Online streaming services operating in Canada will have to contribute five per cent of their Canadian revenues to support domestic media. That's about $200 million each year. Some of the money will go to local and Indigenous media. And: You may not know that when you file a complaint with the Canadian Transportation Agency and win your case, you could still wind up in court. Changes to the law make it easier for airlines to challenge rulings – potentially dragging passengers into legal battles. Plus: Even though he has declared victory, Indian Prime Minister Modi didn't get the absolute majority he wanted. Some analysts are suggesting that he needs to step away from identity-driven politics.

This case involves a challenge to the validity of regulations adopted by the Agency to compensate air passengers for various delays, losses and inconveniences experienced in the course of international air travel. Parliament adopted the Transportation Modernization Act, S.C. 2018, c. 10 (“TMA”), which amended the CTA by creating the new s. 86.11. This new provision requires the Agency, after consulting with the Minister of Transport, to make regulations imposing certain obligations on air carriers, notably in relation to flight delays, flight cancellations, denial of boarding, and loss of or damage to baggage. Pursuant to s. 86.11(2) of the CTA, the Minister issued the Direction Respecting Tarmac Delays of Three Hours or Less, S.O.R./2019-110 (the Direction) requiring the Agency to adopt regulations imposing obligations on air carriers to provide timely information and assistance to passengers in cases of tarmac delays of three hours or less. Around the same time, the Agency adopted the Regulations, imposing obligations, including liability, on air carriers with respect to tarmac delays, flight cancellations, flight delays, denial of boarding and damage or loss of baggage in the context of domestic and international air travel. The appellant airlines challenged numerous provisions of the new Regulations on the basis that they exceed the Agency's authority under the CTA. They claim that the Regulations contravene Canada's international obligations, in particular the Montreal Convention and many of the Regulations' provisions are ultra vires because they have impermissible extraterritorial effects, which violate fundamental notions of international law. These matters went directly to the Federal Court of Appeal. It dismissed the appeal, except with respect to s. 23(2) of the Regulations which it found ultra vires of the CTA (this section deals with liability for temporary loss of baggage). Richard Cashin, lawyer, politician, union leader (b at St John's 5 Jan 1937). He was a grandson of Sir Michael Cashin, sometimes known as "King of the Robbers" for his south shore salvage operations, who was frequent Cabinet minister and prime minister of Newfoundland, and he was the nephew of Peter J. CASHIN. Cashin was himself elected Liberal MP for St John's West in 1962, 1963 and 1965.After his defeat in 1968 he practised law and won a significant settlement for Placentia Bay fishermen who were suing the Electric Reduction Co for phosphorus-based destruction of their fish. In 1970 he joined with Father Desmond McGrath, a former St Francis Xavier University classmate, to help organize the Fishermen's Union. After major victories over the fishing companies at Burgeo in 1972 and in the trawlermen's strike of 1975, the union fully established itself. Now the biggest union in Newfoundland by far, the Newfoundland Fishermen, Food and Allied Workers' Union is a major political force.Cashin supported NDP candidates in the mid-1970s but joined the National Unity Task Force and the board of Petro-Canada in 1977. In the 1980s, however, he has led the NFFAWU into full support of the NDP and is himself a party vice-president. The union has also been very active in the Coalition for Equality, a broad coalition of labour and other progressive groups. In spring 1987 he led the union out of the United Food and Commercial Workers International Union into the new Canadian Auto Workers. Cashin was founder of the Fishermen, Food and Allied Workers' Union and its president from 1971 to 1993. He was chairman of the Task Force on Incomes and Adjustment in the Atlantic Fishery (1992-93). He also became chair of the Fishing Industry Renewal Board and a member of the Canadian Transportation Agency. We break down the airline bailouts at Air Canada and Air Transat, and what consumers must do and by when to get their money back and how to apply for these refunds and other details.We also cannot help ourselves as we talk about the challenges for consumers of passenger air travel in the best of times, and now in the worst of times.  Air passengers who are bumped from overbooked flights or who are forced to sit through long delays could receive up to $2,400 under proposed regulations for the government's promised passenger bill of rights.  The proposed compensation will use a sliding scale with larger airlines and longer delays requiring bigger compensation payments. The Canadian Transportation Agency is releasing the draft regulations for public comment with an aim to having the rules take effect by next summer. He’s filed twenty-six successful regulatory complains and has more or less paved the way for many other airline passengers to do the same.
