With certain exceptions, unfinished business “dies” on the Order Paper and must be started anew in a subsequent session. Bills which have not received Royal Assent before prorogation are “entirely terminated” and, in order to be proceeded with in the new session, must be reintroduced as if they had never existed.116 On occasion, however, bills are reinstated at the start of a new session at the same stage they had reached at the end of the previous session. This is accomplished either with the unanimous consent of the House117 or through the adoption of a motion to that effect, after notice and debate.118 The House has also adopted provisional amendments to the Standing Orders to carry over legislation to the next session following a prorogation. Since 2003, prorogation has had almost no practical effect on Private Members' Business.120 As a result of this significant exception to the termination of business principle, the List for the Consideration of Private Members' Business established at the beginning of a Parliament, all bills that originate in the House of Commons and all motions in the Order of Precedence, as well as those outside of it, continue from session to session.121 If consideration of an item at a certain stage had begun but had not been completed, the item is restored at the beginning of that stage, as if no debate had yet occurred. Private Members' bills that were referred to a committee in the previous session are deemed referred back to the same committee. Private Members' bills which have been read a third time and passed are sent again to the Senate.122 With dissolution, all business of the House is terminated. The Speaker, the Deputy Speaker and the members of the Board of Internal Economy continue in office for the acquittal of certain administrative duties until they are replaced in a new Parliament.143 For the purposes of certain allowances payable to them, Members of the House of Commons at the time of dissolution are deemed to remain so until the date of the general election.144 Members' offices, both in Ottawa and in their constituencies, remain open in order to allow Members and their staff to provide services to constituents.145 As the office budget for Members is drawn from public funds, Members' offices and staff may not be used for electoral purposes. All items on the Order Paper including government and private Members' bills die.146 The government's obligation to provide answers to written questions, to respond to petitions or to produce papers requested by the House also ends with dissolution.147 The government must wait until the new Parliament is in session before tabling any document that is required pursuant to an act, resolution or Standing Order. Committees cease to exist until the House reconstitutes them following the election. All orders of reference expire, and the Chairs and Vice-Chairs of all committees cease to hold office. The government is no longer required to provide responses to committee reports. The executive committees of interparliamentary associations carry over from one Parliament to another. However, as a general rule, the activities being organized by the associations are postponed during a dissolution. Since multilateral assemblies continue to meet, Canada's representation is usually ensured by Senators.148 Once an election has been held and prior to the start of a new Parliament, both Senators and re-elected Members may participate. Official parliamentary exchange programs with other assemblies are also usually postponed. I can't accuse NZ First MP Shane Jones of being pale, male, and stale. But he is male, and he is stale with these comments of his about the way some MPs are dressing in Parliament. I do agree with him, though, that some of the rules in Parliament need toughening up. This has all been stirred-up after the MPs did their haka in Parliament last week. Shane Jones and ACT leader David Seymour are saying that the rules governing how things are supposed to run in the House aren't up to scratch. I was reading that the toughest personal penalty that an MP can face for playing up in the debating chamber is $1,000. Which is chicken feed when you consider the salaries MPs are on. So MPs on Parliament's Standing Orders Committee are going to look into it and see if they can come up with some stiffer penalties for MPs who break the rules. Officially, these rules are known as Standing Orders and it is the Standing Orders Committee which is responsible for reviewing and considering the rules that govern how the House operates. So Shane Jones is happy about that. He's also happy to let the Standing Orders Committee decide what changes might be needed. But he also reckons they need to get tough on dress standards, as well, in Parliament. He thinks the way some MPs dress, they look like "scarecrows". But I'm not upset about cowboy hats and feathers in Parliament. That's because Parliament is, after all, the House of Representatives. Meaning the politicians in that House are supposed to be representative of us. And, if you're somewhere right now where there are other people, take a look around. Is everyone dressed the same? Of course they're not. Are all the guys in suits and ties? I bet they aren't. And are all the women wearing smart business suits? I bet they're not, either. Whether we like it or not, dress standards generally have changed. You might say they've gone backwards. I wouldn't describe it that way. The point I'm making is that Parliament needs to reflect the real world. And the real world includes people dressing in cowboy hats. And feathers too, at times. But where I am with Shane Jones and Christopher Luxon, though, is the need to ensure that the rules that determine how Parliament is run and what is expected of MPs and the consequences for breaking those rules need toughening up. Reason being that there would not be any other workplace in the country where aggressive behaviour would be tolerated. And I'm not being anti-haka here, but what happened in Parliament last week was aggressive. The All Blacks' haka is aggressive, and the haka in Parliament on Thursday was aggressive. Just like Julie-Anne Genter was aggressive when she went nuts at Matt Doocey in the House earlier this year. And that's where the rules —or, at least, the punishments for breaking the rules— need a good look at. Because, just like people wearing cowboy hats and feathers is part of the real world, we should also be seeing our Parliament run in a way that gives MPs the same protections that all workers in this country expect when it comes to not being treated aggressively and being respected. Jersey's States Assembly has 49 elected members who can be appointed to different roles. How this happens is guided by the rules of the States Assembly - the 'Standing Orders'. After a general election deciding appointments is the first job of the newly-elected Assembly. The very first appointment made is for Chief Minister. Members can become government Ministers (part of the 'executive') or be made chair or member of a panel or committee (also called 'non-executive'). The Assembly votes on who gets which role.During the four year term between elections, there can be 'casual' vacancies. These are often due to resignations, or may be as a result of a vote of no confidence. Tony Burke is the minister for employment and workplace relations and minister for the arts, as well as the leader of the House of Representatives. One of his first tasks is the government's new submission for the minimum wage case, which will say these workers should not be left behind, as inflation has spiked. If the Fair Work Commission gives a 5.1% rise, in line with inflation, is there a case for it not flowing through to awards, or all awards? "I can't imagine a situation where there was no flow-through at all. The commission always has the capacity to work out how the flow-through might happen." He notes one option floated has been a flat dollar increase so the flow-through happened differently. "The commission will work that through. But certainly there are many awards that are not far from the minimum wage. "And when we talk about the heroes of the pandemic a lot of those people are on those awards. So while the focus has been specifically minimum wage, I tend to use the term low-paid workers." On reforming parliament, Burke says he is not trying to get rid of the anger. He doesn't want to turn parliament into "a quiet, polite dinner party". "The debate is fierce and passionate and real. I think that matters and I think it's good for democracy." Nor is he in favour of scrapping "dorothy dixers", because the government needs the opportunity to tell the house what it is doing. But there will be more questions for the larger crossbench, and he flags the government won't so routinely shut down opposition moves for debates. "Standing Orders say there's one question from the crossbench. With a crossbench as large as what we're now facing, that's just not sustainable." Without changing that, "you're effectively telling a very large number of Australians that because they didn't vote for a major party, their voice is going to be heard less." Burke says he has a passion for the arts – he was briefly arts minister at the end of the last Labor government – and laments a lack of a cultural policy in recent years. "In cultural terms, what the arts, events, entertainment sector do matters to who we are as Australians. And that affects your education policy, your health policy, your trade policy, your foreign affairs policy. Nor has there been any guidance that these are serious industries and these are serious jobs." The arts are really important in giving people a capacity to imagine and create, Burke says. They are "really important for us as a nation. I don't think we've had an arts minister see it as a priority in that sense for a long time, and I really want to bring that back".
