U.S.-Russia relations have been complicated, to say the least. Given Russia's recent cyberattacks on SolarWinds and the government-directed attempts to influence the 2020 U.S. presidential election, the Biden administration is stepping up and issuing sanctions against the Russian government to curtail harmful foreign activities. But do these sanctions make a difference? I'm joined by attorneys Fatema Merchant and Mario Torrico to discuss the efficacy of U.S. sanctions against Russia. Fatema Merchant is a partner in the Government Contracts, Investigations and International Trade and White Collar Defense and Corporate Investigations Practice Groups in Sheppard Mullin's Washington, D.C. office. “Economists have predicted nine out of the last five recessions,” Nobel-winning economist Paul Samuelson famously joked. On June 27, the European Commission issued the long awaited opinion in its competition case against Google. The Commission held that Google had abused its dominant position as an Internet search engine by promoting its own comparison shopping service in search results and demoting those of competitors. In addition to imposing a fine of €2.42 billion ($2.7 billion) – the largest fine the E.U. has ever levied in an abuse of dominance case – the Commission ordered Google to correct the unlawful conduct within 90 days or face penalty payments up to 5% of the company’s average daily worldwide turnover. This conduct component of the remedy potentially places the company under Commission oversight for years to come. In addition, Google is likely to face related civil actions in individual Member States brought by competitors – aided by the new E.U. Directive on Antitrust Damages Actions – alleging that their business has been hurt by Google’s search practices. -- The Commission’s view of the case is in stark contrast to that of U.S. antitrust enforcers who, after thoroughly investigating much the same conduct, elected to take no action. Daniel Griswold is director of the Center for Trade Policy Studies at the Cato Institute in Washington, D.C, and the author of the new Cato book, Mad about Trade: Why Main Street America Should Embrace Globalization. Since joining Cato in 1997, Mr. Griswold has authored major studies on globalization, trade, and immigration. He's written articles for major newspapers, appeared on CNBC, C-SPAN, CNN, PBS, and Fox News, and testified before House and Senate committees. Earlier in his career, Mr. Griswold was editorial page editor of a daily newspaper, the Colorado Springs Gazette, and a congressional press secretary. He holds a bachelor's degree in journalism from the University of Wisconsin at Madison and a diploma in economics and a master's degree in the Politics of the World Economy from the London School of Economics.
