Tarun, Mike, and Holly are joined by Maddie Salamone to dive into the latest in the NIL world. Welcome to THE Sports Law Podcast! We keep you informed on everything at the intersection of sports and the law. The world of Name, Image, and Likeness keeps moving forward as Tarun (@tksharmalaw), Mike (@Mike_sonof_Law), and Holly (@SlamDunkSummers) are joined by Maddie Salamone (@madsal15) who is a former DI SAAC chair and currently on the board of the College Football Players Association. Federal Judge denies Brandr's motion for temporary restraining order against EA Sports. (2:06) Many believed that Brandr had an uphill battle with this suit, but this was the tipping point in favor of EA Sports that may show how the rest of this lawsuit will proceed. Maddie gives insight into the future of athletes' involvement with video games and licensing deals. Maddie also believes that this lawsuit at the very least shined a light onto what EA Sports was doing and preventing them from taking advantage of athletes' NIL rights. Maddie is a former Division I SAAC chair and gives insight into the letter that SAAC sent to congress a few weeks ago. (18:18) As we discussed on that episode, the letter was very NCAA favored and was out of the realm of what SAAC advocates for and focuses on. San Diego State University is leaving the Mountain West Conference; maybe. (26:13) SDSU was required to provide a one-year notice to the MWC if they were planning to exit the conference. The deadline was June 30, 2023. There were six letters that were sent back and forth between SDSU and the MWC in which it appeared that SDSU was going to be leaving the conference. However, the sixth and final letter was sent at 11 p.m. on June 30 stating that SDSU was not leaving the conference and that was their final decision. However, the MWC stated that SDSU had already provided their notice for withdrawal from the conference. With the exit comes a $17M exit fee due by July 1, 2024, when they officially leave the conference. The MWC also stated that they would be keeping the $6.6M revenue sharing check that was due to SDSU, as a first payment of the $17M exit fee. The next MWC meeting is July 17 and SDSU will not be able to attend. A decision on SDSU future in the conference will most likely be made at that meeting. NYS Governor Hochul has signed the NIL bill amendment into law. (35:03) NYS joins Texas, Arkansas, and others in passing an NIL law that protects state schools from NCAA or Conference punishment for being involved in NIL deal, i.e., facilitating and working with collectives and boosters. This comes on the heels of the NCAA submitting a memo regarding schools needing the follow NCAA bylaws and not state laws. Maddie gives insight into the future of NIL and schools' involvement and where it goes from here. *** Have a topic you want to write about? ANYONE and EVERYONE can publish for ConductDetrimental.com. Welcome to THE Sports Law Podcast! We keep you informed on everything at the intersection of sports and the law. The world of Name, Image, and Likeness keeps moving forward as Tarun (@tksharmalaw), Mike (@Mike_sonof_Law), and Holly (@SlamDunkSummers) break down the latest updates in NIL. Amanda Christovich (@achristovichh) from Front Office Sports joins us! The NCAA Student Athlete Advisory Committee ("SAAC") sent letters to Congress advocating for federal NIL. (2:19) Amanda joins to discuss her latest article on Front Office Sports about the letters sent from all three divisions. The D1 SAAC letter was the only one not signed by all members of SAAC, being signed only by the D1 Chair. Amanda's discusses that these letters were clearly written or edited by the NCAA before being sent and published because all of the points were favorable to the NCAA, like no employee status and an antitrust exemption. You can read Amanda's article here. The IRS Chief Counsel sent a memo regarding NIL Collectives and their tax-exempt status. (24:40) This memo, which is not precedent or binding, is a warning to all collectives who provide tax-deductible donations to student athletes, as they are "not incidental both qualitatively and quantitatively to any exempt purpose." Many of these collectives have already been granted 501(c)(3) tax exemption status, but this memo states that the IRS will be monitoring their activities to make sure that there are no direct benefits being made for private interests. This memo is a blanket warning to all NIL Collectives seeking tax exempt status or those who are currently tax exempt. Baby Gronk has been making waves on social media. (38:33) Madden "Baby Gronk" is currently a 4th grader and has been touring the country to many schools as a prospective football athlete. The issue many are taking with this is that he is being controlled by his father and many are saying Baby Gronk's father is "clout chasing" his son for NIL. *** Have a topic you want to write about? You have most likely heard the last name “Rane” come up in some sort of rowing dialogue. After the podcast with the New Trier Boys, I felt it was only right to have twins Rachel Rane & Jonah Rane, NTRC ‘19 coxswains, along with their older sister, Eden Rane, NTRC ‘17 coxswain, to discuss how their family comprised of 80% coxswains, manage to be some of the most elite and well-respected boat drivers in the nation. The family chats about the true competitive culture that they were raised in, how they go about breaking records, making history, and so much more. The love that they all share for the sport is truly unmatched. Rachel is the Varsity 8+ coxswain for the University of Texas, having been a two-time consecutive NCAA National Champion for 2021 & 2022, while also striking Gold in the Women's 8+ at the 2022 Under-23 World Rowing Championships in Italy this past summer. She is also ranked as a CRCA & Big-12 First Team All-American. Jonah coxes for the Badgers at the University of Wisconsin on the Men's Rowing team, where he competed at and won the 2022 Royal Canadian Henley, while continuing to impact the squad on a positive note. The eldest sibling, Eden Rane, coxed the Women's Lightweight Rowing Team at the University of Wisconsin, graduating in 2021, being the president of SAAC, a large role representing student-athletes. Their mother, Michelle, also coxes Masters Rowing and is probably one of the most supportive parents (along with their father Mike) in the rowing game. Tune into one of those episodes, that will make you want to get out there and just be straight “dawgs”. The passion and ambition that this family has for the 9th seat position is truly out of this world!

Sean co-founded the Axel Group in August of 2017 with his childhood friend turned business partner, Len Forsyth. Six years prior, Sean was a rising star at one of the top global recruiting and staffing agencies. During his tenure there, he was promoted from recruiting trainee to recruiter, then ultimately to account manager. His ascent was not surprising. Sean won multiple sales contests, promoted multiple direct reports, and facilitated recruitment and sales training for the local, regional and corporate offices. Though Sean has won multiple individual achievement awards -- including being named to NJBIZ's acclaimed 40 under 40 list -- the accomplishment he's most proud of was when the group he was leading won “Team of the Year”. But Sean has always been a team player - even as far back as college where he was a member of the Rutgers wrestling team. Humble brag alert: not only did the team finish Number 22 and Number 9 in the USA Today Coaches poll, Sean was the wrestling representative on the SAAC and was the athletic representative on the university-wide student government. Simply put, Sean has been leading since before he stepped foot into the working world. When Sean isn't working or spending time with his family, he spends his free time volunteering and giving back to the community. Sean now coaches wrestling at Shore Regional High School and mentors kids to prepare them for college athletics and life-beyond. He also volunteers his time coaching the local youth program, and for 10 years from 2009-2019, was the voice of Rutgers Wrestling serving as a color commentator through Rutgers Athletics' internet television network having called matches that have been aired on the Big Ten Network, BTN2GO, FLOwrestling, and Fox College Sports. Sean has been married to his high-school sweetheart Molly since 2014. They live in Tinton Falls, NJ where they are raising two children, Axel and Lola — who despite their tender ages, are excelling at their daily mat drills.

During this episode, we discuss our time at the NCAA Convention. This was a historical meeting as the new NCAA Constitution was officially adopted during this convention. The new constitution contains language that supports student athletes' ability to profit from their name, image, and likeness. We are joined by our producer, Anthony Palmer, from Palm Tree Pod Co.During the convention, members were allowed to voice their opinions about the new constitution. Dr. Bill Fierfelder, President of Belmont Abbey College, voiced concern that the new constitution was rushed. Mads McKenna, a member of SAAC, expressed her support for the new constitution and added that she was pleased with the fact that student-athletes could now profit from their NIL. Betsy Mitchell, Athletic Director of Cal Tech, expressed her opposition to the new constitution and stated that the new constitution was revised to benefit a few members, rather than the majority of institution members. We interviewed a few amazing guests. We spoke with Keith Lowe from DV Sport about the POV of a parent of a student-athlete trying to navigate the NIL era. We sat down with Harrison Larner, a junior at Northwestern University and co-founder of 8 In The Box Productions, to discuss how student-athletes can promote themselves using visual media. We also spoke with Sylvia Cortes, a student-athlete from the University of Alabama at Huntsville and member of SAAC. She provided updates on SAAC and also the new NCAA Constitution. Our final guest was Andrew Trimble CEO of Kairos, a scheduling and communications platform. We discussed the demanding and ever-changing schedules of student-athletes.Wheeler also expressed his love of Subito sandwiches. We discuss our favorite recent nillies, including FSU women's soccer's apparel line, Notre Dame football's deal with Ikonic, and Raising Cane's proposed deal with Adonis Arms.
