Drake assisted in an inspector general complaint concerning a costly intelligence boondoggle and aided Congressional investigations into intelligence failures in the lead-up to 9/11. And as the national security state expanded post 9/11, Drake's oath forbade him to remain silent when the government undertook surveillance that violated the rights of Americans. On the show this week, Chris Hedges discusses the prosecution and sentencing of former intelligence analyst, Daniel Hale, with his lawyer Jesselyn Radack. Daniel Hale, a former intelligence analyst in the drone program for the Air Force, who as a private contractor in 2013 leaked some 17 classified documents about drone strikes to the press, was sentenced on Tuesday to 45 months in prison. The documents, published by The Intercept, exposed that, between January 2012 and February 2013, US special operations airstrikes killed more than 200 people. Of those, only 35 were the intended targets. For one five-month period of the operation, according to the documents, nearly 90% of the people killed in airstrikes were not the intended targets. The civilian dead, usually innocent bystanders, were routinely classified as “enemies killed in action.” The Justice Department coerced Hale, who was deployed to Afghanistan in 2012, on March 31 to plead guilty to one count of violating the Espionage Act, a law passed in 1917 designed to prosecute those who passed on state secrets to a hostile power, not those who expose to the public the lies and crimes of government. Hale admitted as part of the plea deal to “retention and transmission of national security information” and to leaking 11 classified documents to a journalist. If he had refused the plea deal, he could have spent 50 years in prison. The sentencing of Hale is one more potentially mortal blow to the freedom of the press. It follows in the wake of the prosecutions and imprisonment of other whistleblowers under the Espionage Act including Chelsea Manning, Jeffrey Sterling, Thomas Drake and John Kiriakou, who spent two-and-a-half years in prison for exposing the routine torture of suspects held at black sites. Those charged under the act are treated as if they were spies. They are barred from explaining motivations and intent to the court. They cannot provide evidence to the court of the government lawlessness and war crimes they exposed. The bipartisan onslaught against the press – Barack Obama used the Espionage Act eight times against whistleblowers, more than all other previous administrations combined – by criminalizing those within the system who seek to inform the public is ominous for our democracy. It is effectively extinguishing all investigations into the inner workings of power.

While the textile business in the United States started in New England, it did not take Philadelphia long to catch up and pass our northern neighbors. Three people who immigrated to Manayunk helped build what had been a small village into one of the major manufacturing centers of the country. Joseph Ripka was a draft dodger from Silesia who at his peak employed 2000 men, women, and children in his mills, but went out of business at the start of the Civil War. Sevill Schofield came from England and took advantage of the Civil War to manufacture 365,000 blankets for the Union Army. Samuel Winpenny also came from England, but he declared bankruptcy before his 35th birthday. Several of his sons and grandsons were far more successful, but others were not and still have interesting stories to tell. Thomas Drake is a former senior executive of the U.S. National Security Agency, a decorated United States Air Force and United States Navy veteran. In April 2010, a federal grand jury in Maryland indicted Tom under the Espionage Act for illegally retaining classified information after he was suspected of leaking operational inefficiencies in the National Security Agency.

SPY Historian Vince Houghton sat down with Thomas Drake, former senior executive of the NSA – and whistleblower – who in 2010 was indicted on 10 felony counts; charges that would have carried decades of prison time had Drake been convicted. Instead, in early June 2011, the government dropped all of the charges and agreed not to seek any jail time in return for Drake's guilty plea to a misdemeanor of misusing the NSA’s computer system. Although the legal case was settled, the controversy would continue, as a new wave of whistleblowers (or leakers – depending on your perspective) burst on to the public scene, and dramatically changed the way many Americans viewed the power of their government.

Whistleblowers and journalists play a crucial role in scrutinising the powerful and holding them to account. The revelations by Edward Snowden have transformed our understanding of how sweeping digital surveillance techniques capture personal information about all of us. They have also exposed the immense dangers faced by whistleblowers in exposing illegality by governments, with Snowden having fled the US and currently residing in Russia. This MEAA and The Walkley Foundation special event, in partnership with Blueprint for Free Speech, features US whistleblower Thomas Drake, a former senior executive of the US National Security Agency, together with Edward Snowden’s US defence attorney Jesselyn Radack in discussion with ABC broadcaster Quentin Dempster. He is a former senior executive of the United States National Security Agency (NSA) and a whistleblower. We explore the extent of surveillance by the United States. Why is there so much surveillance and is the increasing surveillance of people in the United States justified? We discuss which is more harmful to our society, leaks or the policies that are leaked. Our first guest is Thomas Drake who was prosecuted for allegedly disclosing National Security Agency secrets years before Edward Snowden surfaced. Drake says the U.S. government has an “industrial-scale” surveillance system that “the Stasi in East Germany would have drooled over.” Then Fred Branfman, who recently wrote “America’s Most Anti-Democratic Institution: How the Imperial Presidency Threatens U.S. National Security,” is our guest. He argues, ”And today’s U.S. executive branch policies pose an even greater long-term threat to U.S. strategic interests, not only abroad but at home. The evidence is overwhelming, including the statements by several dozen U.S. national security experts cited at the end of my recent piece, that U.S. leaders are not protecting national security but rather weakening it as never before.”
