June 9, 2025 ~ After 119 years, the NCAA's amateurism model has officially ended, marking a seismic shift in college sports history. Deb Schneider, Of Counsel to Fishman Stewart, talks with Chris and Lloyd about the House vs. NCAA settlement and the future of universities paying their athletes.
The Tony Blair Institute for Global Change (TBI) recently released a widely publicized report titled “The Climate Paradox”, which has garnered significant positive attention from outlets such as the Guardian, the BBC, the Financial Times, Bloomberg, and much of the European press.Beginning with the statement, “Climate action has reached an impasse,” the report, authored by Lindy Fursman (who holds a PhD in Sociology from UC Berkeley), outlines several key “facts” that have been effectively debunked by experts like Michael Liebreich in his Substack and Michael Barnard in Cleantechnica.The TBI concludes with a series of recommendations, the most prominent being the call to “accelerate and scale technologies that capture carbon, alongside significant investments in engineered carbon-dioxide removal technologies, including direct air capture (DAC) solutions”. To emphasize this message, the cover of TBI's report features an image of Climeworks' plant in Iceland. Climeworks, a Swiss engineering company with 500 employees, has received $800 million in equity and subsidies from major players such as Partners Group, the GIC (Singapore's sovereign wealth fund), Baillie Gifford (an early investor in Tesla), Swiss Re, and Microsoft.However, last week, Climeworks faced a major setback when it was revealed that despite receiving substantial funding, the company had only captured 105 tonnes of CO2—not 105,000, but just 105 tonnes (less than a single flight London – New York) —despite the strong backing of tech giants like Stripe, Microsoft and Shopify.This revelation has sparked widespread concern and warranted a prompt discussion with Laurent Segalen, Gerard Reid and Michael Barnard to assess the implications. When I was introduced to the Amateurism Collective in 2020, Leo Walton's records were a happy distraction from the isolation of the pandemic when he, alongside his 3 other friends launched the Amateurism 24/7 radio station. The era of college football that you grew up with and around is coming to an end. On Thursday the five “power conferences” voted to move forward with universities paying student athletes. In addition to this, the universities will pay out $2.8 billion in antitrust claims that date back as far as ten years. But where will this money come from? Sure, the “blue-bloods” of college football probably have that money laying around, but what about the smaller schools? A lot of schools will have to do some massive re-structuring of their athletic departments to not only pay out the money from past suits, but to also start paying student athletes in the future. There may even be situations where some departments or even sports may be completely eliminated from some programs. Andy Bunker and Jason Longshore dive deeper in to this new era of college sports that we are just now scratching the surface of.

Our podcast conversation today focuses on three pending legal cases involving athletes as employees-Dartmouth's men's basketball team attempting to unionize; Johnson v NCAA, with the plaintiffs arguing athletes should be treated as employees under the Fair Labor Standards Act; and the NLRB upcoming hearings probing whether USC, the Pac-12 and the NCAA are treating athletes as they would an employee. A prominent journalist and a legal scholar join me today to talk about the 3 cases moving their way through the political and legal systems involving athletes as employees. Sam C. Ehrlich, JD/PhD is an assistant professor of legal studies at Boise State University. Sam's research focuses on the legal governance of sports leagues, specifically through sport-specific antitrust exemptions, athlete fairness in collective bargaining and employment, and tort and constitutional liability for overseeing athletic organizations. Amanda Christovich is a reporter at Front Office Sports based in New York City covering the business of college sports. Her work has previously appeared in USA TODAY and The Wall Street Journal. She plans to be in the NLRB hearing covering the arguments in December 2023. All three cases are moving ahead in an environment where the NCAA is also putting great pressure on Congress to decide the definition of amateurism in college athletics in a post-Alston world. These cases could fundamentally alter college athletics. Let's get started.
