The Arizona Corporation Commission's Securities Division released a warning to investors this month about self-directed IRAs, and it's something that we immediately read through and processed.   In this episode, we're going to give you the details in the alert and help you better understand what you need to be aware of. If this is an account you have or are thinking about opening, then you want to have all the information available to help you make the best decisions possible.   The self-directed IRA isn't like a regular IRA. This product allows you to store other types of assets like real estate, promissory notes, precious metals, and other investments. When you're dealing with this type of IRA, you increase the possibility of something not being legitimate and you incur additional risk beyond normal IRA investing.   The alert, which you can read here, makes points out a handful of risks you need to be aware of:   You are solely responsible for evaluating and understanding the investments. There will be a lack of information and liquidity in these IRAs. These are considered high-risk investment options. This might be a fertile ground for fraud. There are complex tax rules that you need to know about.   Join us as we break down this alert for Arizonans and provide an update on the latest inflation and monetary policies.   Here's some of what you'll learn in this episode:  Nancy's feeling about all the monetary spending and inflation policies happening in Arizona. (3:21) What concerns Nancy most with the recent inflation reports. Court Rich, an attorney representing solar developers and others before the Arizona Corporation Commission, recounts how the state's 20-year-old law promoting retail competition in electricity was thwarted for years by the state's utilities and then, recently, ultimately repealed after an army of more than a hundred lobbyists descended on the Legislature. The bill, through some sleight-of-hand rewriting of the governing statute, was then touted by the utilities as being a consumer-protection law, in what he calls an exercise of "pure political power from the monopolies." Interestingly, he says public exposure of  Dark Money groups and the utilities' influence at the Corporation Commission has actually led to a diminution of the industry's clout with individual state regulators. That has "handcuffed them a little bit," Rich says. But the recent legislative battle, in which lawmakers ordinarily supportive of those in a diverse coalition opposing the bill changed their votes in the face of intense lobbying from utilities, shows utilities' influence with lawmakers, while somewhat diminished, was still ultimately effective.Support the show

The Arizona Corporation Commission is known as the fourth part of the Arizona government.  It is the agency that deals with corporations as well as utility rates. Bill Mundell, one of the candidates for the Arizona Corporation Commission, is interviewed about what he would do as a Commissioner. In addition, Vivian Harte, a member of the League of Women Voters of Greater Tucson, describes the many ways you can research candidates to decide which ones to vote for. Make sure you VOTE! It is crucial in this election of November 3, 2020!! We invited all Arizona Corporation Commission Candidates for interviews. Only Mr. Mundell and two other candidates responded. Lea Márquez Peterson and Shea Stanfield were interviewed in a previous episode of this series. KXCI Community Radio is pleased to partner with The League of Women Voters of Greater Tucson to provide a series of shows called Your Arizona Voting Guide leading up to the general election on November 3rd. This weekly half-hour series will air at 3:30 p.m. on Sundays beginning August 16th. During any election season, we always can count on a bombardment of political ads that tell us all the wonderful things every candidate has done and everything that’s wrong with their opponent. In addition, all too often, political consultants advise their candidates not to accept invitations to participate in public forums with their opponents to lessen the chance they’ll say something off-script. That results in very limited opportunities to hear directly from candidates and limits voter access to information about candidates and their positions on issues to scripted ads and sound bites. During the lead up to the November 3rd General Election, the League of Women Voters of Greater Tucson is interviewing candidates for the Arizona Corporation Commission, which is a State of Arizona office. In addition, the League will interview candidates running for Pima County offices: Sheriff, Recorder, and Treasurer. League member, Vivian Harte, serves as host of the program. To aid voters in making informed decisions at the polls, candidates for each respective position are being asked the same questions. KXCI 91.3 FM Community Radio is partnering with the League to air these interviews with the community. In addition, members of the League will be interviewed about various topics, including what to know about registering to vote in Pima County, ballot propositions, getting out the vote during the COVID-19 pandemic, speeches offered by the League, and League activities promoting diversity, equity, and inclusion. Redistricting is something we do every 10 years, based on the Census. In many states, the state legislature determines the district lines for both the United States Congress and the state legislature. This has resulted in legislators drawing lines that benefit themselves and making the districts less competitive. In Arizona, the Independent Redistricting Commission is empowered to make more neutral decisions. Created by citizen initiative, the Independent Redistricting Commission operated in 2001 and 2011. Its third round will begin in 2021. Kathy Aros, President of the League of Women Voters of Greater Tucson, discusses the importance of the Census in redistricting and the rate of completing the Census in Tucson, Arizona, and the country. Betty Bengtson, Chair of the Advocacy Committee, details how Commissioners are chosen and the process the Arizona Independent Redistricting Commission goes through in drawing the lines. We hope you have enjoyed the programs and become educated about the candidates and the voting process. Be sure to vote on November 3 or before! If you decided to open a new business that will be based in Arizona you can choose from several options: Sole Proprietorship: Sole owners of Arizona-based businesses could opt for sole proprietorship as the easiest form of business organization. Not the most recommended, given the liability a sole proprietor assumes as a result of owning a business. No registration with Arizona Corporation Commission is necessary, but it is recommended to register a trade name (DBA), and if you plan to hire employees then also obtain an EIN. Single Member LLC: Limited liability company, as the name suggests, is an entity that allows its owners to limit the liability of the business to the entity itself, shielding the owners' personal assets. This type of entity is recommended for most small businesses. By default your LLC will be taxed as "disregarded entity", meaning you will file your LLC tax return as part of your personal tax return. Keep in mind though - LLC is a flexible entity, which means you have the option of electing it to be taxed as S-Corp (assuming you are a U.S. person) or C-Corp. Learn more about LLC here, and about the details of forming LLC in Arizona here. Corporation: You can also form a corporation and be a sole shareholder with 100% of all shares. Corporations have more formalities than LLCs (for example in Arizona you are required to have bylaws and maintain minutes of meetings in corporate records), but provide similar limited liability protection. That's one of the reasons this entity type is often more suitable for bigger companies, or those who seek major investment. Corporations can be taxed as S-Corp or C-Corp, with each form of taxation having its pros and cons. Keep in mind, you can elect your corporation to be S-Corp only if you, as the sole shareholder, are a U.S. person. https://www.myusacorporation.eu/arizona.html MyUSACorporation is your reliable partner since 2009.

At this week’s Republican National Convention in Cleveland, the GOP doubled down on its commitment to coal -- calling it “an abundant, clean, affordable, reliable domestic energy resource.” Coal can get cleaned up. But it comes at a steep price. And that price can make it hard for even the most ardent supporters to get behind carbon capture and sequestration in practice. Earlier this month, the New York Times published an investigation on the Kemper Power plant, a carbon capture and sequestration project supported by the stimulus that is billions of dollars over budget and still not in service. Securities regulators are investigating the use of government funds, ratepayers in Mississippi are suing Southern Company, and now a whistleblower has released thousands of documents showing that Southern Company covered up its problems and lied about timelines. This is the latest blow to the clean coal industry – which detractors say will never materialize. This week, we'll talk about what Kemper means for the future of carbon capture and sequestration in the U.S. Later in the show, we'll provide some context to an FBI investigation into the 2014 Arizona Corporation Commission elections. And we'll end with a discussion about NextEra's failed bid to acquire Hawaiian Electric Industries.
