This Day in Legal History: West Coast HotelOn December 16, 1936, the US Supreme Court heard oral arguments in West Coast Hotel Co. v. The deduction does not exempt overtime pay from taxation; instead, it offers a narrow, post-withholding deduction that workers must calculate themselves, often without support from their employers or sufficient guidance from the IRS.The structure of the deduction is flawed: it only applies to the “half” portion of time-and-a-half pay and is capped at $12,500. For lower-wage workers to take full advantage, they must clock extraordinary amounts of overtime—something not feasible for many. Meanwhile, employers are actively disincentivized from helping employees understand or claim the benefit. If they report eligibility and make an error, they could face legal penalties, while doing nothing carries no risk. The system thus favors inaction and leaves employees to fend for themselves.Without clear W-2 guidance or safe harbor rules, the deduction becomes accessible primarily to those with tax professionals or payroll tools—functioning as a quiet subsidy for the well-advised. For others, it's a bureaucratic maze with limited reward. To prevent administrative failure, the IRS should at least provide a legal safe harbor for employers and model W-2 language. A more ambitious fix would be a flat-rate standard deduction for eligible workers, reducing complexity. The second Trump administration has made tearing down parts of the federal government a priority. And some of those efforts have been literal. In October, President Donald Trump ordered the demolition of the White House's East Wing to make way for the construction of a massive 90,000-square-foot ballroom. He's also given the White House a gilded makeover, bulldozed the famed Rose Garden, and even has plans for a so-called “Arc de Trump” that mirrors France's Arc de Triomphe. So what's behind all of this? Art historian Erin Thompson—author of Smashing Statues: The Rise and Fall of America's Public Monuments—says that whether it's Romans repurposing idols of leaders who had fallen out of favor or the glorification of Civil War officers in the American South, monuments and public aesthetics aren't just about the past. They're about symbolizing power today. Here are 3 big things you need to know—   One — The White House is denying a report that President Trump is considering removing FBI Director Kash Patel in the coming months.  On Tuesday MSNow cited three people with knowledge of the situation, who say Patel's top aides have become frustrated with headlines generated by Patel, and that top FBI official Andrew Bailey is being considered to replace him.  Later, White House press secretary Karoline Leavitt posted on X, saying the story was completely made up.   Two ---  A pair of turkeys are enjoying presidential pardons.  President Trump signed the paperwork for Gobble and Waddle yesterday in the Rose Garden.  Trump took a shot at former President Biden, saying the turkey pardons last year were determined to be invalid because they were signed by an auto-pen.  And number three --- The Thanksgiving travel rush is on.  The TSA expects to screen over 18-million flyers between today and next Tuesday, and today's the busiest with 52-thousand flights scheduled nation-wide.  Officials say air traffic control staffing is back up to pre-government shutdown levels, and flights are largely on-schedule.
