This week, we're examining the Federal Trade Commission's (FTC's) stance on a federal non-compete ban, the expansive changes introduced by Florida's Contracts Honoring Opportunity, Investment, Confidentiality, and Economic Growth (CHOICE) Act, and a pivotal ruling by the Supreme Court of the United States (SCOTUS) on pension withdrawal liabilities. FTC Delays Decision on Non-Compete Rule         The FTC requested an additional 60 days to decide if it will continue defending the non-compete ban, suggesting the rule may soon be withdrawn. Florida CHOICE Act Expands Non-Competes Florida's new CHOICE Act now allows non-compete agreements for covered employees to span up to four years, doubling the previous limit. Show Notes: Kendalle Cobb, a family physician, has been practicing in Cleveland since 2004. She graduated from George Washington University School of Medicine in Washington, DC and completed her family medicine residency at Kaiser Foundation Hospital in Fontana, California. After a year in Boston, she returned to serve on the faculty at her former residency program. She met her husband, who taught at a boarding school in Claremont, California, and after they got married, they moved to Cleveland to be closer to his family. Family Physician and Physician Advisor Kendalle shares that family medicine, as a primary care specialty, takes a more holistic approach with the inclusion of counseling and a “cradle to grave” mentality that follows the patient through different stages of life. She sees patients 50% of the time in a family health center in the community. The rest of her time is spent as one of the associate chiefs of staff and as a physician advisor at Cleveland Clinic Lerner College of Medicine, a five-year program that trains students to be physician investigators, focusing on research, scholarship, personal and professional development, and reflective practice. The physician advisor attests to the students' competency report is representative of the feedback that the students receive. Supporting Medical Students Kendalle talks about working as a physician advisor. She shares what she has learned in this role. One aspect she has realized is that people are often used to being self-sufficient, making it challenging to ask for help or to work in collaborative environments. She explains what some students struggled with in terms of peer-to-peer interaction, challenges of the assessment system, and accepting that there will always be areas of improvement. Kendalle helps normalize expectations for students. She also talks about the connections between her work as a physician advisor and as a family physician. The Partnership Aspect of Medicine When Kendalle first thought about becoming a doctor, she initially had an idea of being able to fix things, but now she appreciates the partnership aspect of medicine where she accompanies people along their path. She mentions that there is often a difference between the textbook ideal treatment and what's best for the patient in front of her. She explains that medicine is a team sport, and group work requires trust and collaboration, and while she didn't like group work in school, she realizes that, in medicine, no individual can do everything, and doctors rely on others to answer phones, send messages, and process refill requests. By understanding and addressing these challenges, doctors can help their students navigate the challenges they face and become better doctors. Counseling and Family Medicine Kendalle talks about how family medicine and her approach to counseling has evolved over time. During her residency, one afternoon a week was dedicated to mental health, in addition to didactic sessions, she had two hour-long patients, supervised by a family physician and psychiatrist. Over the course of her residency, she had an increasing number of clinic sessions to see an increasing number of patients with various physical and mental health concerns. She learned that some people just want to share their feelings without wanting to change anything. She shares a story of a patient who was upset about a situation, and although their conversation was not health related, it helped Kendalle support the patient in figuring out next steps. In addition to counseling, she also learned to use tactical phrases and questions to help patients make decisions that align with their goals. This approach allows for more effective communication and understanding of patients' needs and concerns. Creating a Safe Space for All Patients Kendalle discusses the importance of understanding and addressing various health issues in healthcare settings. She shares her experiences with the stub toe theory, which is really "broken arm theory,"  which is when a doctor attributes any concern with which a patient presents, to some other risk factor (smoking, obesity, gender identity). She also discusses the importance of considering factors that can affect health in interacting with patients. She shares a case of a woman with previously well-controlled blood pressure whose blood pressure was high. Kendalle uncovered a social stressor.  Kendalle emphasizes the need to consider different priorities and the reasons behind people's decisions regarding their health. She avoids asking the question "why" and instead asks "what factors contributed" to the patient's decision or thoughts about their health issues. This approach helps patients feel less defensive and allows Kendalle to better partner with patients to manage their health. Confidentiality in the Doctor's Office Kendalle explains that she is often the doctor for more than one generation in a family,  and she shares a story that stresses the importance of confidentiality in the doctor's office. She also talks about how difficult it can be when extended family members want to become her patients, but the fact that the family entrusts the doctor with their loved ones is special. She also talks about the trust, gratitude, and grace shown by the patients, and how these are the moments that stay with her. What happens when the analytic setting—built on confidentiality and silence—meets the institutional demands of psychoanalytic training? Can the frame of supervision truly preserve the integrity of the analytic pact, or does it inevitably put it at risk? In this episode, Ellen Sparer explores a central paradox in psychoanalytic formation: the tension between the confidentiality of analytic work and the structural requirements of supervision. Drawing from her experience at the Paris Psychoanalytic Institute, she asks whether supervision risks undermining the very foundation of the analytic situation—what Freud, in An Outline of Psychoanalysis, described as a pact in which “the patient's sick ego promises us the most complete candour…” while “we, on the other hand, assure him of the strictest discretion.” Through reflections on André Green, José Bleger, and Freud's concept of disavowal, Sparer examines what she calls a “noisy contradiction”—a situation in which the analyst-in-formation becomes both observer and observed, and where the silence essential to the analytic space is disturbed by institutional structure. She invites us to consider the Institute's role as a symbolic third—present, structuring, yet potentially unsettling—and to ask whether we can live with this paradox without disavowing its presence. Rather than resolving the contradiction, this episode engages with it directly, as Ellen Sparer offers a nuanced and courageous inquiry into a space of ethical tension, institutional inheritance, and potential transformation at the core of analytic formation.   Ellen Sparer is a training analyst at the Paris Psychoanalytic Society and former Director of the Paris Institute of Psychoanalysis, a role she held until March 2025. She has served as co-chair of the Applicant Societies Committee of the IPA, where she contributed to the evaluation of emerging psychoanalytic groups seeking IPA recognition. She is also an Associate Editor of the International Journal of Psychoanalysis, where she's part of the Education Section, and a scientific advisor for the Jahrbuch of Psychoanalysis. From 2009 to 2019, she was on the editorial board of the Revue Française de Psychanalyse. Most recently, she was elected to the IPA Board as a European representative. Her scientific work and publications focus on the unconscious ego, supervision, training, the frame, and ethics. In honor of Sexual Assault Awareness and Prevention Month this April, host Janet Michael spoke with Aliyha Gill, a passionate sexual assault victim advocate for the Phoenix Project to explore the crucial efforts of the organization and highlight the importance of consent, support systems for survivors, and educational initiatives. Janet introduced the show by highlighting April as Sexual Assault Awareness and Prevention Month, emphasizing the importance of widespread awareness. Aliyha shared her role as a sexual assault victim advocate for the Phoenix Project, an organization extending its services to domestic violence and sexual assault survivors. She delved into the comprehensive support provided by the organization, including legal advocacy, educational supportive counseling, medical accompaniment, and specialized support for children and parents. A significant part of the conversation revolved around the topic of consent. Aliyha provided an in-depth understanding of consent from a sexual assault perspective, emphasizing both verbal and non-verbal communication. This event aims to provide an expressive outlet for survivors through various art forms, from abstract art to spoken word. The showcase will feature submissions from survivors in Warren County and presents an opportunity for the community to witness the resilience and creativity of these individuals. Alongside the art showcase, the organization is preparing for International Denim Day on April 30th, promoting awareness through wearing denim. Aliyha highlighted the origin of this day and its significance in advocating against victim-blaming attitudes. Additionally, various educational materials and support resources will be available at multiple locations, making it accessible for those in need. April also marks Child Abuse Prevention Month. The Phoenix Project is actively participating by displaying blue pinwheels and providing educational resources to the community. A cohesive approach involving public and systemic efforts is essential to prevent child abuse, with schools and workplaces playing significant roles in this mission. The Phoenix Project will host an open house and donor event on April 24th, offering a platform for the community to learn more about their services and meet the dedicated advocates in person. This event aims to foster better support systems and create a safer community for all. Phoenix Project's comprehensive support system and educational initiatives are paving the way for a more aware and empathetic community. Their dedication to providing safe spaces for survivors and raising awareness about consent and prevention makes a significant difference in the fight against sexual violence and domestic abuse. Today, we're taking on a topic you've probably heard of – it may have even impacted you personally. But you might not be aware just how linked it is to the issue of diversity and inclusion.   We're talking about noncompete agreements.   Noncompetes have long been a staple in corporate America. But, despite supposedly being in place to protect trade secrets, many workers, including low earners, have been subject to this practice, greatly restricting their career options, flexibility and earning potential.   And that's especially the case for underrepresented voices. A number of studies suggest that noncompete agreements more strongly affect women and people of color, with one finding that strict enforcement of noncompete agreements lowered the wages of women and people of color by twice as much as white men.   But things are starting to change. Last year, the FTC announced a rule banning noncompetes. Whilst it was largely welcomed by workers, not all employers were so happy about it.    So we're going to dive into the issue today. It's at least a good idea for the employer, but not always for the employee.” Karin “It's a system that's put in place with the right intentions, to overcome certain issues, but I personally feel that it doesn't fulfil the requirements either for the employer or the employee.”  Kiran “It was originally designed to protect companies, but I don't think that's where it's sitting today.” Chelsey “It's something that has to be monitored, managed and updated – and potentially resigned on a  regular basis, if a company is serious about its intent behind the noncompete. That's very expensive, and each and every time you request an employee to re-sign, it's a time for that employee to reconsider if they still want to be a part of that organization.” Karin “Fewer than 10% of workers negotiate these agreements.” Chelsey   “Can everyone talk about the meaning of the words?! The words have lost all meaning, they've become buzzwords... Let's talk about the words as part of impact on culture.” Kiran “It's so hard to restrict information in a human brain. If I'm an employee in one place and go to another, I didn't say anything about my previous job… but I still have lessons learned and knowledge, I'm not sharing information customer-to-customer, but I'm going to have new solutions. And allowing the candidate to see what's written and also discussing it with them, obviously makes it quite easy for them to get both positive input, but also at times, input that will help them evolve and deepen their work even more.”  Episode Description: We begin by exploring the critical role of case writing in psychoanalytic training, discussing Stephen's concept of "a fourth pillar of analytic training." Stephen introduces the dynamic interplay between writing and self-reflection, arguing that the act of writing illuminates resistances, countertransference, and areas of growth that might elude the analyst in supervision or personal analysis. He shares his innovative "three-minute chess match" technique for identifying the heart of a case narrative and reflects on his journey—from his mother's poetry to his current work mentoring candidates in the art of case writing. We explore Stephen's insights on the 're-immersion anxiety' that can inhibit case writing, and how addressing these resistances transforms the writing process and deepens clinical work. We conclude with a discussion of how the process of writing fosters an enduring capacity for self-supervision and analytic insight.   Our Guest: Dr. Stephen Bernstein, MD is a Training and Supervising Analyst at the Boston Psychoanalytic Society and Institute and has chaired a discussion group on writing about analytic cases for over 30 years. He is a prolific author, including his recent paper, The Process of Case Writing: A Fourth Pillar of Analytic Training, published in the Journal of the American Psychoanalytic Association. Dr. Bernstein's work highlights the centrality of case writing as an essential tool for self-reflection and professional development.
