It appears law firm financials are heading in a positive direction. The Thomson Reuters Institute's Law Firm Financial Index rose 14 points in the first quarter of 2023, marking the first increase since Q2 2021. The index found that billing rate growth remained healthy, up almost 6% over the past year, and law firm direct expenses grew more slowly in Q1. Practices such as litigation and labor and employment saw increased demand in Q1 compared with the previous quarter. However, the index also noted a decline in profits-per-lawyer and lawyer productivity over the past 12 months. The report found a divergence between the largest and midsize law firms, with midsize firms seeing an increase in demand and headcount growth but also an increase in direct expenses. In contrast, Am Law 100 firms saw direct expense growth kept to less than 5% but experienced a decline in demand for their services.Law firm financials heading in the right direction, report finds | ReutersPeter J. Schwartz, a Pennsylvania man, has been sentenced to 14 years in prison for assaulting police officers with pepper spray outside the U.S. Capitol during the January 6 riot. Schwartz, who was convicted last December, was found to have been at the forefront of the mob that attacked police at the lower west terrace of the Capitol. He boasted later that he had "started a riot" by "throwing the first chair". Prosecutors said Schwartz seized a police duffle bag full of pepper-spray canisters and handed them out to others in the mob, including his wife, so they could turn them against police officers. Schwartz was found guilty on four counts of assault with a dangerous weapon and six other charges, including obstructing an official proceeding and entering a restricted building with a dangerous weapon. His 170-month prison term surpasses the previous longest sentence yet handed down in a case related to the Jan. 6 attack. At least 950 people have been charged and more than 600 convicted for their roles in the Capitol rampage.Man who pepper-sprayed police gets 14 years in longest Jan. 6-related sentence | ReutersFlorida Governor Ron DeSantis has signed a bill that grants a new board he controls the authority to void development agreements its predecessor signed with Walt Disney. The bill passed the Republican-controlled legislature largely along party lines. The Central Tourism Oversight District Board, whose members are appointed by DeSantis, can cancel any deals signed up to three months before the board's creation. The move comes after Disney and DeSantis have been in a feud since last year when Disney criticised a new state law banning classroom instruction of sexuality and gender identity with younger children. I anticipate this will be a topic of discussion on Esquiring Minds later this week, so don't forget to jump over to there if you're interested in hearing an actual expert, Jacob Schumer, discuss the latest news on the Disney–DeSantis brouhaha. DeSantis signs bill allowing Florida board to cancel Disney deals | ReutersThe governance arm of the federal judiciary is being called upon to investigate Supreme Court Justice Clarence Thomas again following recent reports on his undisclosed financial ties to Texas billionaire Harlan Crow. The move has brought the judiciary's process for enforcing financial reporting rules under scrutiny, with long-running concerns that it is inadequate for such matters. A red flag had previously been raised about the handling of public allegations of wrongdoing against Thomas over a decade ago, sparking internal process changes. US District Judge Mark Wolf raised concerns in 2012 that the Judicial Conference of the United States was being kept in the dark and shut out from reviewing complaints against Thomas. Wolf's objections led to changes in the process that should now formally notify the conference of complaints against Thomas and how they're handled. This latest controversy, like the one in 2011, has caused a national debate about how the judiciary enforces ethics rules and the Supreme Court's lack of a binding code of conduct.Justice Thomas Ethics Review Questioned by US Court Leader in 2012The US Justice Department has reached a settlement on antitrust concerns surrounding Swedish lockmaker Assa Abloy's $4.3bn purchase of Spectrum Brands' Hardware and Home Improvement unit, allowing the deal to proceed. The Justice Department had sued to block the acquisition in September 2022, arguing that it would limit competition in the residential door hardware industry and raise prices. The settlement requires Assa Abloy to divest some of its brands to Fortune Brands Innovations, which will acquire Emtek, Schaub, Yale and August brands from Assa Abloy. The deal still needs to be approved by a judge. Spectrum Brands' CEO David Maura said the agreement was a "critical milestone toward putting HHI [Spectrum's hardware unit] in the hands of Assa Abloy".DOJ Settles Antitrust Case, Clearing Way for Assa Abloy Deal - WSJA National Labor Relations Board judge has ruled that Starbucks Corp. broke US labor laws when it fired five union activists who appeared in a news report filmed inside a closed store in Memphis, Tennessee. Starbucks terminated the workers in February 2022, alleging that their meeting with the news crew had taken place without the company's approval. But prosecutors alleged that the firings had been motivated by retaliation against workers' attempts to form a union. The judge also found that the coffee giant had committed other unfair labor practices in the Memphis store, including the temporary closure of the site to frustrate a union demonstration. However, the judge found that the termination of two of the workers was lawful. The company said that it was evaluating the decision. It is sometimes nice to get together with your sister and have a Sunday Morning Talk. And on this episode of talking-based podcast Las Culturistas, that is what Bowen Yang and Matt Rogers do. Over weed and coffee, the two dive into all things recent (except Succession, sorry sorry sorry): the Disney-DeSantis war, marijuana in NYC, Chappell Roan's imminent ascendance to That Girl, "being a finalist", the definition of a "sneaky link", the Porsha and Gizelle of it all on RHUGT, wifi and internet wars both on land and in the skies, the end of Taylor and Joe, the Super Mario Bros movie, boygenius slaying it, and AO Scott's retirement. Also, Luigi as a queer figure, Peach as a nothing figure, and republicans as physically ugly figures. All this, Yellowjackets/Melanie Lynskey, Monster's Inc./Shrek, improv/roleplay, Ellen Pompeo quietly leaving Grey's Anatomy, reviews of The Thanksgiving Play and Sweeney Todd on Broadway, "Thatgirlability", Drew Barrymore being an icon, and coffee shop milk counter etiquette. Where were you when Taylor and Joe broke up? When do you think was the end of glamour and taste? Does your FYP give you what *you* want or what *they* want? Regardless of the answers to these questions... Katie, you're a finalist. Now have a great day.See omnystudio.com/listener for privacy information.

The man who deemed the recent fight between Disney and Florida politicians “like a really ugly middle school ugly middle school breakup” sat down to talk with Florida's Fourth Estate hosts Ginger Gadsden and Matt Austin about the Reedy Creek Improvement District debacle. “(Disney and Florida politicians) were hot and heavy in this case for, like, five decades sort of each scratching each other's back and then all of a sudden you know Disney said, ‘Eh, we're not so fond of this Don't Say Gay bill, which they only said after a lot of pressure,” Orlando Sentinel columnist Scott Maxwell said. “And then Disney, and this is really important in my mind and it gets overlooked, Disney also said we are going to stop giving you money, which Disney has given to politicians on both sides of the aisle for decades and as soon as that happened the politicians just went apoplectic.” He's referring to politicians approving a bill that would dissolve the Reedy Creek Improvement District. Maxwell, who has been covering Central Florida for years, calls it a rush job. “Part of the problem here, Ginger, is that you have probably done more research into what Reedy Creek involves than the legislatures and the policymakers who abolished it,” Maxwell said. Gov. Ron DeSantis signed the bill into law in April. If nothing changes, the special district that has given Disney space to self-govern for decades would go away in 2023. On Florida's Fourth Estate, Maxwell discusses what getting rid of that district could mean for Disney. “There are some people who say, ‘Well, Disney is going to disintegrate and problems will happen if they don't have these powers.' I think that's a bunch of horse hockey,” Maxwell said. “If Disney doesn't have its own government, you know what Disney will do? It will function just like every other company in the world that doesn't operate its own government.” Maxwell also discussed the impact on local taxpayers. “Last we checked, there was something like a billion dollars worth of bond indebtedness that Disney has basically assumed right now via Reedy Creek, and if the state takes it over or if Orange County takes it over, that means taxpayers ultimately take it over and we still don't have good answers on to who is going to be responsible for all of that,” he said. Maxwell also goes on to talk about how all this plays into the DeSantis' political aspirations on the latest episode of Florida's Fourth Estate. You can hear his analysis and get a breakdown of this political battle and the week's most interesting stories in our state from hosts Matt Austin and Ginger Gadsden. Is restoring American energy independence as easy as rescinding an EO? It's a start, but Chuck Yates explains that's all it is. Policy instability and industry setbacks have kept capital out of the oil and gas industries, and the "windfall profit" claims are mythical. The oil/gas expert gives us a look at the complex issues behind the US decline in production and what can be done to reverse it. Plus, Dustin Siggins joins us to talk about the Disney-DeSantis feud and take a larger look at corporate America's vast China problem.

Matt Gaetz joins the Pod to discuss Libs of TikTok and Disney. Libs of TikTok Is anyone safe online? Is doxing the new normal? What happens when, not if, someone gets hurt because of doxing, which is revealing someone's anonymous online identity. Taylor Lorenz, from the Washington Post, doxed the anonymous woman who operates the popular Twitter account “Libs of TikTok.” Lorenz, the former New York Times journalist who earlier this month broke down in tears on MSNBC while recounting “harassment” she has experienced online, published an article on Tuesday doxing the Libs of TikTok creator. Glenn Greenwald, the Pulitzer Prize-winning journalist, slammed Lorenz, tweeting: “The same people who – just 2 weeks ago – were insisting that criticizing Taylor Lorenz is wrong because it generates ‘harassment' toward her are now cheering as she shows up at the homes of the relatives of Twitter users to dox them.” Ben Shapiro, the conservative commentator and Daily Wire co-founder, tweeted: “Taylor Lorenz is a terrible journalist and worse human.” Disney Disney is not a special place. Disney needs to play on rules of equity and pair their fair share. Florida Governor Ron DeSantis made that happen. DeSantis signed a bill in late April 2022 dissolving the Reedy Creek Improvement District, the autonomous zone outside of Orlando where Disney established Walt Disney World. The district, created in 1967, allowed Disney to act as a self-governing body with its own municipal services and building codes. “This company had a deal unlike any company or individual in all the state of Florida, probably anywhere in the United States. They were self-governing, they had extraordinary powers, they could build nuclear power plants, they didn't have to go through permitting processes and obviously a lot of tax benefits. And that's just inappropriate,” DeSantis said.

Today we're celebrating Ron DeSantis, seemingly one of the only Republican politicians with an actual spine, hitting back against Disney after the company tried to use lies and propaganda to stoke opposition to the Parental Rights in Education bill. For some reason, the Left is still mad about this law, and many of them still actually think it's called the "Don't Say Gay" bill. However, as we've discussed, all the bill does now that it's been made law is to guarantee that schools and teachers cannot keep secrets from parents and that explicit discussion of sex and gender identity cannot be included in school curriculum. But that didn't stop Disney from raising a disrespectful ruckus about it, and now it's paying the price, as DeSantis has stripped Disney of special legal privileges that allowed the company to effectively institute its own government on its land.
