During this episode, Jay and Dan connect over their personal brand, how to capture an audience's attention without losing morality, and one of Dan's passion projects: authoring a book.Dan and Jay kick things off with a discussion about Dan's marketing as a lawyer and the importance of authenticity. Dan talks about his journey and inspiration behind making his content relatable (4:25).Later, Dan toys with the idea of creating a TV show (7:35) and Jay poses the question: How do you create content that captivates an audience without losing your loveable nature? Dan and Jay brainstorm an answer – mimic elements of reality TV and make the viewers feel like they are “right there in the shit with you,” creating a narrative that an audience can follow from beginning to end (16:20).In the middle of the episode, Jay dives into Dan's book, 12 years in the making. Dan talks about how he channels fictional writing in his legal writing to keep his reader interested (24:15), but Jay pushes back with his own views and writing process as he works on his own novel (29:50).Near the end of the episode, Jay suggests a lot of lawyers are really creative and were considering other creative careers before choosing law (35:20). In Non-Compliant Podcast Episode 50 Host Jay Edelson, nationally recognized plaintiff's attorney and founder of Edelson PC, sits down with Eric Troutman, a prominent class action defense lawyer and the Czar of TCPAWorld. To start the show, Jay and Eric talk about their careers. Despite having wildly different paths, both attorneys started in BigLaw, opened their own firms, and now have podcasts discussing a wide range of issues (6:30). Next, Jay and Eric discuss counseling clients on the defense side (19:00). According to Jay, when valuing cases on the defense side he looks at the plaintiffs' attorneys and asks himself how much they need out of the settlement. For Eric, the first things he looks at are market value, jurisdiction, judge, and opposing counsel. Eric even goes so far as to say, the lowest dollar you can settle for is the lowest dollar the court will approve, not the lowest dollar the plaintiffs attorney will accept. In Non-Compliant Podcast Episode 46, Host Jay Edelson, nationally recognized plaintiff's attorney and founder of Edelson PC, and Guest Elizabeth Chamblee Burch, the Fuller E. Callaway Chair of Law at the University of Georgia School of Law, and author of Mass Tort Deals: Backroom Bargaining in Multidistrict Litigation, discuss Elizabeth's most recent work, a two-year procedural justice study titled, Perceptions of Justice in Multidistrict Litigation: Voices from the Crowd.To start the show, Jay and Elizabeth get into the weeds of what is going on in the Plaintiff's Bar and Elizabeth's study. After spending two years conducting research for this project, Elizabeth came to the following conclusion— MDLs work really well for plaintiff attorneys, but not their clients. The reason for this? MDLs are like factories—they were built to serve a goal of efficiency, which often leaves clients unsatisfied and feeling like they are not being heard (15:36). Later in the show, Elizabeth offers a solution to improve client satisfaction with the MDL process. According to Elizabeth, for people to feel good about judicial system, it's not only the result they look at; they also look at procedural fairness— people want accountability, for others and the system to acknowledge the harm they've been subjected to, and to protect other people from these products/ companies (15:36).Next, Elizabeth and Jay discuss the improper (and shocking) way many plaintiff's firm calculate their costs, which includes charging their clients for steak dinners, flying private, and charging interest (34:34). To end the show, Jay and Elizabeth discuss what the future holds. If the past is an indicator, Elizabeth is not optimistic, change is really slow, and the status quo benefits attorneys and judges (40:21). In Non-Compliant Podcast Episode 45, Host Jay Edelson, nationally recognized plaintiff's attorney and founder of Edelson PC, and Guest Jonathan Pollard, a high stakes competition lawyer and founder of Pollard PLLC, discuss Elon Musk's tweet about building an in-house legal team of “hard-core streetfighters".Jay and Jonathan start the show by giving their initial reactions to Musk's tweet, discussing how the hiring paradigm that large corporations such as Tesla use make it difficult, if not impossible, for Musk to assemble the legal team he wants (3:15). Pollard explains that “elite” Big Law firms create risk-adverse, “paint-by-numbers” players. Later in the show, Jay and Jonathan discuss in-house positions more generally (10:45). The discussion then turns to possible solutions not only for the challenge Musk faces in assembling his legal team, but also to the challenges corporate in-house teams face more generally (16:45). Jay suggests Musk incentivize firms on the project by offering money for big wins rather than an hourly bill rate to address issues of motivation and passion for the work. Jonathan highlights the need for companies to seek out small firms that are subject-matter experts, rather than using huge firms who may perform poorly in the areas where they lack expertise. After this, Jay and Jonathan shift to their personal experiences with “streetfighter” lawyers (23:21), the dynamic of audacity and success, and Musk's crusade against Twitter's plague of fake accounts (32:35). Finally, Jay asks Jonathan what advice he might give law students considering various career paths, to which Jonathan answers: do your due diligence to avoid a miserable experience, know that you can be successful beyond the “triangle” of Big Law, Big Corporate, and Big Government, and seek out firms that care about mentorship (39:11). Federal Judge Durkin is not having any of the Tom Girardi BS. In December 2020 Edelson PC filed their lawsuit against Tom Girardi, Girardi Keese, Erika Girardi, and her companies, former Girardi Keese lawyers Keith Griffin and David Lira. That is the lawsuit that alleges a 20 million dollar loan from Girardi Keese to Erika Girardi, that the divorce was a shame and that the victims are widows and orphans. That same day Edelson PC also filed their Motion for Rule to Show Cause asking the court to enter an order; 1) requiring Girardi Keese to show cause why7 it should not be held in contempt for violating the Court's orders relating to the settlement of [the six lion air client cases], and 2) granting any such further relief as it deems reasonable and just. The court seems focused on further relief after already holding Tom Girardi and Girardi Keese in contempt. At the end of three days of evidentiary hearings, the court asked the lawyers to further brief on “[d]o I have the power to order you to pay the clients not because you violated a court order but because in failing to come to me you caused the plaintiffs to lose that money”. It seems that at least as to the Lion Air clients there are court proceedings moving forward strongly focused on how to make the clients, whose settlements weren't paid too, whole. Remember, this is the Judge who forwarded this incident to Federal Prosecutors, and we know they have at least opened an investigation because Federal Prosecutors filed a motion asking the court for access to unsealed documents. What do you think will happen next? Key Take-Aways Federal Judge Durkin is focused on if he can sanction former Girardi Keese lawyers Keith Griffin and David Lira and possibly Edelson PC as a firm or its lawyers for not bringing issues with Tom Girardi not paying clients of the Lion Air case to the court. Tom Girardi Exclusive Voice Mails Tom is heard over two voicemails left for attorney Jay Edelson after the filing of the Motion for Rule to Show Cause saying: “I'm a good guy, get along great with all the Judges, I can do some real good shit but I want to make sure that you know we'd be joined at the hip” and “I want to be in charge of all your shit and at the end of about nine months I want you to say ‘God Tom, you made me another Million'”. During Testimony during Day 3 of the contempt hearing Jay Edelson testified that Tom Girardi had called him repeatedly after the Motion for Rule to Show Cause was filed and that Tom indicated he could make him a ton of money because of his connections with Judges in California, and that the whole thing was ‘beyond unseemly'. What Happens Next? The lawyers for former Girardi Keese lawyers Keith Griffin and David Lira and the lawyers for Edelson PC will submit a briefing to the court about if the court can impose sanctions not for violating the court order, which Tom Girardi, has already been held in contempt for…but for not bringing it to the courts' attention sooner. They will also be submitting a chart breaking down the Girardi Keese client IOLTA account to see what happened with the settlement money after Boeing funded the settlements in March 2020. Seeing what happened with that money will be very interesting. The court will rule on the Sanctions and contempt. Sanctions may be possible, but contempt here is unlikely. The lawsuit filed by Edelson PC against the lawyers and Erika Girardi is still moving forward in Illinois and will continue forward into discovery. Script Supervisor Mamie Mitchell files a new lawsuit against Alec Baldwin and others alleging egregious negligence in their handling of the gun on the Rust set and outlining the facts of the script, which did not call for Baldwin to cock or fire the gun. In the ongoing litigation in the Girardi bankruptcy, Edelson PC won their declaratory relief from the court allowing them to try to pursue litigation against Erika Girardi in the Illinois suit they filed against Erika and several other attorneys in the firm. In the process of this motion Special Counsel Ron Richards was replaced by the Bankruptcy Trustee by attorney Larry Gabriel after Richards was accused of conducting a bizarre shakedown of Edelson PC. According to Carolyn, the Chief Justices relied on their hallmark move— making decisions that do not appear to be earth shattering, but contain the seeds for significant applications and legal changes (4:20).Next, Jay and Carolyn discuss the confirmation process (14:30). For Jay, confirmation hearings seem inconsequential, as nominees know the questions they're going to be asked, and the correct way to answer them. Because of this, it's hard to determine a candidate's actual judicial philosophy.Later in the show, the extreme significance of the Supreme Court's decisions on average Americans is discussed (31:00). Professor Shapiro notes that she was particularly upset about the voting rights decision that came down at the end of the term, which essentially re-wrote the voting rights act to make it extraordinarily difficult to challenge voting restrictions that benefit Republicans and hurt Democrats (31:30).To end the show, Jay and Carolyn discuss TransUnion, which looks at Article III standing (38:00). Calls to take down abusive and harassing content is often met with apathy from the largest tech companies. As victims of this online abuse can’t wait for law enforcement to act, social platforms must step up to remove this harmful content and step out from behind Section 230’s liability shield. In Non-Compliant Podcast Episode 32, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Carrie Goldberg, Founder of C.A. Goldberg Victims’ Rights Law Firm and author of Nobody’s Victim, discuss sexual harassment and abuse on the internet, the problems with Section 230, and why Big Tech companies need to do more to stop online predators To start the show, Carrie dives into her work to protect people who face cataclysmic online abuse, including revenge porn, cyber-stalking, sextortion, and the lasting impacts of child pornography (2:30). Carrie explains that the bulk of the harm her clients face happens on major social media platforms like Facebook, Instagram, and Snapchat, which do little to prevent these abusive actions—often ignoring requests to take down damaging content (5:30). Next, Jay and Carrie discuss how tech companies face limited accountability for ignoring requests to remove harassing content under Section 230’s liability shield (7:30). Through the lens of one of Carrie’s cases against Grindr, she explains that the provision is getting attorneys to seek other legal theories, such as product liability, to force tech companies to take down abusive content that can ruin people’s lives (12:30). Jay and Carrie continue their discussion on Section 230 as they pivot to the power dynamics of Big Tech’s stranglehold of Congress and the courts that has cemented the online liability shield (20:00). Even with a flurry of bills to reform Section 230, Big Tech’s power to influence the debate will limit any short-term changes to the law (21:00). But the public’s shift in their views of tech companies is likely to lead judges and lawmakers to make important long-term changes to the liability shield. Later in the show, Jay and Carrie chat about the difficulties to stop online sexual harassment (30:00). Often, local law enforcement act too slow to stop abusers due to limited resources and the inability to force tech companies to remove content. Outside of the criminal justice system, abusers are often judgment proof which gives little to no value in pursuing civil claims (34:00). As Carrie explains, it is often crueler to victims to have them go through lengthy court proceedings with their abusers when the outcome is unlikely to stop the harassment. To wrap the show, Carrie explains that her experiences with revenge porn and online abuse led her to launch her own victims’ rights firm and to become a leader in the field (40:45). Carrie saw that there weren’t attorneys that had expertise dealing with all aspects of digital abuse cases and has made it her mission to protect online harassment victims that need someone in their corner fighting the fight against Big Tech’s inaction.
