Last week, the Supreme Court ruled on several issues related to immigration policy. While the court narrowly preserved birthright citizenship, it issued other rulings that will put an untold number of people in danger. One ruling, Mullin v Al Otro Lado, upheld the federal government's policy of turning back asylum seekers before they can reach the US-Mexico border—a policy also known as “metering”—hollowing out the right to asylum enshrined in both domestic and international law. In her dissent, Justice Sonia Sotomayor referenced the St. Louis, the ship of Jewish refugees from Nazi Germany turned away from the US, whose passengers were mostly killed in the Holocaust: “Congress passed the Refugee Act in 1980 because it did not want this country to repeat the mistakes of its past. Yet if the refugees on the M. S. St. Louis were to walk up to a port of entry on our southern border today, the majority's interpretation would allow immigration officers to refuse even to consider their asylum applications by physically blocking them from stepping foot onto US soil,” she said.In another ruling, Mullin v Doe, the Supreme Court granted the president the power to end the Temporary Protected Status program, or TPS, which has allowed vetted and eligible immigrants to live and work legally in the US if they cannot return safely to their countries. Justice Samuel Alito, in his majority opinion, said courts do not have a say in what the president and the Department of Homeland Security decide; the president can end TPS for Haitians and Syrians without judicial review. He also rejected a separate claim brought by Haitians that the move to deport them was based in racial prejudice. TPS has been in effect since 1990. There are 350,000 Haitians who have been in the US legally under TPS, and whose lives have now been thrown into chaos.In our spring issue, we published a prescient piece by immigration reporter Tanvi Misra about the death of asylum, and the ways that its decline is a dire portent for democracy itself. Asylum, Misra reminds us, is a “place-based right” designed to prioritize human life over national borders: As soon as an endangered person steps foot onto a country's soil, they “are entitled to that body's protection,” regardless of whether they crossed with permission. This is exactly the principle that has been undermined with this recent ruling, which prevents people from arriving and making an application. As this ruling suggests, for as long as asylum has existed in the US, so have efforts to weaken it. It has been issued selectively and on racial grounds—much more easily been granted to German-speaking Protestants than to Jews escaping the Holocaust; readily offered to Cubans fleeing Castro but not to Haitians fleeing the US-supported Duvalier dictatorship.Misra's essay tells us that this tactic of denying landfall to migrants as a way of denying them asylum has gone into overdrive in the past decades as border agents try to intercept asylum seekers earlier and earlier in their journeys. In the process, the US border has, Misra says, “not just hardened, but expanded”—into Mexico, Guatemala, Panama, and beyond. Under Trump 2.0, the border has also spilled inward, into LA, Chicago, Minneapolis, and all the other places where border agents are chasing down asylum seekers and, increasingly, all migrants.In this episode of On the Nose, recorded in mid-June before the Supreme Court rulings, Misra speaks about these grievous attacks on asylum with John Washington, a staff reporter at Lookout and the author of the forthcoming book, How to Close a Camp: Dispatches from the Fight Against Immigrant Detention, as well as The Case for Open Borders and The Dispossessed: A Story of Asylum at the US-Mexico Border.This conversation was originally a live membership event. In this episode of the WOLA Podcast, recorded on June 25, 2026, host Adam Isacson speaks with Elijah Maurus, an attorney based in Tijuana who has worked principally with LGBTQ+ asylum seekers since 2018. Maurus relocated to Tijuana during the major migrant caravan that arrived in late 2018, initially working with Al Otro Lado before launching a pilot legal project dedicated to LGBT asylum seekers in October 2019. The conversation moves roughly south to north, tracing the dangers LGBTQ+ migrants face crossing Mexico to reach safety in the United States. Maurus describes how Tijuana—which requires a difficult "left turn" across territory controlled by multiple cartels—nonetheless became one of the few border cities with dedicated LGBT shelters, though these remain scarce and small. He explains how vulnerabilities multiply "exponentially" for transgender and gender-nonconforming migrants at every checkpoint, river crossing, and cartel-controlled bus stop. He recounts witnessing the human toll of policies like "metering," the Migrant Protection Protocols (Remain in Mexico), Title 42, and the cancellation of CBP One appointments. The second half of the discussion turns to the rapid deterioration of asylum protections in the United States since President Trump's return to office in January 2025. Maurus details both the headline-grabbing measures—the suspension of asylum at the border, Supreme Court decisions issued that very morning upholding metering and allowing the removal of Temporary Protected Status from roughly 350,000 Haitians—and the quieter "death by a thousand cuts." These include courthouse arrests after government attorneys move to dismiss cases, the use of "pretermission" to reject incomplete asylum applications, Asylum Cooperative Agreements that ship asylum seekers to third countries like Guatemala or Ecuador, and the gutting of the immigration court system through mass firings of judges and their replacement with "deportation judges." Maurus devotes significant attention to immigration detention, which he calls a political and financial choice rather than a punishment. With $45 billion newly allocated and a goal of detaining 100,000 people per day in largely private facilities, he describes the elimination of the limited protections for transgender detainees that had existed under prior administrations—including the end of gender-affirming care, the housing of trans women among men, prolonged solitary confinement for trans men, and the disappearance of oversight mechanisms. He also raises the alarming practice of sending people with withholding-of-removal protections to dangerous third countries such as Eswatini or Uganda, where LGBTQ+ people face legal persecution. Despite the bleak picture, Maurus closes on a note of resolve. He argues that asylum remains salvageable but that advocates must stop ceding the narrative and avoid treating individual horror stories as isolated anecdotes rather than the products of deliberate policy. He emphasizes the importance of local-level storytelling, documentation for future accountability, and the simple insistence that turning people away violates the lessons learned after refugees were turned back to die during World War II.
On Thursday, the Supreme Court issued two decisions on U.S. immigration policy. In the first case, Mullin v. Al Otro Lado, the Court ruled 6–3 that the federal government can turn back asylum seekers before they cross into the United States. In the second, Mullin v. While at Scotland Correctional Institution, Shine was helping organize political education among prisoners and speaking out about conditions and serious medical concerns inside the facility. As many already know, he had a contraband cell phone. According to Shine, that phone contained recordings and information documenting conditions inside Scotland, including prisoners begging for medical attention. Not long after, Shine and others around him were transferred and separated across different facilities. In mid-April, Shine was transferred overnight from Scotland to Granville Correctional Institution in what he described as one of the fastest transfers he had seen in 17 years of incarceration. Upon arrival, he was immediately placed on HCON (High Security Maximum Control). Shine maintains the placement was arbitrary, requested a grievance regarding that placement, and to our knowledge has yet to receive a meaningful opportunity to challenge it. He has been on hunger strike ever since. Over the past few weeks, many of you participated in Calls to Action, making phone calls and sending emails seeking answers about his health, communication, property, grievances, and HCON status. Those efforts led to direct conversations with Assistant Regional Director Timothy Jones, who assured us that concerns were being reviewed and investigated. Here's the problem. We have now confirmed through official records that Shine was already housed at Central Prison on the same date we were being given information that appeared to place him at Granville. We still don't know whether that means the Regional Office had outdated information, didn't know where he was, or something else entirely. What we do know is that the answers we were given don't line up with the timeline we can now verify. At this point, we have no direct communication with Shine. Updates are coming through fellow comrades who have been able to get word out through prison channels. What we know right now: Shine remains on HCON. Shine remains on hunger strike. Shine is housed in Central Prison's medical unit. Communication remains extremely limited. Questions about his mail, property, grievances, and classification remain unanswered. The transfer changed the address. It did not answer the questions. This week we are launching another Call to Action. Supporters will once again be contacting Central Prison, the Regional Office, and NC DAC leadership seeking answers and accountability. If Shine's status remains unchanged and these concerns continue to be ignored, we are preparing for an in-person demonstration later this week. If the goal was to make people stop paying attention, it didn't work.
