Dr. Robert Glatter is Editor at Large for Medscape Emergency Medicine and Assistant Professor of Emergency Medicine at Zucker School of Medicine at Hofstra/Northwell. Dr. Peter Papadakos is Professor of Anesthesiology, Surgery, Neurology and Neurosurgery at the University of Rochester, and a Professor of Internal Medicine at Mercer University School of Medicine. Drs. Papadakos and Glatter dissect the harsh realities of suffering and injustice surrounding the execution of Kenneth Smith in Alabama, the first person executed using nitrogen gas. They explore what nitrogen is and its physiological effects and reflect on the inhumane nature of nitrogen hypoxia. The conversation also touches upon the broader issues of botched executions, delayed executions as psychological torture, the absence of definitive DNA evidence in some death row cases. They highlight the point that both the American Medical Association and the American Society of Anesthesiologists as well as many nursing associations state that participating in executions is not the practice of medicine and is prohibited by their members. This means that executions are conducted by non-medical personnel. They also point out that delaying executions, sometimes for decades, falls under the definition of torture under the Geneva conventions. I have known Ben ever since June, 2014 when he fought a former fighter of mine on Journey Fight Series (shout out to team Smandych! we miss JFS!!!) in an 8-man tournament, and I have been following Ben ever since! We have a chat about his event - Capital Punishment and what his motivation is to host a fight event, of course we talk about some of the key match ups that went down including the main event for the Muay Thai Canada national title. Scott Turow is a writer and attorney. He is the author of fourteen works of fiction, including Presumed Innocent, and most recently, Presumed Guilty, which hit the shelves in January of this year. All of his novels have been New York Times bestsellers. His defense team has filed motions to suppress key evidence, arguing that the use of Investigative Genetic Genealogy (IGG) violated his constitutional rights. They contend that law enforcement's application of IGG, which involves using DNA from public genealogy databases to identify potential suspects, was conducted without proper warrants, rendering the subsequent evidence inadmissible. Additionally, the defense claims that search warrants for Kohberger's phone, car, and residences were obtained through misleading information presented to the court.In a broader strategy to remove the death penalty as a potential sentence, Kohberger's attorneys have previously argued that capital punishment violates contemporary standards of decency and international treaties against prisoner torture. They also assert that prolonged periods on death row constitute cruel and unusual punishment.
