For lovers of tax controversy, disputes between taxpayers and the IRS over Malta pension plans should be legendary. Following the Lockport Cave boat tragedy, Rob Ortt is part of a group of lawmakers seeking regulations for attractions like the Lockport Cave.
After courts held that the IRS violated the law when it issued Notice 2017-10 classifying syndicated conservation easement transactions (“SCETs”) as “listed transactions,” the IRS scrambled to salvage the situation. In particular, it released Proposed Regulations in December 2022, which centered on information-reporting requirements for those involved with SCETs. About three weeks later, Congress enacted the Secure 2.0 Act. That legislation did not address disclosure duties; rather, it identified easement donations that would get a tax deduction of $0 if their value surpassed a certain amount. The disparate objectives, timing, terminology, and standards in the Proposed Regulations and Secure 2.0 Act have caused confusion among easement stakeholders. The attached article examines the current situation, as well as the actions leading up to it.
The European Union is considering adopting a wide-ranging regulatory regime for the licensing and litigation of standard essential patents (SEPs). Proposed for release on World IP Day (April 26, 2023), a leak revealed the EU plan to create an administrative tribunal to perform mandatory “essentiality checks” of certain SEPs, set royalty rates for those SEPs, mandate public disclosure of licenses, and provide mandatory but non-binding conciliation for disputes. Critics contend that this regulatory regime is unnecessary and will stifle the explosive rate of innovation in mobile telecommunications with added costs. Supporters argue this regime will bring more certainty in the marketplace and reduce costs in litigation over SEPs. Although fines are not generally deductible, they may be deducted when attributable to restitution, remediation, or paid to comply with the law. The Tax Cuts and Jobs Act clarified these rules and the IRS has recently proposed regulations that delineate the distinctions between non-deductible fines and deductible government payments. Air passengers who are bumped from overbooked flights or who are forced to sit through long delays could receive up to $2,400 under proposed regulations for the government's promised passenger bill of rights. The proposed compensation will use a sliding scale with larger airlines and longer delays requiring bigger compensation payments. The Canadian Transportation Agency is releasing the draft regulations for public comment with an aim to having the rules take effect by next summer. The regulations would also force airlines to automatically seat children under age 14 next to their parents rather than require them to pay an additional fee to select their own seats.
