Insured Must Reside at Dwelling for Homeowners Policy Coverage to Apply Plaintiff alleged that, on October 28, 2020, Hurricane Zeta caused significant damage to his property. Plaintiff alleged that Southern conducted an inspection which constituted “satisfactory proof of loss,” but that Southern failed to adjust the claim or provide compensation to Plaintiff following the inspection.  Plaintiff alleged that he was forced to hire his own experts, and repair estimates. In Todd M. Korbel v. Republic Fire And Casualty Insurance Company And Southern Underwriters Insurance Company, No. 2:21-CV-2214, United States District Court, E.D. Louisiana (May 31, 2023) BACKGROUND Plaintiff sued seeking damages. Southern generally denied  the allegations and asserted a number of affirmative defenses including that Plaintiff did not “reside” at the Property, and that he is therefore not entitled to coverage under the Policy. APPLICABLE LAW Residence under the Policy The plain, ordinary and generally prevailing meaning of the word “reside” requires more than purchasing a home or intending to move into it. Plaintiff argued that he received mail, including correspondence from Southern, at the Property, that he paid water and electric bills for the Property in his name, that he was at the Property every day performing work or checking on the Property, that he had stored some belongings at the Property, and that he had a homestead exemption on the Property. As the Fifth Circuit has previously explained to Plaintiff himself in a previous lawsuit, this evidence is insufficient to create an issue of material fact as to whether Plaintiff resided in or at the Property. In an earlier case Plaintiff brought similar claims for damages and statutory bad faith penalties under Louisiana law after a house that he had purchased, but not moved into, was damaged during Hurricane Katrina. The insurer raised the same lack of coverage defense to Plaintiff's claims for certain damages, arguing that Plaintiff did not reside at the property as was required under the insurance coverage contract. Although Korbel clearly spent a great deal of time working on the house and intended it to be his residence in the future, this evidence was insufficient to establish residence. Given that Plaintiff kept only a minimal amount of furniture there and did not engage in leisure activities at the house, but rather went to the Property to work on or check on the house the facts establish he did not reside there. In fact, Plaintiff admitted in his deposition that he did not move into the Property but was still living at another location at the time the Property was impacted by Hurricane Zeta. Accordingly, Plaintiff did not ‘reside' at the Property, and is not entitled to coverage under the Policy. ZALMA OPINION Homeowners policies require that the insured reside at the premises that is the subject of the policy. Since the evidence established Korbel did not reside at the premises but only visited for purposes other than residence and it was in no condition to live in, he did not meet the requirement of residence as he did not in a previous case he brought to the Fifth Circuit Court of Appeals. He could have purchased a policy for a property in the course of construction but did not. Once he lost with the same argument it was unwise to make the same losing argument to the to the USDC that had failed on an appeal to the Fifth Circuit. The historic Airmount Grave Shelter, built in 1853, was severely damaged by falling trees from Hurricane Zeta in 2020. FEMA funds and a local match restored the structure, the only one of its kind south of Virginia. Jamie Houston's home on DuBose Avenue across from the Grove Hill Public Library was severely damaged by Hurricane Zeta in late October 2020, just over two years ago. The home was declared a total loss and she found a new home. Tuesday, a track hoe moved in and the old house was torn down. The home was built by Graham and June Waite, likely in the late 1940s. Hurricane Zeta caused extensive damage to the Alabama Forestry Commission office on Old Highway 5 just north of Grove Hill. The October 2020 storm took down a lot of pine trees in the complex and a big one crashed through the office building, causing roof, interior and floor damages. The old Thomasville School Gym behind the Civic Center will be getting a new playing surface for the upcoming winter basketball season. The floor was one of several things that were heavily damaged from Hurricane Zeta almost a year ago this month. Besides the gym floor, the roof was heavily damaged and so were the restrooms. Grove Hill firefighters responded to a call of a brush fire that had gotten out of hand Memorial Day afternoon. They found a fire burning near the home of Jamie Houston on Du- Bose Avenue. The fire was so close it was burning the siding on the home. Houston was at the scene and said she was trying to clean up. The home was totaled by Hurricane Zeta in October and has stood with gapping holes in the roof since then. Houston said she cannot find a contractor to take the building down. He was working with the state’s Seminole Tribe, who own and operate the Hard Rock Hotel & Casino chain throughout Florida. More recently, the state’s Senate approved the measure 38-1. Next, the state’s House passed it by a vote of 97-17. The new 30-year Tribal Compact still needs federal approval by the US Department of the Interior. This involves a 45-day process to render a decision. Expansion includes both retail and mobile sports betting.  Gulf Coast Casinos Prepare for Another Hurricane SeasonGulf Coast casinos in Louisiana and Mississippi first had to contend with the coronavirus shutdown in March of last year. They then had to deal with the impacts of five named storms during the annual hurricane season. This starts on June 1 and runs through Nov. 30. Both Hurricane Laura and Hurricane Delta slammed into the Lake Charles region of Louisiana less than six weeks apart. Casinos from New Orleans east into Mississippi were impacted by Hurricane Zeta in the month of October. There are 13 riverboat casinos in Louisiana with a land-based venue in New Orleans. Our guest is Lt. General Russel Honoré. Thousands of Mississippians are still navigating the aftermath of Hurricane Zeta. We hear one story of from the owner of Bay St. Louis institution steeped in Black history, and how the arts will help pave the road to recovery. Then, on the eve of the election, we take at a final look at the leading candidates in Mississippi's Senate Race.Plus, in 2016, Donald Trump was able to win the Presidency despite a three million point deficit in the popular vote. We examine the quirky but definitively constitutional Electoral College.Segment 1:In 1894, 12 civic-minded African American residents of Bay Saint Louis drew up the bylaws for an organization called the Hundred Members Debating Benevolent Association. The group's primary purpose was to "assist its members when sick, bury its dead in a respectable manner and knit friendship." The group later built a pavilion and then a hall that would last as a cornerstone for the town's black community for over a century.Last week, the 100 Man Hall was one of many structures damaged by Hurricane Zeta - much of its roof ripped off by the storm's strong winds. Now, owner Rachel Dangermond plans to use one of the hall's historic staples - the arts - to fuel recovery efforts. She shares more with our Evelina Burnett.Segment 2:Mississippians will be deciding on a rematch of the 2018 U.S. Senate race when they head to the polls tomorrow. Democrat Mike Espy is trying, again, to unseat Republican incumbent Cindy Hyde-Smith. MPB's Ashley Norwood takes a closer look.Segment 3:In the final day before the election, President Donald Trump is looking to duplicate his success from 2016. With stops scheduled today in North Carolina, Pennsylvania and Michigan, Trump is keying in on the states that helped him in his first campaign for the White House. Democratic hopeful Joe Biden is also focusing much of his final efforts on those pivotal swing states. Despite a significant lead in national polls, analysts predict Biden needs to win back states Trump carried in 2016 if he wants to prevail. This method of localized politicking and messaging to specific blocks of the electorate is a product of the system in which America chooses its President. State officials begin the process of assessing the damage on the coast after Hurricane Zeta raced through southern Mississippi.And, days away from the election, the two leading Senate candidates make their final appeals to voters.Then, those casing ballots will decide the fate of a Jim Crow era constitutional provision. We examine the law historians say was designed to keep Black Mississippians out of office. Plus, some Halloween fire safety tips.Segment 1:State officials are beginning to survey the degree of damage caused by Hurricane Zeta. The storm came ashore in southeastern Louisiana earlier this week as a strong Category 2 hurricane before moving swiftly across the New Orleans area and into Mississippi. Governor Tate Reeves says the storm maintained its strength as it passed through the state's southern counties, resulting in significant damage. Greg Michel, Director of the Mississippi Emergency Management Agency says Zeta serves as a reminder of the unpredictability of tropical cyclones.Segment 2:Two candidates running for U.S. Senate in Mississippi are facing each other for the second time. Republican Senator Cindy Hyde-Smith is the first woman to represent Mississippi in Washington. Her Democratic challenger Mike Espy is looking to become Mississippi's first black U.S. Senator since Reconstruction. The two ran against each other in a 2018 special election following the resignation of former Senator Thad Cochran. Hyde-Smith won by 7 points, but recent polls show that lead is shrinking.Segment 3:A referendum on the November ballot in Mississippi seeks to remove a Jim Crow- Era law historians say was designed to prevent Blacks from holding statewide office. MPB's Desare Frazier explains.Segment 4:Tomorrow is Halloween and the State's Fire Marshall says there are some key safety tips to consider - whether families are trick-or-treating or taking in a fall bonfire. Despite mask mandates in place in 16 counties that require masks indoors while in public, both Governor Tate Reeves and Secretary Watson claim the requirement of a mask to vote restricts the electorates constitutional right. The remnant low from Hurricane Zeta (likely to make landfall later Wednesday night near SE Louisiana as a Category 1 hurricane) combining with a non-tropical low which has brought heavy, blowing snow to Colorado and New Mexico will send a surge of moisture to the middle Atlantic and northeast states. By late Thursday night, enough cold air may trail this developing storm to produce an elevation-driven widespread accumulating slushy snowfall.
