This Day in Legal History: Terry Nichols ConvictedOn December 23, 1997, Terry Nichols was convicted of conspiracy to use a weapon of mass destruction and eight counts of involuntary manslaughter in connection with the 1995 Oklahoma City bombing. This devastating attack, orchestrated with Timothy McVeigh, targeted the Alfred P. Murrah Federal Building, killing 168 people and injuring hundreds more. The bombing was the deadliest act of domestic terrorism in U.S. history at the time. Nichols, who played a critical role in the attack by helping McVeigh acquire and prepare the bomb materials, was sentenced to life in prison without parole. McVeigh, the primary perpetrator, had already been convicted earlier that year on June 2 and was sentenced to death. Nichols' trial, however, focused more on his involvement as an accomplice, leading to a conviction that avoided the death penalty. The two trials revealed the intricacies of their plot, rooted in anti-government ideologies and resentment over events such as the Waco siege and Ruby Ridge standoff. The workers, who won a $148 million defamation judgment against Giuliani, claim he has ignored court orders to produce financial documents, risking further legal consequences. Giuliani denied deliberately withholding information, stating in a declaration that any missing documents were not intentionally concealed.The upcoming January 16 trial will determine whether Giuliani's Palm Beach condo and other assets, including three World Series rings, can be seized to satisfy the judgment. Giuliani, who filed for bankruptcy in 2023 after the defamation ruling, lost significant assets, including his Manhattan apartment and a Mercedes-Benz, due to his ongoing financial troubles. Welcome to EO Radio Show—Your Nonprofit Legal Resource. I'm Cynthia Rowland, and today's episode introduces several critical compliance topics relevant to international grantmaking by U.S. public charities and private foundations. These are the antiterrorism rules, income tax withholding rules, and special rules for private foundations. These "basics" episodes touch on the rules for U.S. charitable organizations that make grants to organizations or individuals not resident in the United States. Grantmakers need to be aware of a couple of general requirements, and private foundations also have an extra set of concerns to ensure that the expenditure outside the United States is not penalized as a taxable expenditure. The private foundation grantmakers also want to be sure that the expenditure does count towards its minimum distribution requirement. I'll start this series with an episode focused on introducing the Patriot Act rules that apply to all grants, international and domestic. In the next episode of this series, I'll provide a brief overview of the income tax withholding rules that apply to payments for services that come into play when making a grant to an international organization that may provide some services in the United States. The third installment of this series will focus specifically on the special private foundation rules, expenditure responsibility, equivalency determination, and other techniques used by private foundations that make grants to international organizations. Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Jones v Hendrix. In this case, the court considered this issue: May a federal inmate who did not challenge their conviction on the ground that the statute did not criminalize their activity subsequently apply for habeas relief after the Supreme Court retroactively invalidates the circuit precedent on which the inmate relied in not challenging their conviction? The case was decided on June 22, 2023. The Supreme Court held that Section 2255(e) does not allow a prisoner asserting an intervening change in interpretation of a criminal statute to circumvent the Antiterrorism and Effective Death Penalty Act of 1996's (AEDPA) restrictions on second or successive §2255 motions by filing a §2241 habeas petition. Justice Clarence Thomas authored the 6-3 majority opinion of the Court. The majority first clarified the relationship between §2255 and §2241 in the context of federal prisoners challenging their sentences. Congress introduced §2255 to allow prisoners to challenge their sentences in the sentencing court, rather than through a habeas corpus petition under §2241. While the saving clause in §2255(e) preserved access to §2241 in specific situations, the Antiterrorism and Effective Death Penalty Act (AEDPA) added restrictions on second or successive §2255 motions. The saving clause does not permit prisoners to circumvent AEDPA's restrictions, even if they are challenging a new interpretation of a criminal statute. The majority found unpersuasive arguments by both Jones and the federal government regarding when §2255 might be considered “inadequate or ineffective,” thus allowing recourse to §2241. AEDPA's restrictions reflect Congress's deliberate choice to balance finality with error correction in the justice system. Justices Sonia Sotomayor and Elena Kagan jointly dissented, arguing that Jones presents the precise type of mismatch contemplated in §2255(h) and would those remand for the lower courts to consider his claim under the proper framework. Justice Ketanji Brown Jackson authored a dissenting opinion arguing that §2255 requires that Jones's petition alleging legal innocence should have been considered on the merits. Michael Sugrue began his law enforcement career in the United States Air Force as a Security Forces Officer in 1998. As a Security Forces Officer, Michael specialized in Law Enforcement, Global Force Protection, Anti-Terrorism, Nuclear Security, Foreign Air Field Assessments and Air Base Ground Defense. Michael served in a variety of assignments, including Flight Leader, Flight Commander, Senior Watch Officer, Chief of Command Post, and Chief of Security Forces.Michael served all over the United States, Europe, the Middle East, and South America. He was also a Security Forces Phoenix Raven with the unique identifier of #1173. Michael honorably separated from the Air Force as a Captain in 2004.Immediately after the Air Force, Michael was hired by the Walnut Creek Police Department, where he served in a variety of assignments including Patrol Officer, Driver Training Instructor (EVOC), Field Training Officer (FTO), SIU Detective, Undercover CA DOJ Narcotic Task Force Agent (Contra Costa County), Public Information Officer (PIO) and Patrol Sergeant. Michael was awarded the Walnut Creek PD Distinguished Service Medal in 2014 for his heroic and life-saving actions during a Fatal Officer Involved Shooting in 2012. Michael ultimately medically retired in 2018. He is now a Peer Volunteer at the West Coast Post Trauma Retreat (WCPR) and an Ambassador for Save A Warrior (SAW). Michael is a dedicated advocate for awareness, prevention, education, and training on Post Traumatic Stress Injury (PTSI) and First Responder Suicide Prevention. Wegter admits that more needs to be done to tackle what he calls "borderline content" online that might be inciting hatred and fuelling individuals' radicalisation. This horrifying experience, along with unresolved childhood trauma, led him down a downward spiral. This ultimately led to him leaving law enforcement behind. However, Michael forged a new path championing the vital need for 1st responder mental health treatment. Michael Sugrue began his law enforcement career as a Security Forces Officer in the United States Air Force in 1998. As a Security Forces Officer, Michael specialized in Law Enforcement, Global Force Protection, Anti-Terrorism, Nuclear Security, Foreign Air Field Assessments, and Air Base Ground Defense. Michael served in various assignments, including Flight Leader, Flight Commander, Senior Watch Officer, Chief of Command Post, and Chief of Security Forces.Michael served all over the United States, Europe, the Middle East, and South America. He was also a Security Forces Phoenix Raven with the unique identifier #1173. Michael honorably separated from the Air Force as a Captain in 2004.Immediately after the Air Force, Michael was hired by the Walnut Creek Police Department, where he served in a variety of assignments, including Patrol Officer, Driver Training Instructor (EVOC), Field Training Officer (FTO), SIU Detective, Undercover CA DOJ Narcotic Task Force Agent (Contra Costa County), Public Information Officer (PIO) and Patrol Sergeant. Michael was awarded the Walnut Creek PD Distinguished Service Medal in 2014 for his heroic and life-saving actions during a Fatal Officer Involved Shooting in 2012. Michael ultimately medically retired in 2018. He is now a Peer Volunteer at the West Coast Post Trauma Retreat (WCPR) and an Ambassador for Save A Warrior (SAW). In the early morning of March 24, 1994, 20-year-old Kenneth Hayes was getting out of his car when someone emerged from the bushes, chased him down, and fatally shot him in front of his home in Detroit, MI. 18-year-old Larry Smith Jr. became a suspect when a car belonging to a friend of his was spotted near the scene of the crime. Since there was no physical evidence tying Larry to the crime, authorities relied on junk science and questionable eyewitness testimony to convict him of the murder and sentence him to life in prison without parole. The Boston City Council this week turned down a $ 13.3 million dollar grant from the Federal Department of Homeland Security in anti-terrorism funds. The tie vote (6 to 6) followed comments by Mayor Wu, who said the grant would “…help prevent, respond to and recover from threats or acts of terrorism, including chemical, biological, radiological, nuclear and explosive incidents”. Boston City Council President Ed Flynn, who voted for the grant, weighs in .
