TRUMP SUDDENLY SPECULATING ABOUT A FUTURE WITHOUT HIM - 10.6.25

A-BLOCK (2:30) SPECIAL COMMENT: TRUMP SUDDENLY SPECULATES ABOUT LIFE WITHOUT HIM: From anybody else it would be trivia. From Trump this is startling. Buried in an ordinary narcissistic flight: "It'll be very unfair in the future when they (Republicans) don't have Trump to fight for them." That quote, might be the biggest headline Trump has made this year and it sailed RIGHT past the American news media yesterday. What in the HELL did he mean by that and more importantly why did he suddenly acknowledge there is an end, maybe soon? After being MIA for five days – no live public viewing of him, just one video that according to White House time stamps took more than two hours to produce even though it only required him to try to speak for a minute-ten… he EMERGED with what was, even for him, such an utterly bizarre and especially vulnerable admission. He was out of view for FIVE DAYS. FIVE. From that bizarre “please clap” speech before the Generals at Quantico on Tuesday – the Pete Hegseth International Day of Military Hair Care Symposium and Product Sampling – through yesterday morning when he managed to stagger out of the White House, blast a series of non sequitirs at the press pool, and then go to another military celebration for which we have the money even in the middle of his shutdown of the government. Nobody asked: HOW have you been, WHERE have you been, WHAT are they treating you for, WHAT does that "when they don't have (you) to fight for them" quote mean? Because again, as in the week he went MIA at the beginning of LAST month, nobody had a clue what would take a man with compulsive talking disease and an ego so large it has own it zip code, from appearing in front of crowds and cameras for FIVE DAYS. And THEN Trump went in front of the Navy and said he warned about Osama Bin Laden last year, and told Pete Hegseth about it a year before 9/11, and claimed he was president in 2016 but they fixed the 2016 election, but they ran it again and he "got 250." What. In The Hell. Is Wrong. With Trump’s Health? B-Block (27:44) THE WORST PERSONS IN THE WORLD: A $1 Trump coin? Ten cents per chin? Ian Miles Cheong doesn't think they'll eat his face. Noem and Lewandowski think they'll find undocumented immigrants attending the Super Bowl. And Kristi really has to go to the toilet. THIS IS OFFICIAL BUSINESS! C-Block (38:00) THINGS I PROMISED NOT TO TELL: Well, here we are. Fifty years ago Tuesday night, at 11:15 PM, I did my first broadcast on an actual radio station with advertisers and listeners. I was 16 and it's not bad for 16 and for the fact that my much older colleagues at WVBR-FM did a superb job of hazing me. Harriett is joined by Silvia Moreno-Garcia to discuss her chilling bestseller Mexican Gothic. The story begins when Noemí Taboada, a glamorous socialite from 1950s Mexico City, receives a desperate letter from her cousin Catalina, claiming her new husband is poisoning her. Unsure if Catalina is mad or truly in danger, Noemí rushes to High Place - a decaying English manor transplanted to the Mexican mountains. But is she to be the rescuer, or the unwitting prey of the evil that festers in the bones of the house? High Place, and its inhabitants, want Noemí, and it will take all her courage and ingenuity to save her cousin, and herself. A masterful blend of gothic suspense, startlingly vivid imagery and dark romance, Mexican Gothic has sparked intense fascination from readers around the world - and Silvia Moreno-Garcia will be answering questions from our global audience of book lovers. Why is Gothic literature seeing a resurgence in the 21st century? How does horror allow us to explore themes of colonialism and sexual violence? And where is the very real cemetery that inspired the setting of High House?

This Day in Legal History: Earl Warren AppointedOn October 2, 1953, President Dwight D. Eisenhower appointed Earl Warren as the 14th Chief Justice of the United States, setting in motion one of the most transformative periods in Supreme Court history. Warren, who had previously served as Governor of California and was the Republican nominee for Vice President in 1948, was a surprise choice—appointed during a recess of the Senate following the death of Chief Justice Fred Vinson. Though Eisenhower reportedly later regretted the decision, Warren would go on to lead a Court that dramatically expanded civil rights, civil liberties, and judicial power.Under Warren's leadership, the Court issued a series of landmark decisions, beginning with Brown v. Board of Educationin 1954, which declared racial segregation in public schools unconstitutional. The Warren Court also established the principle of “one person, one vote” in legislative apportionment, expanded the rights of criminal defendants in cases like Gideon v. Wainwright and Miranda v. Arizona, and reinforced the wall between church and state. Warren was known for his ability to forge consensus among justices, often securing unanimous decisions in major cases to strengthen the Court's moral authority. His tenure marked a fundamental shift in constitutional interpretation, emphasizing equality, due process, and the role of the judiciary in correcting social injustices. While praised by many for championing individual rights and the rule of law, the Warren Court also faced significant criticism from those who viewed its decisions as judicial activism. Warren retired in 1969, but the legal legacy of his Court continues to shape American law and society.New York Attorney General Letitia James filed a lawsuit and an emergency motion against U.S. Secretary of Homeland Security Kristi Noem and the Department of Homeland Security (DHS), accusing them of unlawfully withholding nearly $34 million in funding for New York's Metropolitan Transportation Authority (MTA). The MTA oversees subway, bus, and commuter rail systems across New York City and surrounding areas. James filed the suit in the U.S. District Court for the Southern District of New York, seeking a temporary restraining order to preserve the funds while the legal case proceeds.According to James, DHS abruptly reduced the funding allocation from nearly $34 million to zero, a move she described as unlawful and politically motivated. Her office emphasized that the emergency request does not seek immediate disbursement, but rather aims to prevent the funds from being lost while the court reviews the matter. She warned that the funding freeze could endanger the safety of millions of transit riders in New York. This legal action comes amid broader concerns raised by the U.S. Transportation Department, which recently threatened to withhold 25% of MTA's federal transit funding unless improvements are made to track worker safety protocols. DHS did not provide an immediate response to requests for comment.New York AG James sues Homeland Security for nearly $34 million over transit funding freeze | ReutersApple and OpenAI asked a U.S. judge to dismiss a lawsuit brought by Elon Musk's AI company, xAI, over claims that their partnership harms competition. xAI's suit, filed in August, seeks billions in damages and argues that Apple's integration of ChatGPT into its devices gives OpenAI an unfair advantage while sidelining rival products like Musk's Grok chatbot. Apple and OpenAI countered that their deal is not exclusive and that Apple plans to work with other generative AI providers.Apple's lawyers emphasized the openness of the agreement, asserting that the arrangement does not prevent competition or violate antitrust laws. In a separate filing, OpenAI described Musk's legal actions as part of a broader “campaign of lawfare” against the company, referencing previous lawsuits Musk has filed, including one challenging OpenAI's shift from nonprofit to for-profit status.OpenAI further argued that xAI had not demonstrated concrete harm or the kind of anticompetitive behavior that antitrust law is designed to prevent. Musk, who co-founded OpenAI in 2015 before departing, has accused the company and CEO Sam Altman of straying from its original nonprofit mission.Apple, OpenAI ask US judge to dismiss Musk's suit over competition claims | ReutersLawyers representing Prince Harry and other public figures accused the Daily Mail publisher, Associated Newspapers (ANL), of also targeting Prince William and Princess Kate in an ongoing privacy lawsuit. The new allegations, presented in filings at London's High Court, suggest that confidential details about William's 21st birthday were obtained through “blagging”—a deceptive tactic to access private information. Kate was allegedly targeted by a private investigator working for a Mail journalist.Prince Harry and six others, including Elton John and his husband David Furnish, are suing ANL for alleged privacy violations dating back 30 years. The lawsuit accuses ANL of unlawful activities such as voicemail hacking, obtaining medical records by deception, and even burglary. ANL has denied the claims and called them baseless and exaggerated. A trial is scheduled for early 2026.The publisher pushed back in court, arguing that the claimants failed to connect the alleged misconduct to specific journalists or investigators. They also sought to exclude findings from earlier cases against other newspaper publishers like News Group Newspapers and the Daily Mirror. ANL accused two claimants, Sadie Frost and Simon Hughes, of manipulating the timing of story publications to evade a statute of limitations—though the court had previously ruled in the claimants' favor on that issue.Prince Harry attended the hearing remotely, while several other claimants were present in court. This lawsuit marks the first time ANL has been directly implicated in the phone-hacking scandal that has plagued British tabloids for nearly two decades.Daily Mail publisher asks UK court to limit Prince Harry lawsuit | Reuters This is a public episode. How a SCOTUS Immigration Case Could Implicate Gun Owners (Ft. UC Law Professor Rory Little)

The Weekly Reload Podcast

This week, we're looking at potential fallout for gun owners from an unexpected area: immigration. Earlier this month, the Supreme Court of the United States (SCOTUS) issued a stay on an emergency basis in Noem v. Perdomo. Justice Brett Kavanaugh's statement in that case inspired UC Law Professor Rory Little to write a piece for SCOTUSblog on its potential implications in areas beyond immigration enforcement, including firearms law. He joins the show to elaborate on why he finds Kavanaugh's reasoning dangerous. Little said Kavanaugh's holding that immigration agents could use a person's apparent race, accent, and location as justification to detain them is troubling. He argued the idea that agents should be able to involuntarily stop and question somebody based on the idea that some percentage of similarly situated people may have broken the law could be turned on all sorts of people. He used gun shows as a prime example, arguing they primarily attract white men and can sometimes be the site of illegal sales. He argued an administration taking an aggressive approach to federal gun law enforcement could use Kavanaugh's logic to detain and question everyone at a gun show in hopes of catching the few that may be breaking the law. Little said that moving from a probable cause standard for detentions that relies on individualized suspicion to one based on demographics or probabilities would have far-reaching consequences for all sorts of Americans. He argued it's difficult to see how Kavanaugh's logic could be contained to immigration either, though he also emphasized Perdomo is still at a preliminary stage and other members of the majority haven't fully articulated their view on the matter. Special Guest: Rory Little.

A-Block (2:30) SPECIAL COMMENT: After perhaps the most hapless 96 hours of his presidency, the worst 96 hours of the worst presidency of ALL TIME, the most FAIL in the shortest span… the mentally-deteriorating, untethered-from-reality Trump… must RESIGN. And take his idiot sycophants with him. The last 96 hours: His U.N. speech, sounding like an escapee from a psych ward. His Tylenol news conference, sounding like an escapee from a psych ward who’s been living on the street for a month. His suggestion NATO countries shoot down Russian jets. His sudden embrace of Zelensky, either another stall or a stupid dare to Putin. MAGA’s RAGE AT his sudden embrace of Zelensky. The cover of a London right wing daily: his picture and in 72-point type, the word “DERANGED.” The ICE shooting in Dallas; his sadistic Homeland chief pretending the victims were agents when they were detainees; his idiot simpering Vice President pretending the victims were agents when they were detainees; his corrupt venal FBI director pretending the victims were agents when they were detainees. His ICE chief not denying he took $50,000 in a paper bag. His staff THEN denying he took $50,000 in a paper bag. His cancellation of a meeting with Democrats making sure if there’s a government shutdown it’s all his fault. His crackpot pal Milei crashing the Venezuelan economy and needing us to bail him out. His paranoia over the stopped teleprompter at the U-N that was his White House staff’s fault. His paranoia over the stopped escalator at the U-N that was his own vanity videographer’s fault. His desire to arrest the U.N. escalator technician or the U-N escalator button pusher. His desire to arrest the escalator AND James Comey. The election of Raul Grijalva’s daughter to Congress. The fact that Adelita Grijalva will be the last Representative needed to force a vote on releasing the Trump Epstein Files. His self-humiliation at the Kirk Memorial. ABC reinstating Jimmy Kimmel. Meaning Disney told him to eff off. Meaning the National Football League told him to eff off. Meaning they all told his propagandists at Sinclair to eff off. Kimmel then shoving him in a locker using only a monologue. Kimmel getting a record 6 million viewers and 22 more online in the first TWENTY hours. Kimmel and his show getting new life and maybe a new contract. His self-owning confession that HE and his goons used threats to get Kimmel cancelled. The fact that Kimmel, and ABC, and Bob Iger, and Disney, and America told Trump to SHOVE HIS THREATS. And that’s just since Sunday night. You lost to an escalator. Resign. Take Vance with you. Take Noem with you. Take Ho-man with you. Take Milei with you. LEAVE the Epstein Files. B-Block (32:53) THE WORST PERSONS IN THE WORLD: Jason Whitlock says eff everybody, this is Christ-land and he won't be brainwashed any more (no brain, no pain). Derrick Van Orden says Kirk was Jesus and you don't F with the Jesus so defund The Mayo Clinic (he should go there and get CT scanned) and Kristi Noem says a tweet saying she'd have a bad day was terrifying for her. Affording Your Life with Attorney General Keith Ellison

Today I want to speak about Noem v. Vasquez Perdomo — a Supreme Court ruling that affects not just law, but who we are as a nation — and especially about one justice's dissent that stands as a moral compass in the storm. The Ruling: What HappenedIn Noem v. Vasquez Perdomo, the Supreme Court's conservative majority stayed an injunction that had barred ICE in Los Angeles from arrests based solely on factors like race or ethnicity, speaking Spanish or accented English, being found in certain locations, or working certain types of low-wage jobs. The district court had found that ICE was relying on those four factors alone in many cases, which the Fourth Amendment forbids. The Supreme Court permitted the government to resume those kinds of detentions under that standard, even though no detailed majority opinion was published. The public only knows who is responsible, and the full force of what's allowed now, because of Justice Sonia Sotomayor's dissent.Justice Sotomayor: Her Wisdom and Her WordsJustice Sotomayor's dissent is not just a legal disagreement. It is an act of truth-telling. She writes:“We should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job.” These words cut to the heart of what is at stake. They force us to acknowledge that policy, when unrestrained, can touch innocent lives in ways that tear at the fabric of justice. She continues:“Rather than stand idly by while our constitutional freedoms are lost, I dissent.” In those few words, she reminds us that rights do not defend themselves. They depend on someone speaking up even when the cost is high, even when the majority is quiet. Why Her Dissent Matters* Naming the harm: Justice Sotomayor does more than identify legal error. She names the human toll — people seized because of their appearance, language, type of work. She calls out the injustice by telling us plainly: “looks Latino … speaks Spanish.” Those are not abstractions, but people's lives.* Moral clarity: The phrase “while our constitutional freedoms are lost” is chilling because it suggests we are already losing them — or letting them slip away. She doesn't wait for them to go; she challenges us not to.* Courage in dissent: In the face of a decision made without full court procedure—without argument, without a signed majority opinion—she stands alone (joined by Justices Kagan and Jackson) to preserve the idea that constitutional protections mean something. She does not allow the marginalized to be erased by silence or ambiguity.Lessons & Charge for UsWe learn from her that:* Words have power, especially when spoken in courage. Her dissent is more than dissent — it is a warning. It is a mirror for what America promises to be.* Constitutional rights depend on vigilance. The language of the law is fragile if those sworn to uphold it remain silent.* Each generation must defend justice. Her dissent is an invitation: not to be mere spectators, but participants. To ensure that rights aren't conditional on language, race, or job, but universal. Conclusion: Her Voice, Our ResponsibilityJustice Sotomayor has raised her voice in this case with precision, force, and conviction. Her words—“We should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job” — will echo long after this ruling unless we do more than remember them.As she says, “Rather than stand idly by while our constitutional freedoms are lost, I dissent.” Let us not stand idly by. Let us take her dissent as our rallying cry. To speak, to organize, to defend what should never have to be defended: equal justice under the law.Thank you. This is a public episode. OA1189 - The Supreme Court's next term may not start until October, but their infamous shadow--sorry, “interim”--docket is in rare form as they issue snap decisions on everything from exactly where one 14-year-old boy can pee to just how openly racist ICE gets to be. Matt and Jenessa review which major precedents the conservative majority is ignoring to enable Trump's worst policies this week before getting on to some Epstein-related legal updates and a radical new development from the Board of Immigration Appeals with massive implications for Trump's mass deportation plans.  Finally, Matt drops a footnote to address one of our nation's least pressing legal questions: is it really true that a wedding in Kentucky can be legally officiated by a dead bear once described as “filled to the brim with cocaine”? See omnystudio.com/listener for privacy information.

Join Jim and Greg for the Monday 3 Martini Lunch as they spotlight three major media stories—from CBS changing its interview editing policy, to reporters downplaying violent crime for political reasons, to a bizarre demand from a disgraced Boston politician.First, they welcome a new CBS News practice to allow interviews to air unedited on Face the Nation after Homeland Security Secretary Kristi Noem ripped CBS for gutting her answers in a recent appearance. Jim and Greg also note that mainstream media editing controversies always seem to benefit the left.Next, they scold Marc Caputo of Axios for fretting about "MAGA influencers drawing repeated attention  to violent attacks to elevate the issue of urban crime — and accuse mainstream media of under-covering shocking cases." It's all connected to the mainstream media's silence over the grisly, unnecessary murder of a female Ukrainian refugee in Charlotte by a guy who had been arrested many times for violent crimes. Is the biggest problem calling attention to the murder...or is it maybe the murder itself? Finally, Jim and Greg are stunned by a former member of the Boston City Council who was sentenced to prison for fraud. It's not even the crimes that surprise them but the member's insistence that media stop talking about her and her crimes because she is an introvert and it hurts her feelings. Please visit our great sponsors:Support your health with Dose Daily.  Save 25% on your first month when you subscribe at https://DoseDaily.co/3ML or enter code 3ML at checkout. Find the right support that's right for you with BetterHelp. Department of Homeland Security Secretary Krisi Noem joined the Guy Benson Show today to discuss a bevy of topics on the news of the day. Sec. Noem first reacted to D.C. Mayor Bowser's apparent change in attitude as she reflected positively on the increased police and military presence in the district that has lead to a sharp decrease in crime. Sec. Noem also reacted to other blue state politicians and their respective responses to violent crime in their cities, and she also detailed a new "task force" that she is sending to Chicago. Sec Noem also discussed Kilmar Abrego Garcia, her response to complaints from FEMA, and MORE! Listen to the full interview below. Learn more about your ad choices. Visit podcastchoices.com/adchoices

Despite his deep delusions to the contrary, Donald Trump turning Washington, D.C. into a police state is making life and business in the District worse, thanks in large part to the team of bad faith bunglers Trump has assembled to carry out his will. While Trump's acolytes appear eager to help him weaponize the DOJ and law enforcement against his political enemies, their incompetence mostly yields embarrassment. The best possibility for a consistent ceasefire in Ukraine is if a coalition of outside countries deploy a NATO-like force to enforce it, argues former U.S. ambassador to Ukraine William Taylor. Texas State Rep. Nicole Collier is essentially imprisoned in the State Capitol because she won't agree to being monitored by police, so they won't unlock the doors to allow her to leave. Oklahoma's MAGA superintendent of public schools is working hard to make his state the most poorly educated in the nation by prioritizing right-wing ideological standards instead of fact-based scholastics. And Homeland Security Secretary Kristi Noem is probably wishing her spokesperson didn't invoke the church when offering a retort about Noem mooching a free apartment from the Coast Guard.

OA1180 - We begin with some much-needed reminders that good things are still happening and the rule of law is still (mostly) holding on before turning to a recent Trump executive order on homelessness which reads like something out of a (not very good) Batman movie. Jenessa explains how this development fits into the history of long-term institutionalization of vulnerable and unhoused people in the US as we work through what this thing is actually trying to do. In an unfortunately not-at-all-unrelated story, Matt then breaks down the situation with Florida's “Alligator Alcatraz” (aka “Gator Gitmo”), the pending challenges to this completely new (and totally illegal) approach to state-based immigration detention, and where this is all going. Finally, in today's footnote: has ChatGPT finally made its first hallucinatory appearance in a judicial opinion? We investigate not just one but two recent instances of federal judges who have now joined the many lawyers caught using AI to do their homework. “Ending Crime and Disorder on America's Streets,” The White House (7/25/25) Complaint in Friends of the Everglades v.
