You might remember Bill Bucklew from our 2018 interview when he walked across the United States for Parkinson's Disease, which Bill has. In today's interview, we join Bill on his latest journey, something he's calling The Long Walk for Parkinson's: 640 miles, over 17 days, 40 miles per day, from the northern tip of Scotland to London... where he'll then run the London Marathon. For this journey, Bill is not alone.  He's joined by John MacPhee, who also has Parkinson's and has a slate of his own incredible accomplishments, including a previous walk across the U.K. The two of them are representing the U.S. and the U.K. coming together in a collaboration to help people living with Parkinson's live their best lives. Appropriately, they're also raising money for Parkinson's organizations in both countries, including The Michael J. Our new season brings changes! As the initial creator of Heartland Bank's Diving the Cbus, Kailyn Bucklew (McComb) remains actively involved in the development and continuation of the series. She is a co-host with her father, Scott, in addition to her duties in the Commercial Banking division. After graduating from The Ohio State University and beginning her career at Heartland, Kailyn started her “life” which includes her fiancé who also is a Heartland associate, a farm with many animals and a garden that she plants from her greenhouse seedlings. In her spare time, you just might catch her listening to legal commentary or offering eggs to friends at the bank. But Scott's still with us on each episode, as always. Scott McComb is the Chairman, President and CEO of Heartland Bank. In March 1996, Russell Earl Bucklew (May 16, 1968 – October 1, 2019) murdered Michael Sanders, with whom his former girlfriend Stephanie Ray took shelter after the breakup of their relationship, then kidnapped and raped Ray. He was sentenced to death by the state of Missouri in May 1997, and failed to have the conviction overturned in legal challenges which had completed by 2006. During this period, Missouri, as well as several other states, changed its protocol for death sentences by lethal injection to a combination of drugs. We are approaching the January 20th inauguration of President-Elect Joe Biden. As the days wane, President Trump intends to break a 130-year-old precedent of pausing executions amid a transition of presidential power. Trump has five executions slated to happen over the next few weeks and if they all take place, Trump will become the most prolific execution president in more than a century. Today we are reposting episode #102 to shed light on the death penalty and lethal injections as Aaron and Dr. Joel Zivot discuss the moral and ethical challenges of the death penalty as well as the 8th Amendment and prisoner rights.   What are the moral and ethical challenges with the death penalty today?  Not even so much whether to have a death penalty – which is a crucially important question, of course – but what are the moral dimensions of using lethal injection to carry out executions?  And what moral implications are there because medicine used to heal, here is used to kill?  And what about the requirement that health care professionals must engage in the act of taking a life?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast series Good Law | Bad Law, is joined by Dr. Joel Zivot to discuss the case of Russel Bucklew a death row inmate in Missouri who claims lethal injection would violate his 8thAmendment rights.   Russel Bucklew suffers from an illness called cavernous hemangioma, a disease that causes weak and damaged blood vessels. Bucklew contends that pentobarbital, the drug Missouri uses when executing inmates by lethal injection, would not circulate through his blood properly. As a result, Bucklew and some doctors believe he would hemorrhage, choke on his own blood, and suffocate.   Dr. Zivot testified on Mr. Bucklew’s behalf saying, “If we are going to have capital punishment, it has to be done correctly.” In today’s episode, Dr. Zivot walks Aaron through the intricacies of the case and Mr. Bucklew’s illness. Dr. Zivot states during the episode, Mr. Bucklew isn’t challenging his sentence, he just wants his sentence issued in a way that doesn’t cause him torture. After nearly four decades, the complete Bible is now available in American Sign Language for the first time ever.Deaf Missions, a ministry dedicated to communicating “the Gospel of Jesus with Deaf people through their heart language, culture and identity,” began the project in the early 1980s.In 2016, the mission partnered with Wycliffe USA, American Bible Society, Deaf Bible Society, Deaf Harbor, DOOR International, Pioneer Bible Translators, and Seed Company to complete the project.The Deaf Bible Society President J.R. Bucklew previously said that "although there are various text translations of the Bible available, some 95% of the world's deaf population is functionally illiterate. And only 20 of the world's 400 sign languages have some form of Bible content available."The final books needed — Isaiah, Jeremiah and Ezekiel — were completed this fall. Now, the entire Bible is available to the world’s 70 million people who are deaf for free online, through social media, and on a smartphone app. The translation was led by people who themselves are deaf and trained in the biblical languages.

SUPREME COURT OF THE UNITED STATES _________________ No. 20A8 _________________ WILLIAM P. BARR, ATTORNEY GENERAL, ET AL. v. DANIEL LEWIS LEE, ET AL. ON APPLICATION FOR STAY OR VACATUR [July 14, 2020] PER CURIAM. The application for stay or vacatur presented to THE CHIEF JUSTICEand by him referred to the Court is granted. The District Court's July 13, 2020 order granting a preliminary injunction is vacated. The plaintiffs in this case are all federal prisoners who have been sentenced to death for murdering children. The plaintiffs committed their crimes decades ago and have long exhausted all avenues for direct and collateral review. The first of their executions was scheduled to take place this afternoon, with others to follow this week and next month. To carry out these sentences, the Federal Government plans to use a single drug—pentobarbital sodium—that “is widely conceded to be able to render a person fully insensate” and “does not carry the risks” of pain that some have associated with other lethal injection protocols. Zagorski v. Parker, 586 U. S. ___, ___ (2018) (Sotomayor, J., dissenting from denial of application for stay and denial of certiorari) (slip op., at 2). Hours before the first execution was set to take place, the District Court preliminarily enjoined all four executions on the ground that the use of pentobarbital likely constitutes cruel and unusual punishment prohibited by the Eighth Amendment. Vacatur of that injunction is appropriate because, among other reasons, the plaintiffs have not established that they are likely to succeed on the merits of their Eighth Amendment claim. That claim faces an exceedingly high bar. “This Court has yet to hold that a State's method of execution qualifies as cruel and unusual.” Bucklew v. Precythe, 587 U. S. ___, ___ (2019) (slip op., at 12). For good reason—“[f]ar from seeking to superadd terror, pain, or disgrace to their executions, the States have often sought more nearly the opposite,” developing new methods, such as lethal injection, thought to be less painful and more humane than traditional methods, like hanging, that have been uniformly regarded as constitutional for centuries. Ibid. The Federal Government followed this trend by selecting a lethal injection protocol—single-dose pentobarbital—that has become a mainstay of state executions. Pentobarbital: • Has been adopted by five of the small number of States that currently implement the death penalty. • Has been used to carry out over 100 executions, without incident. • Has been repeatedly invoked by prisoners as a less painful and risky alternative to the lethal injection protocols of other jurisdictions. • Was upheld by this Court last year, as applied to a prisoner with a unique medical condition that could only have increased any baseline risk of pain associated with pentobarbital as a general matter. See Bucklew, 587 U. S. ___. • Has been upheld by numerous Courts of Appeals against Eighth Amendment challenges similar to the one presented here. See, e.g., Whitaker v. Collier, 862 F. 3d 490 (CA5 2017); Zink v. Lombardi, 783 F. 3d 1089 (CA8 2015); Gissendaner v. On April 1, 2019, the Supreme Court decided Bucklew v. Precythe, a case considering the standard applicable when an offender sentenced to death raises an Eighth Amendment challenge to the state’s lethal injection procedure.Petitioner Russell Bucklew was convicted of murder and sentenced to death by lethal injection of a single drug, pentobarbital, by the State of Missouri. Bucklew challenged the State’s injection protocol under the Eighth Amendment, alleging that regardless of whether it would cause excruciating pain for all prisoners, it would cause him severe pain because of a particular medical condition he had. The District Court dismissed his challenge. The U.S. Court of Appeals Eighth Circuit, applying Supreme Court precedent in Baze v. Rees and Glossip v. Gross, remanded the case to allow Bucklew to identify a feasible, readily implemented alternative procedure that would significantly reduce his alleged risk of pain. Bucklew eventually suggested nitrogen hypoxia, but the District Court rejected his argument for lack of evidence. A divided Eighth Circuit panel affirmed, and the Supreme Court granted certiorari.By a vote of 5-4, the Supreme Court affirmed the judgment of the Eighth Circuit. In an opinion delivered by Justice Gorsuch, the court held that Baze and Glossip govern all Eighth Amendment challenges alleging that a method of execution inflicts unconstitutionally cruel pain, and Bucklew’s as-applied challenge fails the Baze-Glossip test. He failed to raise a triable issue of fact regarding the viability of nitrogen hypoxia as an alternative method, and even if he had there was no showing that it would significantly reduce a substantial risk of severe pain.Justice Gorsuch’s majority opinion was joined by the Chief Justice and Justices Thomas, Alito, and Kavanaugh. Justice Thomas and Justice Kavanaugh filed concurring opinions. Justice Breyer filed a dissenting opinion, in which Justices Ginsburg, Sotomayor, and Kagan joined as to all but Part III. Meet Bill Bucklew, a longtime friend, Charity Miler extraordinaire and Team Fox All Star. Bill was diagnosed with Parkinson's Disease in 2012.  But he has become another datapoint in my theory that Parkinson's Disease is a disease that makes you walk and run really, really far. Last November, the day after Thanksgiving, Bill stood in Tybee, Georgia with his hands in the Atlantic Ocean.  Just 67 days later, he stood in San Diego, California, with his hands in the Pacific Ocean. How did he get from Tybee to San Diego?  Naturally, he walked. When Bill first told me about what he was going to do, I have to admit, I wasn't quite sure he could pull it off.  I didn't doubt that he could cover the distance.  But it was how fast he wanted to do it. (He said he had to do it that fast because he couldn't take so much time off work- lol!) But indeed, he did it.  2,503 miles in 67 days.  If certified by Guiness, this will be the World Record for the fastest walk across the US. Shortly after he finished his walk, Bill was in NYC for some press on the Today Show.   (Well la de da!)  I didn't want him to rest too much so I asked him to join me on a walk in Central Park, which is when we recorded this podcast. That evening I tried to upload the podcast and somehow the file had been corrupted. I thought it was gone forever, but just learned how to recover it. Whew! So this is a little late, but it's worth the wait.  Bill is amazing.  I hope you're all as inspired by him as I am.  #EveryMileMatters! What are the moral and ethical challenges with the death penalty today?  Not even so much whether to have a death penalty – which is a crucially important question, of course – but what are the moral dimensions of using lethal injection to carry out executions?  And what moral implications are there because medicine used to heal, here is used to kill?  And what about the requirement that health care professionals must engage in the act of taking a life?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast series Good Law | Bad Law, is joined by Dr. Joel Zivot to discuss the case of Russel Bucklew a death row inmate in Missouri who claims lethal injection would violate his 8th Amendment rights.   Russel Bucklew suffers from an illness called cavernous hemangioma, a disease that causes weak and damaged blood vessels. Bucklew contends that pentobarbital, the drug Missouri uses when executing inmates by lethal injection, would not circulate through his blood properly. As a result, Bucklew and some doctors believe he would hemorrhage, choke on his own blood, and suffocate.   Dr. Zivot testified on Mr. Bucklew’s behalf saying, “If we are going to have capital punishment, it has to be done correctly.” In today’s episode, Dr. Zivot walks Aaron through the intricacies of the case and Mr. Bucklew’s illness. Dr. Zivot states during the episode, Mr. Bucklew isn’t challenging his sentence, he just wants his sentence issued in a way that doesn’t cause him torture. Daniel breaks down what Florida statutes consider a data breach (basically an unauthorized party accessing restricted data) and gives a few examples of situations within a law firm where this definition applies. He then provides an in-depth explanation as to what types of data fall under personally identifiable information, such as social security numbers, medical records, and email addresses, and discusses what Florida's data breach notification law is. Daniel takes time to explain what the Florida attorney general's office will require from law firms that experience such a breach and analyzes what ethical obligations legal professionals have to their clients and the prevention of future unauthorized access. He closes the interview with tips on how law firms can encrypt their data and proactive changes companies can implement to increase their security policies. This week, Point of Inquiry welcomes Dahlia Lithwick, Senior Editor and Legal Correspondent for Slate, where she writes the "Supreme Court Dispatches" and "Jurisprudence" columns. Her legal commentary won her a National Magazine Award in 2013. She is a graduate of Stanford Law School and she joins Lindsay Beyerstein to talk about the crisis facing capital punishment in the United States.   Almost all executions in the United States are performed by lethal Injection but America's go-to lethal injection drug cocktail is rapidly becoming obsolete because a key component is no longer readily available. States have been reduced to scrounging drugs from unregulated bulk pharmacies and experimenting with secret and untested mixtures of medications, a practice that may amount to cruel and unusual punishment.    On May 21, the U.S. Supreme Court stayed the execution of Russell Bucklew of Missouri, just two hours before he was scheduled to be executed for the murder of Michael Sanders. Bucklew suffers from a condition called cavernous hemangioma, which means that his brain is a swamp of blood-vessel based tumors where drugs could pool or leak during a lethal injection. Bucklew's lawyers argued that Missouri's secret lethal execution protocol risked causing their client an agonizing death. They cited the example of Clayton Lockett, an Oklahoma inmate who took 43 minutes to die last month, during a botched execution, a death so horrific that the State of Oklahoma suspended executions pending an investigation.    Lithwick and Beyerstein discuss immediate practical crisis of capital punishment, as well as the larger moral and legal issues surrounding the death penalty.
