We and our financial advisors are preparing to need money to last 30 plus years in retirement, yet we don't trust LTC insurance companies to help protect us during that time. If we think we're going to live that long, do we really believe we will remain as strong, healthy and active as we are today? Look at our parents and grandparents. Humans slow down as we age. Dementia is showing up in our 60s. People are having strokes in their 50s due to stress. We need to be prepared. LTC insurance is strictly regulated by the NAIC (National Association of Insurance Commissioners) to make sure that rules are followed for marketing and claims. Learn how our state departments of insurance protect us The America Association for LTC insurance was created in 1988 to educate consumers and support insurance/financial professionals. You can learn a lot from them The report from Faegre Drinker on NAIC Model regulation can be found Estimate LTC premiums View current and projected costs of care where you live Schedule a meeting with me and Prepare for Tomorrow
It's All Hearsay! The podcast where lawyers give current news, practical tips and real stories on legal issues relevant to in-house attorneys - hosted by the Chicago Chapter of the Association of Corporate Counsel (ACC). In this episode, you'll hear Mollie Sitkowski, partner in Faegre Drinker's customs and international trade practice, discuss a preliminary review of issues and policies companies need to consider that may impact supply chains and U.S. trade as a result of the 2024 election. A quick disclaimer that this podcast was recorded shortly after the election results and things have moved quickly since then, so we may have some new information since recording, but the underlying conclusions remain the same.
In this episode of On Record PR, sponsored by Lawline, Gina Rubel goes on record with Shawn Swearingen, Chief Innovation Officer of Faegre Drinker, to discuss the practical applications of generative AI for the legal industry and its ethical challenges. Learn More Shawn Swearingen serves as Faegre Drinker's chief innovation officer. She collaborates with the executive and operations leadership teams to keep the firm on the frontline of organizational development and emerging legal trends conducive to a culture of innovation. Harnessing the potential of technological advances, she develops, champions and leads strategic innovation initiatives related to data science and analytics, client and practice technologies, and knowledge management. Shawn supports the firm's growth goals by helping to advance new ideas, introduce best practices and encourage design thinking across the firm.
This week, we talk with a team of innovation leaders from the law firm Faegre Drinker. The guests included Shawn Swearingen, Chief Innovation Officer; David Gross, Design Lab co-founder; and Ruben Gonzalez, Design Lab Director. The discussion centered around the relaunch of Faegre Drinker's Legal Design Lab in Scottsdale, Arizona, exploring its origins, evolution, and impact on legal problem-solving. The Legal Design Lab's inception traces back eight or nine years when an associate at the firm, Helen Chacon, reconnected with her Stanford Law School friend Margaret Hagan, who was pioneering the concept of legal design. Intrigued by the idea of applying design thinking—a user-focused, empathetic approach to problem-solving long used in other industries—to the legal field, the firm embarked on a deep dive into the methodology. This included David (DJ) Gross auditing courses at Stanford's D-School and team members like Kate Rozavi designing courses on visual advocacy at the University of Minnesota Law School. The relaunch and relocation of the Design Lab to Scottsdale were influenced by several factors, notably the firm's merger that expanded its geographic footprint and the practical considerations brought about by the COVID-19 pandemic. The move allowed the firm to acquire a significantly larger and more cost-effective space. With input from architects, designers, and Margaret Hagan herself, the new lab was designed to be a flexible, creative environment featuring movable furniture and an industrial aesthetic, fostering collaboration and innovation. Throughout the podcast, the team shared concrete examples of how design thinking has been instrumental in solving complex legal challenges. One such example involved simplifying a profitability tool for lawyers by using a color-coded system akin to credit score reports, making it more accessible and actionable. Another highlighted the use of tennis balls to demystify crystallography during a jury trial, showcasing how visual aids and empathetic explanations can lead to successful outcomes. These instances underscore the lab's focus on user-centric solutions and visual advocacy to enhance understanding and efficiency in legal processes. The guests also discussed the challenges of integrating design thinking within the traditional legal framework, particularly in encouraging open-mindedness and collaborative participation among lawyers and clients. They emphasized the importance of a learning mindset, active listening, and the willingness to embrace creativity and risk-taking. To further disseminate these ideas, the team mentioned an eBook available on their website, aimed at introducing legal professionals to design thinking and visual advocacy concepts. The Department of Labor released its final “Retirement Security Rule” recently, which aims to raise the legal bar for financial advisors, brokers, insurance agents and others who give retirement investment advice.Noted ERISA attorney Fred Reish Esquire, Partner at Faegre Drinker, shares his thoughts on some of the rule's key focuses and changes, along with implementation questions and potential hurdles to the rule becoming effective in September.Key Insights:Clarification of "Retirement Investment Advice": The updated Retirement Security Rule defines advice that is fiduciary in nature, emphasizing that even one-time advice must prioritize the investor's best interests. This redefinition aims to reinforce the legal and ethical duty advisors hold toward their clients. The new retirement security rule's implementation, scheduled for September 2024 with additional requirements phasing in by 2025, is set to introduce new compliance standards, enhancing overall financial advisory practices.New Protocols for IRA Rollovers: Advisors must now perform a thorough analysis to ensure recommendations, particularly concerning IRA rollovers, align strictly with the client's best interests. This includes comparing costs and services between the existing plan and any proposed IRA, a process that could challenge particularly those less familiar with stringent regulatory frameworks, such as independent insurance agents.Impact and Industry Response: While wealth management firms may find adapting to the new standards more straightforward due to previous regulatory experiences, independent insurance agents are anticipated to face significant hurdles. The industry's reaction is mixed, with some viewing the compliance requirements as burdensome, yet the overall sentiment recognizes the new Retirement Security Rule as a crucial step towards ensuring client interests are foremost.SEE ALSO:DOL Fiduciary Rule Hit With First LawsuitBreaking Down the Basics: DOL Fiduciary RuleDOL Final Fiduciary Rule Released, Set to Become Effective in SeptemberDOL Fiduciary Rule Update with Fred Reish

Fred Reish is a partner in Faegre Drinker's Fiduciary Services ERISA team, where he focuses on fiduciary issues, prohibited transactions, tax qualification, and retirement income. On today's episode, Fred and I discuss recent regulatory developments like Regulation BI and the proposed DOL fiduciary advice rule that was announced at the end of June, and how these things impact plan sponsors and the industry in general, especially when it comes to rollovers. We talk about the SECURE Act and specifically the guidance around guaranteed income and multiple employer plans and pooled employer plans also known as MEPs and PEPs. We cover evolving litigation trends, specifically in the areas of cybersecurity and data privacy. And we also discuss recent DOL guidance on ESG and private equity investing for ERISA plans.
