We're doing a live taping of Gaslit Nation on May 23 at 1:30pm EST. Make sure you're subscribed to the show at the Truth-teller level or higher to get access to that special live event to celebrate the launch of our book Dictatorship: It's Easier Than You Think!   It's been a busy week for nazis, neo-confederates, and crimelords – and for the people fighting them! We start out this week by discussing the ProPublica article on corrupt SCOTUS justice Clarence Thomas and his Hitler swag loving backer, Harlan Crow. Sarah gives a lot of background into their relationship, including 1) allegations of sex trafficking by Crow's brother and his ties to a client of Jeffrey Epstein 2) Thomas's ties to GOP sex trafficking and blackmail cases in the 1980s including the Franklin Scandal 3) the combination of bribes and blackmail GOP elites use to keep their judges and reps in line 4) and how the media exposed Thomas's corrupt relationships long ago, but officials refused to act!   Then we discuss the heartening news out of Tennessee, where representatives Justin Jones and Justin Pearson refused to accept their expulsion on baseless grounds, shone a light into the Tennessee legislature's corruption, gave fuel to a national protest movement, and got reinstated into office with a global platform. We discuss the protests and large voter turnouts in gerrymandered hostage states like Tennessee, Wisconsin, and Michigan, and how this may indicate a bigger anti-authoritarian movement in America to come.   Then Andrea details what was in those classified documents found on a Minecraft Discord server (seriously), what they mean for Russia's war on Ukraine, and what Ukraine still needs to win the war: the global democratic alliance must make up its mind if it wants Ukraine to win the war, then give Ukraine what it keeps asking for to win the war: ATACMS (long range missiles) and F-16s.   We released our weekly Patreon bonus episode -- a special on violent feuds among the Kremlin's elites -- earlier than usual so if you are a subscriber at the Truth-Teller level or higher, be sure to check that out. We will be back next week with our usual Q&A, so keep your questions coming! Today's guests founded the groundbreaking Punchbowl News. Anna Palmer worked for the Legal Times and Roll Call before joining Politico in 2011. While at the Legal Times she began to attract national attention for her work and investigating the activities of lobbyist Jack Abramoff, who ultimately went to prison. Not long after joining Politico, she joined the team of journalists investigating sexual harassment allegations against presidential candidate, Herman Cain, who subsequently suspended his campaign. While at Politico, she served as its senior Washington correspondent. She also led Women Rule a leading platform aimed at expanding leadership opportunities for women and hosted the critically acclaimed Women Rule podcast. She also got to work with our other guest who would become her primary writing partner. Jake Sherman grew up in Connecticut before attending the George Washington University and Columbia University's Graduate School of Journalism. He worked for the Wall Street Journal, Newsweek and the Minneapolis Star Tribune in their Washington DC bureaus and joined Politico in 2009. He too became a successful senior writer for Politico. But it seems to me that much of the real magic started happening when he began to partner with Anna. They collaborated extensively at Politico, especially covering the U S Congress. They reported on corruption scandals among Democrats and Republicans. Including on the matter of Congressman Aaron Schock who ultimately resigned. For four years, they took over the wildly popular Politico playbook after Mike Allen's departure, further expanding its readership. And in 2019, our dynamic duo wrote The Hill To Die On: The Battle for Congress and the Future of Trump's America, a New York Times bestseller. They left Politico in 2020 to start Punchbowl News, which would offer non-partisan reporting with a special focus on Washington's elite power players. Anna would become Punchbowl News' CEO with one of the top names in the business. She has been a political commentator for CBS, NBC, ABC, Fox News, CNN, MSNBC, and Washington Week. And Jake too, would become a top name in the business, serving as a political analyst for NBC News and MSNBC.

Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast series Good Law | Bad Law, is joined by Grover Joseph Rees, a retired US Ambassador, retired Chief Justice of American Samoa, and former General Counsel to the Immigration and Naturalization Service, to talk about the judicial selection process.  Mr. Rees was also the chief judge picker in the Department of Justice during the mid-part of Ronald Reagan’s Administration.   Often the media focuses on many of the policies and changes a president wants to make or promises to make while they are in office.  But many of those changes can be un-done by another president. One of the few things a president can do that can’t be reversed later is appointing judges to the various federal courts throughout the country.   On this episode, Aaron and Joseph talk about his experience and background having worked under President Reagan as well as his experience working as a law professor at the University of Texas. They also reminisce about an interview Aaron did while working at the Legal Times where he traveled to American Samoa when Joseph was the Chief Justice of that Pacific island nation.   Joseph  also weighs in on the performance of his friend and former colleague, John Bolton, who was recently appointed as President Trump’s National Security Advisor. He says that though it’s too early to tell yet, he believes John has a large role in the North Korea negotiations and thinks they’ve had a good strategy for those talks so far.   With Joseph’s experience as a professor, serving as an ambassador, helping advise President Reagan on Judicial nominees, and his experience as an attorney, he is one of the most knowledgeable people to talk about how judicial nominees are chosen. Joseph explains the process starts by looking at the nearly 1700 judicial positions and seeing what seats need to be filled. Then for all of the circuit courts and district courts they will consult with the Senator of that state to find the best candidates.   Join us today as Grover Joseph Rees and Aaron Freiwald talk about the Judicial nomination and selection process.   Host: Aaron Freiwald Guest: Grover Joseph Rees   Follow Good Law | Bad Law: YouTube: Good Law | Bad Law Instagram: @GoodLawBadLaw Website: https://www.GoodLawBadLawPodcast.com

Why is our criminal justice system so unfair? How do innocent men and women end up serving long sentences while the guilty roam free? According to law professor and scholar Adam Benforado, our systems problems stem from more than occasional bad apples; they start with deeply rooted biases we all hold and which influence the course of justice. Eugenio Duarte sat with him to discuss how these biases shape every step along the way, from how a crime is initially investigated, through the process of indicting and trying suspects, to ultimate determinations of punishment. His revelations, coming from empirical investigations and first-hand experience, are shocking and sobering. Ed Walters started as a lawyer in a big law firm in Washington D.C. In the late 1990's, he was approached by a client asking him to research a relatively new legal issue without using LexisNexis or WestLaw, as they were trying to reduce online legal research costs. His inability to do this set off a chain of events leading him to create the company Fastcase. His story begs the question, are lawyers simply paying too much for online legal research sources? What are some ways particularly solo and small firm attorneys can reduce research overheads in their practice? And when is it necessary to pay for LexisNexis or WestLaw? In this episode of New Solo, Adriana Linares interviews Ed Walters about his experience starting Fastcase, how it interacts with the bigger legal research companies and smaller startups, and the right steps for solo practitioners to take in choosing an online research source. Linares and Walters begin by discussing the differences between a free resource like Google Scholar, a mid-range company like Fastcase, and a larger company like LexisNexis. If an attorney has a boutique practice and needs treatises or specialized databases, Walters says, they will need a big online research company. Otherwise, the lawyer might be paying too much. He urges practitioners to check their local bar, state bar, and other associations or organizations for member benefits that often include research and even practice management tools. There are three startup companies that Walters encourages lawyers to research: Casetext, which focuses on crowdsourcing, Ravel Law, which uses data visualization, and Judicata, which uses semantic analysis to find relationships based on meanings. He encourages all lawyers, but especially those in small firms, to research different options and find the one that fits their practice best. Ed Walters is the CEO and co-founder of Fastcase, an online legal research software company based in Washington D.C. Before founding Fastcase, Ed worked at Covington and Burling where his practice focused on corporate advisory work for software companies and sports leagues, and intellectual property litigation. He has written for The Washington Post, The New York Times, The University of Chicago Law Review, The Green Bag, and Legal Times, and has spoken extensively on legal publishing around the country. He is an adjunct professor of law at the Georgetown University Law Center, where he teaches The Law of Robots. Special thanks to our sponsor, Solo Practice University.
