You want an example of bizarre stuff happening at council level? Take a look at the Reading Cinema deal Wellington City Council is trying to stitch together The context here is that Reading Cinema is on Wellington's Courtenay Place party strip, but it is closed and has been since 2019 because it is a quake risk- and now it's becoming an eyesore. But apparently, the council is trying to help the owners pay for the strengthening. What it is reportedly offering to do is buy the land under the building for $32 million, which the owners can then use to strengthen the building. And then, those owners can buy the land back in ten years for $32 million. How nuts is that? That land will undoubtedly value up in ten years, and yet, the Council wants to sell it back for exactly the same amount. So basically, it's just a complicated way of providing a loan of $32 million to the owners of Reading Cinema. Now, ratepayers are going to have some opinions on this, because they are struggling to fund the earthquake strengthening of buildings like Town Hall, which they own and the repair of water pipes, which they own. And that's without helping pay for the renovation of a cinema owned by a company listed on the NASDAQ. But here's the really wacky thing- ratepayers are not supposed to know about this. The details of this were supposed to be kept confidential, the deal was supposed to be struck without their knowledge, because it's ‘commercially sensitive', apparently. And that is why the mayor has called in lawyer Linda Clark, to try to shut up the councillors who opposed this, because someone leaked the details to the media. How outrageous is this? To (A), stitch up a deal that uses what little debt allowance Wellington City Council has left to subsidise an US listed company. To (B), try to keep it a secret from the ratepayers who just got hit with a 12 percent rates rise. And then (C), try to shut down any public dissent. Find me something more bizarre at council level this week and I'll buy you a ticket to the cinema, once Wellingtonians subsidise its reopening. Wellington Mayor Tory Whanau has issued five of her councillors with a code of conduct complaint, alleging they breached confidentiality. Whanau confirmed she received a complaint about the conduct of five councillors from Deputy Mayor Laurie Foon and, after seeking advice, decided to proceed with issuing the complaint. “To assist me in my consideration of these allegations, I have initiated an independent review to establish if any breach has occurred. That review will be undertaken by Linda Clark, partner at law firm Dentons Kensington Swan. “Given my role under the Code of Conduct, I do not intend to make any further comment on this matter until the independent review has been completed.” Four of the councillors - Diane Calvert, Ray Chung, Tony Randle and Nicola Young - issued a joint press release this afternoon outlining the nature of the complaint. One other unnamed councillor has also reportedly been issued with the complaint. The councillors say the complaint comes after a public-excluded meeting earlier in October where Wellington City Council discussed the future of the Reading Cinema complex on Courtenay Place. Despite the meeting being held behind closed doors, the Herald understands a multimillion-dollar deal, involving the council buying the land underneath the Reading Cinema, was under consideration. It was discussed in a public-excluded part of the meeting. Reasons given for this included allowing the local authority to carry on negotiations, including commercial and industrial negotiations, without prejudice or disadvantage. At the time, Whanau said it was “getting really boring” that some of her councillors continued to speak to the media about confidential council meetings. “It creates an environment where the public does not have the full picture and loses faith in our processes and decision-making,” Whanau said. The councillors say Whanau left “a clear breadcrumb trail about a deal with Reading Cinema making it easy for the media to identify the project”. “So why is she attacking and blaming us?” Councillor Diane Calvert said the complaint is an attempt to silence councillors. It is an orchestrated attack on democracy.” The complaint also references the councillors' concerns about the Town Hall's cost blow-out and the financial challenges facing Wellington. The Town Hall budget recently exploded from $182 million to a possible $329m. Since the Town Hall was declared earthquake-prone and closed in 2013, the cost of the work has grown from $43m to $60m to $90m to $112m and most recently to $182m in 2022. A independent report has found no evidence of an orchestrated pro-Russia campaign behind the inappropriate editing of international new stories by an RNZ web journalist. But it concludes the reporter breached editorial standards and RNZ's international news contract and the organisation created the conditions that allowed that to happen. The report by media lawyer, William Akel and lawyer and former broadcaster Linda Clark found no evidence malicious intent on the part of the journalist, but his actions damaged RNZ's reputation. It makes 22 recommendations. They include: Changing RNZ's editorial structure so its digital news team is integrated into its broader news division, without unecessary delay, to ensure consistant editorial control. Creating a senior role to oversee editorial performance and encourage a culture of editorial integrity. Increased editorial training. And it also suggests there be a formal review of the staffing levels, budget and work load of its digital news team. ACC doesn't have a strong privacy culture, its policies are outdated and its staff have a narrow view of what privacy breaches are. Those are just some of the findings in a damning independent report into how client information is managed at the agency. The review, carried out by lawyer Linda Clark, was commissioned after RNZ revealed last year that some call centre staff shared, and laughed at, clients' injuries on Snapchat, and one client's old sensitive claim was viewed hundreds of times by more than 90 staff. A damning independent review has found ACC's privacy culture is poor, its policies are outdated and its staff not well informed. The review, by laywer Linda Clark, was commissioned after RNZ revealed a group of call centre workers shared client information on Snapchat. ACC chief executive Megan Main says all 30 review recommendations will be implemented by the end of 2023 and the public can be confident the agency will protect their private information. She said she was sorry about the breach. "I'm personally sorry about the impact that the events in the Snapchat incident had on New Zealanders trust and confidence in ACC."

July 27, 2021 - A coalition of home care organizations are organizing in response to the Cuomo administration drastically reducing the number of providers authorized to direct their services in New York. Linda Clark, an attorney for the burgeoning coalition, explains why the state's decision is legally problematic and could reduce the quality of care for more than 100,000 New Yorkers.
The draft script of the planned movie on the March 15 mosque attacks has been called a Hollywood rewrite of New Zealand history.A copy of the draft script - which centres on Jacinda Ardern and includes a graphic reconstruction of the deadly terrorist attacks on two Christchurch mosques - was leaked to Newshub.The draft script included 15 deaths and more woundings across 17 pages.Newshub asked lawyer Linda Clark to look at the political reaction to March 15 included in excerpts from 10 pages of the script."They're writing a version of New Zealand history, but they're writing it with an American sensibility," Clark said.Jacinda Ardern was represented as a "slender figure". On the night after the attacks as she gets out of her bed "dressed in a slip" and looking out the window where she "breaks down" and "sobs alone".While Ardern is portrayed as politically strong, the script implies she needs reassurance from partner Clarke Gayford and then deputy Prime Minister Winston Peters, Newshub reported."Has there ever been a day like today?" Ardern asks Peters in the script.In te reo Māori, he says: "He kotuku reranga tahi," which is subtitled as "the white heron only flies once".Clark told Newshub the script's portrayal of Ardern was "emotional, objectifying and pretty sexist"."[The draft script] is written as if an American wrote it, for an American audience, with no understanding of how New Zealand looks at these issues and how our politicians behave."Peters called his part of the script "total nonsense" while Simon Bridges, also featured in the script, calling it "misleading" and "offensive"."Hollywood has had some great movies based on history, but sadly this won't be one of them," Peters told Newshub.He said this was too serious of an issue for some "cheap Hollywood script" to try to make money out of."I suggest they withdraw from the scene if they don't intend to be honest here."In the script, Bridges' character is opposed to Ardern's gun law reforms and is quoted as saying: "come for our guns, you might get bullets". However, he supported the law change in real life."This is a misleading and dishonest Americanisation of what happened in our country," he told Newshub.In place of David Seymour, the script includes a character named "Solomon Marsh", also against Ardern's gun law changes.New Zealand-born Andrew Niccol wrote the film script and Newshub sent questions to his agent, but is yet to receive a response.Earlier, Newshub showed parts of the leaked script to three families who lost loved ones on March 15.Ambreen Naeem - whose husband Naeem and son Talha were killed in the attacks - said the script was unethical, totally immoral and unacceptable."It's quite distressing and retraumatising," Ambreen told Newshub.Maha Elmadani, who lost her father Ali in the attack, said she couldn't see how a movie based on the draft script she saw excerpts of was any different from the livestream.Salwa Mohamad, whose husband Khaled and son Hamza were murdered at Al Noor Mosque, said it was worse.
