest Louisiana on August 27, 2020, and Hurricane Delta, which impacted the same area on October 9, 2020. Plaintiff, who was then represented by counsel from the law firm of McClenny Moseley & Associates, filed suit in this court against Atlantic Casualty on August 25, 2022, raising claims of breach of insurance contract and bad faith. Therein he represented that he was the owner of the property represented at 2026 7th Avenue and that the property was insured under a policy issued by Atlantic Casualty. All cases filed by plaintiff's counsel were suspended due to concerns about misconduct committed by that firm. New counsel enrolled for plaintiff on July 11, 2023, and the stay was lifted. Atlantic Casualty moved for summary judgment, showing that plaintiff is not the owner of the insured property and is not listed as a named insured under the policy and requested that the court dismiss plaintiff's claims with prejudice. Louisiana law provides that an insurance policy is a contract and that its provisions are construed using the general rules of contract interpretation in the Louisiana Civil Code. The policy at issue is a commercial lines policy that provides lessor's risk coverage to several dwellings, including the one at 2026 7th Avenue. Doc. 20, att. 3, pp. 5-6. Darrell and Shirley Crochet are listed as the named insureds. According to Atlantic Casualty's records, they are also the owners of 2026 7th Avenue and plaintiff was a tenant at that address. The policy provides that certain individuals, such as employees, may be considered insureds in connection with the business run from that property. However, there is no basis under the policy to consider that the tenant has an insurable interest in the immovable property. Accordingly, plaintiff cannot maintain a claim for breach of contract against Atlantic Casualty. In the absence of a valid contractual claim, plaintiff's bad faith claims must also fail. The Motion for Summary Judgment was granted and all claims in this matter were dismissed with prejudice. The result of these three cases indicates that the MMA firm had a problem with the truth and filed suits on behalf of people who were not insured by the insurer defendant and was, as a result, a suit based on fraudulent allegations. The last 28 issues of Zalma's Insurance Fraud Letter has described the problems faced by MMA and insurers in the state of Louisiana who were required to defend false and fraudulent lawsuits. In 2020, Lake Charles, Louisiana was devastated by Hurricane Laura. Just six weeks later, the city was hit again by Hurricane Delta.    Today, we listen to a report from The Gulf States Newsroom's Stephan Bisaha, who traveled to the city to speak with residents about ongoing recovery efforts. He also tells us what's being done to fortify Lake Charles against future storms.    It's back-to-school season, with many Louisiana schools opening their doors one week ago, and many of the state's universities starting classes next Monday. Walter Isaacson, the Leonard Lauder Professor of American History and Values at Tulane University, will be returning to the classroom. He previously served as chairman of CNN and editor of TIME magazine.   Back in March, Isaacson was awarded a National Humanities Medal by President Joe Biden. He was honored for writing multiple biographies that have helped deepen the public's understanding of history and inspire curiosity. Shortly after he received this recognition, he joined us to discuss the work that led up to that moment. Suing All State Farm Insurers Unconscionable State Farm Mutual Automobile Insurance Company (“State Farm Auto”) and Defendant State Farm General Insurance Company (“State Farm General”) moved the court to dismiss all Plaintiff's claims against the entities. The motion was regarded as unopposed. In Bridget Butler v. State Farm Fire And Casualty Company, State Farm General Insurance Company, And State Farm Mutual Automobile Insurance Company, No. 3:22-Cv-03433, United States District Court, W.D. Louisiana, Lake Charles Division (June 23, 2023) a Bridget Butler whose home was damaged by two hurricanes sued three State Farm Insurance companies when only one insured her against the risk of loss of her property. INTRODUCTION Hurricane Laura made landfall near Lake Charles, Louisiana then Hurricane Delta made landfall near Lake Charles, Louisiana. During the relevant time period, Plaintiff Bridget Butler owned property in Monroe, Louisiana. An entity of State Farm provided a policy of insurance to Plaintiff. Plaintiff alleged that Defendant failed to timely and adequately compensate Plaintiff for her substantial losses pursuant to the Policy. In turn, Plaintiff filed suit against State Farm Auto, State Farm General, and State Farm Fire and Casualty Company (“State Farm Fire and Casualty”) claiming liability for damages for breach of contract plus general damages and for statutory violations and penalties under Louisiana Revised Statutes. State Farm General and State Farm Auto moved for dismissal of the claims against them. Plaintiff filed no response to the motion. RULE 12(b)(6) STANDARD Rule 12(b)(6) allows for dismissal when a plaintiff “fail[s] to state a claim upon which relief can be granted.” LAW AND ANALYSIS The Complaint alleges that the “Defendant” issued and maintained a Policy insuring Plaintiff's Property. The Complaint does not provide a specific policy number, and the Complaint asserts a policy number was unable to be identified because “Defendant” did not comply with Plaintiff's request for production of the policy number. Attached to their Motion to Dismiss State Farm General and State Farm Auto put forth an insurance policy with the policy number 99-CC-X642-7, and both companies assert that the attached policy is the Policy referenced in the Complaint. The attached policy is from State Farm Fire and Casualty and names Plaintiff as insured and the Property as the location of premises insured with a policy period of twelve months beginning August 25, 2020. State Farm General and State Farm Auto are not listed as parties in the attached policy. Additionally, both State Farm General and State Farm Auto maintain that neither entity has issued a policy to Plaintiff. Under Louisiana law, no action for breach of contract may lie in the absence of privity of contract between the parties. State Farm General and State Farm Auto are not parties to the attached policy, and each assert it did not provide Plaintiff with any insurance coverage. CONCLUSION Defendants State Farm General Insurance Company and State Farm Automobile Insurance Company's Motion to Dismiss was granted. Plaintiff maintains claims against State Farm Fire and Casualty Insurance Company. ZALMA OPINION There should be no excuse for a plaintiff to require the State Farm entities that did not insure Ms. Butler to move the court for dismissal. A telephone call from defense counsel to plaintiff's counsel informing Ms. Butler of the proper defendant and voluntarily dismiss the wrong State Farm entities. The decision of the court was easy but Judge Cain has more important things to do than deal with an unnecessary motion. Sanctions against Plaintiff's attorney could have been warranted. I've been meaning to record, especially to share stories from hurricane recovery projects, but it's been crazy busy.  Hurricane Laura, then Hurricane Delta, then floods in southwest Louisiana, all in the August 2020 - May 2021 timespan. all this on along with COVID. then Hurricane Ida hit last year, adding to the chaos. so the gap between recordings grew - days turned to weeks, then months, and now 18 months.  this is a short episode, mainly to get back recording, and also to let you know we'll have some information coming up about storm preparedness and response.  we've been working on gathering information that can help everyone prepare in advance and also know what to do after the storm's gone.  leave us comments and suggestions on what questions you'd like answered.

 After months of intense negotiations, Florida Gov. Ron DeSantis came to terms on a new Tribal Gaming Compact. He was working with the state’s Seminole Tribe, who own and operate the Hard Rock Hotel & Casino chain throughout Florida. More recently, the state’s Senate approved the measure 38-1. Next, the state’s House passed it by a vote of 97-17. The new 30-year Tribal Compact still needs federal approval by the US Department of the Interior. This involves a 45-day process to render a decision. Expansion includes both retail and mobile sports betting.  Gulf Coast Casinos Prepare for Another Hurricane SeasonGulf Coast casinos in Louisiana and Mississippi first had to contend with the coronavirus shutdown in March of last year. They then had to deal with the impacts of five named storms during the annual hurricane season. This starts on June 1 and runs through Nov. 30. Both Hurricane Laura and Hurricane Delta slammed into the Lake Charles region of Louisiana less than six weeks apart. Casinos from New Orleans east into Mississippi were impacted by Hurricane Zeta in the month of October. There are 13 riverboat casinos in Louisiana with a land-based venue in New Orleans. Mississippi is home to 12 casinos in the Gulf Coast region. Rosie’s Gaming Emporium Pays Out Six-Figure JackpotVirginia is in the process of building land-based casinos in specific locations in the state. In the meantime, Rosie’s Gaming Emporium is the next best thing. Offering historical horse racing games of chance, the chain is part of Colonial Downs. This Thoroughbred race track is located outside of Richmond in New Kent County. It is also home to Rosie’s Gaming as one of five locations in the state. The Rosie’s in Vinton made headlines the other day with a $387,000 jackpot hit on one of its games of chance. This set a record for the largest jackpot ever at that location. Bitcoin’s Value Cut in Half From All-Time HighLately, Bitcoin’s current market value has taken violent swings in a matter of hours. The net effect of this volatility can be demonstrated by two numbers. On April 14, the market value of BTC topped $64,895. On May 23, the trading value sunk to $32,601. Early trading in the final week of May points to a slight rebound with bitcoin around $38,000. Outside forces including Tesla’s founder Elon Musk along with the Chinese and US Government have had a hand in the rapid decline. Other factors such as rampant speculation have taken their toll on the BTC market price.

From her home in Galveston, Texas, Lynn Bunn (Fast Canines Greyhound Adoption) is glued to Internet live streams. She's not watching news about Hurricane Delta, COVID-19 or the 2020 election. She's waiting for her racing Greyhound to head to the box at the Palm Beach Kennel Club (PBKC). Lynn is one of a growing number of Greyhound adopters to dip their toes in the waters of racing Greyhound ownership. Her Greyhound -- Lucy, aka KB's Lookin Good -- has a good start at PBKC but gets bumped in the first turn. She closes late on the inside and manages a 5th place finish. "She is learning how to navigate -- that was her 20th race," remarks Lynn. Her optimism for the breed is shared with other Greyhound adopters turned racing owners, like Patti Kacer (Greyhounds as Pets of Northeast FL) of Jacksonville, Florida and Dr. Jennifer Ng (Greyhounds Crossroads and Greyhound Adopters for Racing), a veterinarian from Columbia, South Carolina. Each of them has a story to tell about how Greyhound adoption grew into racing Greyhound ownership. Patti comments, "That's the hardest turn on the track. Any track." We examine what causes Mississippi's severe fall weather.Segment 1:A federal judge's ruling is instructing the Mississippi Secretary of State's office to allow voters the chance to correct rejected absentee ballots. The provision, which is a result of a federal lawsuit brought by voting rights organizations to expand absentee voting in the state, says ballots rejected due to signature problems will be eligible for correction. Christy Wheeler is with the League of Women Voters of Mississippi, one of the plaintiffs in the suit. She tells our Desare Frazier this ruling doesn't account for the missed opportunities to expand absentee voting.Segment 2:The Mississippi State Fair was scheduled to end Sunday. But after conversations with fair vendors, Commissioner of Agriculture and Commerce Andy Gipson is extending the event. The fair's first weekend was significantly affected by Hurricane Delta - shortening operating hours and driving attendance down. The coronavirus pandemic also presented challenges with capacity limits and social distance monitoring. Gipson tells our Kobee Vance he hopes the combination of favorable weather and eager vendors will make for a successful extended weekend.Segment 3:The forecast calls for sunny skies, but residents across the state will be hearing the sounds of tornado sirens this morning. The alarm is part of a statewide tornado drill happening in observance of Fall Severe Weather Preparedness Week. Since 1950, November has experienced more strong tornadoes than any other month besides May. Meteorologist John Moore is with the National Weather Service in Jackson. We assess the impact with MEMA.Then, the state's top health officials express concerns over trends in coronavirus transmission data.Plus, a new report reveals how Mississippi compares to other states in voting accessibility.Segment 1:Hurricane Delta swept through parts of Mississippi over the weekend, bringing with it damaging winds and heavy rains. Delta was the third Category 2 or stronger storm to hit the Gulf region since August. While the state dodged direct hits in each instance, the Mississippi Emergency Management Agency says Delta delivered significant impacts to the state. MEMA Director Greg Michel shares more with our Michael Guidry.Segment 2:Mississippi is one of the top 20 states with the most new cases of the coronavirus per capita in the U.S., and health officials say a "big upswing" of COVID-19 cases could be on the horizon. During a Mississippi State Medical Association round table, State Epidemiologist Dr. Paul Byers cautioned residents not to focus too much on any single day report. But he also says the curve in cases is changing.The recent trends represent a reverse in course compared to the previous two months. State Health Officer Dr. Thomas Dobbs says that is reason enough for health care providers to prepare for a surge.Segment 3:A newly released report by the Democracy Initiative shows Mississippi is the only state in the country that hasn't provided people with more voting options due to the coronavirus pandemic. The coalition of 75 national organizations is working to help states make voting easier and safer.
