June 14, 2022 — The Board of Supervisors has closed its budget hearings and will formally ratify the final county budget on June 21. The total county budget is over $355.8 million, with an operating budget of over $29.6 million per month, according to documents attached to the June 7 agenda. Talk of closing the county museum was notably absent from the list of recommendations. Several organizations asked the board to consider funding them from the American Rescue Plan Act (ARPA), including Meghan Barber-Allende, the Executive Director of the Community Foundation, who asked for $300,000 for hunger relief and another $200,000 for non-profits that were unable to hold fundraisers during covid. “We can make a difference, and we can feed our communities, especially those that are extremely vulnerable,” she told the Board. “I think it's just very, very hard to think about how families and individuals and seniors are going to survive this, if we don't figure out how to provide some support.” Supervisor Ted Williams asked acting deputy CEO Sarah Pierce if it would be possible to fulfill the request. “As we go through these presentations, what would the funding source be?” he asked. “What is the pot of money we have to divide up? Because I can already tell you, I support all of these projects. How do we pay for it?” Pierce told him county staff was keeping track of requests for ARPA funding, but that they were following earlier Board direction to use the funds for county core services first. The health plan deficit, even with an infusion of $4.6 million from the ARPA funds, is projected to be over $3 million by the end of the calendar year. And cannabis tax projections are $1.5 million, down from $6.1 million last year. Supervisor Ted Williams was chagrined. “I see that we had $6.8 million that we didn't collect on cannabis,” he noted. “We're not going to collect that, aren't we?” Interim CEO Darcie Antle confirmed his assessment that, “that's just written off for this year.” Still, some petitioners were given some hope. Stephanie Garrabrant-Sierra, Mendocino County Resource Conservation District's new Executive Director, told the Board that, as a special district, her agency is “a government partner,” which is working to alleviate climate change. With the rising costs of gas and steel, she requested double the $45,000 the RCD typically receives. The Board directed her to Department of Transportation Director Howard Dashiell, to see if it's possible to provide more funding for the district under his allocation. Projected secure property tax for the next fiscal year is up to $41.8 million from $36.8 in May of this year, and projections for the transient occupancy tax are up to $8 million from $6.2 million actuals in May. Patrick Hickey, the field representative for SEIU Local 1021, insists that the budget is not as dire as presented. The county is currently in negotiations with all its labor unions. “Sales taxes are projected to be up by $700,000, transient occupancy taxes are projected to be up by $2 million, property taxes are projected to be up by $2 million as well,” he recited. “This doesn't sound like a county in trouble to me. But how well has the county done at projecting its revenues? Actually, they've underestimated Budget Unit 1000 every year.” This unit is for non-departmental revenue, derived primarily from property tax, sales tax, and ToT, or transient occupancy tax, also known as bed tax. The funds are usually used to make up the difference in expenditures and revenues by county departments that operate at a loss. Hickey went on to say that the county had underestimated Budget Unit 1000 by nearly $8 million in FY 2018/2019, $1.3 million in FY 2019/2020, and $9.4 million in FY 2020/2021. “I think you can see the pattern here,” he concluded. “The county is in the habit of overestimating expenses and underestimating revenues.” Antle provided some more information about the revenue projection, saying, “In the past, the revenue projection has come from the auditor-controller's office, and as you know, we had a change in that position this year. Those numbers weren't provided to us by the auditor-controller, so the fiscal team made the projection for this coming year of 2022/2023.” She added that the team had eventually received the report from the auditor-controller, but not until May 20, which wasn't timely enough for them to use it when the budget process started at the beginning of March. She told the Board that the only difference between revenue projections by the fiscal team and the auditor-controller is that “ours is $700,000 higher.” Hickey also suggested that the county stop budgeting for the nearly 400 positions that it can't fill, which he believes would free up money to pay more to existing staff. The Board agreed to a discussion with department heads to find out if they are still actively recruiting for positions that are funded, but which have been vacant for years. The Board also directed the auditor-controller to track where the cannabis tax that has been collected has gone. In 2016, county voters approved AI, a cannabis business tax of no more than ten percent of gross receipts for cultivation and distribution. The general tax measure was accompanied by AJ, an advisory measure that asked voters if they wanted a majority of the taxes generated by AI to be used for enforcement, mental health, county road repair, and fire and emergency medical services. The destination of the money has not been diligently tracked. AI was a general tax, which means it only needed a simple majority to pass, and the revenue it generated went into the general fund. Advisory measures are not legally binding. The budget also includes direction to the auditor-controller to encumber the unspent PG&E settlement money for its designated projects; and to create one new budget unit within the general fund with $320,000 in it for parks; and another to track grants for the Air Quality Management District. Acting auditor-controller Chamise Cubbison provided some analysis. She said she had given the CEO's fiscal team an updated projection using her own calculations, and had tried to have a conversation with them, but “I got the sense that they didn't want to change the projection, because that was what they had based the initial net county cost assignments on. So I understand that…I'm most frustrated by the fact that the auditor-controller budget is the budget unit that appears to be taking the largest hit, at least from the CEO adjustments. And there's been many references today to direct the auditor, direct the auditor, direct the auditor to do things. But I do need to point out the fact that the auditor-controller's budget unit cannot be underfunded to the tune of more than $340,000 and expect that I'm going to be successful and that my team is going to be successful. The auditor controller's office is a key part to the property tax and the ToT distribution and collections processes, along with the special districts…we do put on the tax roll and distribute over $160 million to the county, to the cities, to the special districts, and the schools. So under the new consolidated office, I really would hope that the Board would fully fund the auditor-controller's proposed budget, with the understanding that in order to be successful, we need to be fully staffed and we need to have the resources that I think are appropriate. So I would hope that the Board would consider possibly revising the ToT projection by enough to possibly cover the auditor-controller's budget, or direct the ARPA funds be allocated to bring positions up to pre-covid, or that that ARPA fund be used somewhere else in the county to free up additional general fund to help support the auditor's office budget.” Antle said part of the one-time $1.7 million of ARPA money that was set aside to bring up staffing to pre-covid levels could be used to fund Cubbison's office.

Democratic lawmakers in the US are considering changes that could benefit millions of undocumented immigrants. It's a shift from the Trump administration, which had been building a wall to keep-out people the former president described as 'rapists and murderers.' President Joe Biden says he wants to take a more humane approach, and it's resulted in a flood of migrants trying to cross the border. As Paolo Montecillo reports, it's sparked fierce Republican opposition to any major reforms. Our correspondent Kilmeny Duchardt has been following the situation at the US-Mexico border in Penitas, Texas and sent us a report. For more, we spoke to Sarah Pierce in Washington. She's a policy analyst at the Migration Policy Institute.

Schools need to create spaces where Indigenous students can be unapologetically Indigenous by building immersion units and hiring Indigenous teachers. As a result, Native students are often subjected to discrimination by white teachers and administrators, and suffer high disciplinary rates. Native students in South Dakota today have one of the lowest achievement rates, graduation rates, and even mobility rates. Though they add up to about 10% of South Dakota public school students, only 1.6% of staff is Indigenous. History Starting in 1868, Western education was imposed on Native Americans. Children were forcibly taken and put in boarding schools. Native elders refer to this now-abandoned practice as the "severing of the sacred loop." The goal was to "tolerate" or assimilate Indigenous students, removing them from their cultures and ways of life. Trauma has been the biggest repercussion of the boarding school movement, and the current education system has failed the Indigenous for generations. The inability of Congress to enact any meaningful legislation on immigration during the past quarter-century has left the United States with a long-outdated immigration system that works for very few, leaving the president with enormous influence and control over U.S. immigration policy. While President Obama’s decision to protect DREAMers via the Deferred Action for Childhood Arrivals (DACA) program was praised by some as an overdue action amid congressional stalemate, it also was the subject of major legal challenge and was criticized as presidential overreach. Well into its fourth year, the Trump administration has undertaken more than 400 executive actions on immigration. President Trump has been able to dramatically reshape the U.S. immigration system through regulatory, policy, and programmatic changes, and his executive actions have prompted extensive advocacy and litigation in response. Is executive action on immigration a recent development? And has it always been as controversial as it seems today? Two leading legal scholars, Adam B. Cox and Cristina M. Rodríguez, tackle this question in their book, The President and Immigration Law (Oxford University Press). In this webinar, these scholars join Elena Goldstein from the New York State Office of the Attorney General, and MPI's Muzaffar Chishti and Sarah Pierce for a discussion that examines the Trump administration’s substantial use of executive power to change the country’s course on immigration, and how the president’s role in immigration policy is a inevitability that should be carefully considered and reimagined in any blueprint for immigration reform or strategy for activism on immigration.

The Supreme Court ruled Thursday that immigrants denied asylum under streamlined proceedings cannot contest those decisions in court.The case involved a Sri Lankan farmer named Vijayakumar Thuraissigiam, a member of the Tamil ethnic minority, who said he feared persecution. The justices ruled in favor of the Trump administration in its appeal of a lower court ruling that Thuraissigiam had a right to have a judge review the government's handling of his asylum bid.The ruling, written by conservative Justice Samuel Alito, found that limiting judicial scrutiny in this rapid deportation case, known as expedited removal, did not violate key safeguards of individual liberty in the US Constitution. It is likely to impact thousands of potential asylum-seekers, who already face long odds in gaining asylum. Related: Trump proposes harsh asylum rules disqualifying many applicantsSarah Pierce, a policy analyst with the Migration Policy Institute, spoke with The World's host Marco Werman about the implications of the ruling.Marco Werman: Explain what the Supreme Court actually upheld today and start, if you would, with these expedited hearings for asylum-seekers. What do they look like and how are they being used? Sarah Pierce: When asylum-seekers come to the United States, whether that be to a port of entry or crossing the border illegally, as the Sri Lankan national did here, they're subject expedited removal proceedings, under which they're deported from the country without seeing a judge within at most a few weeks. While they're in those proceedings, they can claim a fear of returning to their home countries. And that triggers a preliminary asylum interview, also called a credible fear interview. The Sri Lankan national here had that credible fear interview and was denied. And he seeks to have a federal court review that denial. But there's a statute, a law, in place saying that federal courts could not review these decisions. And so he was contesting the constitutionality of that law, which the Supreme Court then upheld today.To contest the constitutionality, he was basically bringing in a habeas corpus petition. How unusual is that at asylum proceedings?It is unusual. A lot of these asylum-seekers don't yet have attorneys. They have not been in the United States a long time and they don't have the resources to go through with this full federal court review. But it definitely happens whether they're trying to get the facts of their case reviewed or if they think that they were denied on a legal error.Related: US and Mexico are blocking kids from asking for asylum because of coronavirusWhat was the rationale for this decision, then, at the Supreme Court today?The Supreme Court ultimately found that foreign nationals like this one, who are detained shortly after entering the country illegally, they don't enjoy as many constitutional protections as other individuals in the United States. This is a pretty big hit for foreign nationals. They're saying that Congress and the executive, the political branches of our government, have the power to determine the rights that these individuals enjoy and they can't depend on the Constitution. So the fear is that this opinion could be expanded to take away other rights for this group of individuals. Generally, how hard is it to be granted asylum in the US right now? Has it gotten more difficult because of the pandemic?During the pandemic, it's essentially impossible if you're talking about asylum at the southern border because of the order that came down from the CDC. Anyone approaching the southern border is being expelled from the country rather quickly. The only individuals who are able to seek refuge in the United States during this kind of black hole period of the pandemic are those who proactively state to US Border Patrol agents that they have a fear of torture in their home country if they fear persecution or anything else, they still will be expelled as quickly as possible.This interview has been condensed and edited. The rapid closures of borders around the world have been among the most dramatic migration-related effects of the COVID-19 pandemic. More than 130 countries have introduced entry restrictions at their borders, the International Organization for Migration (IOM) estimates. While these closures have virtually suspended leisure and business travel across the world, the effects are proving even more severe for refugees and migrants fleeing danger. Crossing an international border to a country of safety and filing an asylum claim is no longer possible in many places—a seismic shock to the foundations of a post-World War II international protection system that relies on the goodwill of national governments to grant access to their territory for those in need. The pandemic has also placed into stark relief the unique vulnerabilities forced migrants now confront in the face of outbreak. The reception facilities where many asylum seekers live while awaiting a verdict on their claim invite outbreaks, even in high-income countries with well-run asylum and reception systems. Infection is likely to spread even more rapidly in severely overcrowded facilities, such as the camps on the Greek islands and informal settlements in Mexican border cities where migrants awaiting U.S. asylum hearings are massed. In developing countries where access to proper health care is limited even for nationals, the consequences of the pandemic could be disastrous for refugees who often live in densely packed housing with poor sanitation. At the same time, the suspension of resettlement operations by IOM and the UN High Commissioner for Refugees has closed off a crucial lifeline for the especially vulnerable. Speakers on this webinar consider how the COVID-19 pandemic has affected—and perhaps, remade—the global protection systems. Meghan Benton, Director for Research of MPI’s International Program, is joined by MPI colleagues, Kathleen Newland, Hanne Beirens, Sarah Pierce, and Susan Fratzke, for a free-flowing conversation regarding the effects of the pandemic on asylum systems in Europe and North America, as well as those in developing regions, where 85 percent of refugees remain. In addition to considering the immediate effects the crisis has had on national asylum systems and on refugees themselves, the conversation looks ahead and begin to assess the implications for the principle of asylum and access to protection in the future. Texas-based singer/songwriter Sarah Pierce was musically influenced by her family’s heritage in the cattle business and she sings about the long line of women who get things done on the ranch. Writing and playing classic country from a woman’s viewpoint and from a place firmly rooted in the land, she combines heartfelt story telling with an honest message in the 9 albums spanning her career. Pierce released her newest CD, Barbed Wire, on the Little Bear Records imprint. Produced by Merel Bregante, Barbed Wire was recorded at The Cribworks Digital Audio in Liberty Hill, Texas, and she is launching her support tour this month in Texas. Gina Chavez is a bilingual Latin-folk singer/songwriter from Austin, Texas, who blends the sounds of the Americas with tension and grace. Her latest independent release, Up.Rooted, is a collection of bilingual songs traversing cumbia, bossa nova, vintage pop, reggaeton, and folk combined with dynamic vocals and sharp social commentary. The album topped the iTunes and Amazon Latin charts and was featured on NPR’s All Things Considered. She is the 2014 John Lennon Songwriting Contest Grand Prize Winner for her song “Siete-D,” a rock-cumbia-rap mix that explores the delights and dangers of El Salvador from the bus she rode as a volunteer there in 2010. She is currently on tour and will be onstage in Los Angeles at the Hotel Café, Oct 10 with Mitre and Irene Diaz. But she stops in at Music FridayLive! this Friday.
