BIRTHRIGHT CITIZENSHIP HEADS TO THE SUPREME COURT And I'm not EXACTLY sure what will come out of this because this hearing is more about procedural stuff when it comes to district courts issuing stays that check the President of the United States's power. The Pacific Legal Foundation says Trump vs CASA is about "a Trump-era Executive Order aimed at ending birthright citizenship for children born to unlawful or non-permanent immigrants. Lower courts blocked the policy nationwide, not just for the plaintiffs, and now the Justices will weigh in on whether courts have the authority to issue such sweeping injunctions." What will this mean for birthright citizenship overall? I've got Joe Luppino-Esposito from the Pacific Legal Foundation at 12:30 on it.

How California’s state and local governments act in the wake of the devastating wildfires will be a harbinger of whether America can deal with its housing issues. California’s housing crisis was dire before the Southern California wildfires were sparked. As Jim Burling has recounted in his new book, Nowhere to Live, half of the nation’s homeless population lives in California. And between 2020 and 2023, California’s homeless population increased by 5.8 percent. Some argue that this housing crisis has only been exacerbated by errant government policies like exclusionary zoning and restrictive permitting conditions because these stifle the production of affordable housing. Others contend, however, that these restrictions are necessary not only to promote the orderly development of California’s land, but also to help prevent and avoid destruction done by wildfires and other natural disasters. Now, after so much property has been razed to the ground, how are California’s state and local governments addressing the needs of displaced landowners? What effect will Gov. Newsom’s emergency orders suspending the California Coastal Act’s requirements have on rebuilding? Will the California Coastal Commission comply with the Governor’s directives and how will it respond to rebuilding efforts? What implications will California’s response to the fires have on housing going forward?Join a panel of expert scholars, Jennifer Hernandez, Ilya Somin, and Nolan Gray, who will address these questions and much more.Speakers:Nolan Gray, Senior Director of Legislation and Research, California YIMBY Jennifer Hernandez, Partner, Holland & KnightProf. Ilya Somin, Professor of Law, Antonin Scalia Law School, George Mason UniversityModerator: Stephen Davis, Senior Legal Fellow, Pacific Legal Foundation

What happens when a government agency arbitrarily decides to hold millions of dollars' worth of inventory hostage? In this episode of American Potential, host David From speaks with Oliver Dunford, senior attorney at the Pacific Legal Foundation, about the legal battle facing Jake's Fireworks, a family-owned business caught in regulatory limbo. The Consumer Product Safety Commission is blocking Jake's Fireworks from selling $2 million worth of inventory simply because their fireworks make a "bang" instead of a "pop." Despite taking the agency to court, the family has been left in legal limbo because the commission refuses to issue a final ruling—leaving them with no path to challenge the decision. Oliver Dunford explains how this case highlights a broader problem of government overreach, where unelected bureaucrats impose regulations without accountability. This episode dives into the dangers of the administrative state, the legal fight for due process, and what this means for businesses across America. Tune in to hear why this case matters beyond fireworks—and how the fight for economic freedom and due process is more important than ever.

Mark Miller from the Pacific Legal Foundation talks about the TikTok "free speech vs. national security" case that's being heard today (Friday, Jan. 10) by the US Supreme Court. From Pacific Legal Foundation: This Friday, January 10, the Supreme Court will hear two hours of oral arguments in a high-stakes case that pits free speech against national security. At issue is TikTok’s appeal to block enforcement of the 2024 Protecting Americans from Foreign Adversary Controlled Applications Act, which mandates TikTok’s shutdown in the U.S. unless parent company ByteDance divests its operations by January 19. The Stakes: TikTok’s Argument: With 170 million U.S. users, TikTok argues the law unconstitutionally silences “one of America’s most popular speech platforms,” violating the First Amendment. The Government’s Stance: ByteDance’s ties to China pose a national security threat, as the Chinese government could exploit user data. The lower court upheld the law, citing its bipartisan roots and focus on addressing foreign adversary threats. But SCOTUS will now weigh in. The Twist: President-Elect Donald J. Trump filed a surprising amicus brief, urging the Court to delay its decision so he can negotiate a deal to keep TikTok operational in the U.S. Focus issues: The First Amendment and national security implications. The broader legal implications of U.S.-China tech tensions. What this decision means for millions of American TikTok users. But a study backed by Sam Altman (creator of ChatGPT) tested that theory out. They handed 1,000 people, $1,000 for 3 years. Some of the recipients did make good financial decisions. But overall, the group ended up a little deeper in debt and had a lower net worth! I'm not surprised. If you give people free money, they'll work less. Incentives matter. But even after this study, UBI proponents still believe a UBI is a good idea. Is it? One missed tax payment and the government takes your entire house, sells it, and keeps all the money. ———— To get our new weekly video from Stossel TV, sign up here: https://www.johnstossel.com/#subscribe ———— It's hard to believe that could happen in America, but it does. It happened to Tawanda Hall. Hall was behind on her property taxes. She was on a payment plan, but short $900. What did her county government do? They took her entire $308,000 house. Hall tried to pay off the debt but says, “They didn't want our money… They wanted our house." I covered her story two years ago. Her lawyer, Christina Martin of the Pacific Legal Foundation, told me this is unconstitutional. “The government can't take more than it's owed,” she explains. Now, she's won in the US Supreme Court. The justices voted 9-0 that such takings are unconstitutional. Yet, in a handful of states, greedy government officials still steal people's homes.   Post “Sudden And Unexpected” @toobaffled The 2020 genocide how they did it, perfectly explained in 3 minutes. https://t.me/Secret_history1 4:06 PM · Oct 14, 2024 144.1K Views   Nate Bargatze Best Stand Up - Back to school for means back to for #funny #australia #england #natebargatze #usa #standup #comedy

The cost of housing rose again last month, making it even more difficult for Americans to afford a home of their own. Inflation is just one of many problems creating a housing crisis in America. On today's episode of “The Daily Signal Podcast,” James Burling, a property rights lawyer with more than 40 years of experience, documents how zoning laws, environmental regulations, and progressive Democrat policies like rent control and affordable housing mandates have put the American dream out of reach for families. Burling is the author of a new book, “Nowhere to Live: The Hidden Story of America's Housing Crisis.” Through his work at the Pacific Legal Foundation, Burling has examined the misguided government policies that contributed to the problem of too few homes for Americans. His book diagnoses where the government went wrong and suggests steps that policymakers—and individual citizens—can take to get out of this mess. Enjoy the show!

On July 15, the Pacific Legal Foundation asked the Ninth Circuit Court of Appeals to reverse a lower court ruling in California that said elementary school students have no First Amendment rights. A six year old called B.B. in Capistrano Unified School District in Southern California was introduced to the phrase “Black Lives Matter” in her first-grade class during a lesson about Martin Luther King, Jr. After the lesson, the child drew a picture and wrote “Black Lives Mater (sic),” added “any life,” and gave the picture to her classmate. The school forced B.B. to apologize for her “racist” drawing, banned her from recess for two weeks, and even banned her from drawing pictures for friends. B.B.'s parents were never informed about the incident and found out years later. Hosted on Acast. See acast.com/privacy for more information.
