The death toll from the flooding in Texas has surged to at least 108, officials say. Amid the devastation, hundreds have been rescued, and volunteers have joined the search efforts. "We're tired but running off adrenaline, and it's for a good cause in trying to find people and bring some closure to those who may not be alive anymore and so that's kind of where we're at in the search," said Louis Deppe, who joined the search. Deppe got involved after seeing a Facebook post asking for help to find a friend's daughter. "His wife posted and said basically, 'We have an emergency. We need help. We need prayers.' So I immediately called them … and said, 'What's going on?' He said, 'Our daughter's been swept away.'" Deppe and his 25-year-old son immediately drove over to help, saying he understood the feeling as a parent. Oprah Winfrey picked "Culpability" by Bruce Holsinger as her latest book club selection. Winfrey said the novel explores artificial intelligence and moral responsibility, topics many are currently grappling with. Award-winning actor Michael C. Hall joins "CBS Mornings" to discuss his return in "Dexter: Resurrection," the highly anticipated sequel series set in New York City. The show picks up ten weeks after the events of "Dexter: New Blood," with Dexter awakening from a coma and hunting a new serial killer. In this episode, Alex starts by talking about why he isn't surprised that Dan Bongino has been tapped to be the Deputy Director of the FBI. Bongino is unhinged, distrusts the FBI, is an election denier, and is a loyal podcast host that loves Donald Trump. Next, Alex gives an update on the German elections that happened Sunday. Finally, it has been three years since the Russian invasion of Ukraine and the United States has finally made a total shift to neutralize culpability on the global stage. Alex talks about a troubling UN vote, why it matters, and why Trump is falling for Putin's trap.

Parental Culpability by Pewology Podcast
Causation in Law Source: Podcast: Causation: The Link Between Conduct and Harm Main Themes: Defining and differentiating factual and proximate causation. Applying causation principles in tort and criminal law. Examining challenges in proving causation, especially in complex cases. Highlighting landmark cases and their impact on legal precedent. Understanding the interplay between causation and public policy considerations. Most Important Ideas and Facts: 1. Two Components of Causation: Factual Causation ("But-For" Test): Establishes whether the harm would have occurred "but for" the defendant's actions. Example: "If a person sets a fire in a building, causing another person to die in the flames, factual causation is established if the victim's death would not have occurred 'but for' the fire set by the defendant." Proximate Causation (Legal Causation): Evaluates whether the harm was a foreseeable consequence of the defendant's actions, even if factual causation is established. Example: The landmark case Palsgraf v. Long Island Railroad Co. illustrates the limits of proximate causation by finding no liability when a series of unforeseeable events led to injury. 2. Causation in Tort Law: Negligence Claims: Causation is essential to prove duty, breach, causation, and damages. Concurrent Causation: Multiple parties can share liability for contributing to the harm. Example: Two factories polluting the same river can be held jointly liable for environmental damage. Intervening and Superseding Causes: These events can modify or relieve liability based on foreseeability. 3. Causation in Criminal Law: Focus on Culpability and Punishment: Requires proving both factual and proximate causation to establish criminal liability. Intervening Acts: Their impact on liability depends on their foreseeability in relation to the defendant's actions. 4. Special Considerations and Challenges: Multiple Causes: Determining each party's contribution to the harm is crucial, as seen in joint and several liability cases. Scientific Uncertainty: Difficulties arise in proving causation in environmental and toxic tort cases with complex scientific evidence. Market Share Liability: Provides a solution when identifying the specific defendant is impossible, as demonstrated in Sindell v. Abbott Laboratories. 5. Landmark Cases: Barnett v. Chelsea & Kensington Hospital: Highlights the importance of factual causation in establishing liability. Wagon Mound (No. 1): Emphasizes foreseeability as a key factor in proximate causation. Derdiarian v. Felix Contracting Corp.: Demonstrates the role of foreseeability in evaluating intervening causes. 6. Public Policy Considerations: Causation doctrines are not just technical rules but reflect broader societal values and aims, like deterring harmful practices and protecting vulnerable individuals. Courts balance the interests of plaintiffs and defendants to ensure fair outcomes and proportionate liability. Key Quotes: "Causation is what connects the defendant's actions or omissions to the harm suffered by the plaintiff or victim. Without causation, there can be no liability, no damages, and ultimately, no justice." "Imagine a world without causation standards—people could be held liable for harms with only a tenuous connection to their actions, leading to unpredictability and injustice." "Causation is a fundamental concept in tort and criminal law, providing the essential link between conduct and liability." Conclusion: Understanding causation is crucial for legal professionals, as it lies at the heart of determining liability and achieving just outcomes in various legal contexts. The principles and doctrines discussed in the podcast, combined with the landmark case examples, provide a comprehensive overview of this vital legal concept. By understanding the nuances of causation, one can better analyze legal situations and advocate for fair and equitable resolutions. --- Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

Much of what gets written regarding the reasons behind declining standards in the coffee shop focuses on the leadership and what they can do to facilitate success. Here at KTTS there are dozens of interviews and solo episodes dedicated to this very thing. But what does not get so much air time is the reality that if we are to see a rise in standards of leadership, we must also call for a rise in personal professional work standards from staff. Culpability for the miserable state of coffee service goes both ways and often it is the leaders avoidance of dealing with toxic employees that keeps them employed thus allowing their negative influence to sabotage the success of the business, the team, and, in fact, the whole industry whose reputation is built from the interactions consumers have with "professionals". Today on this solo episode we will be exploring the reasons why so many owners refuse to deal with toxic employees in the cafe in favor of a misguided notion of giving perpetual grace that is more enablement than kind gesture. We will also talk about what is needed if we are to make progress in the business of coffee shops. High standards are not just for owners and managers, they are for all and it is time we started creating environments that reward and recognize great work, while also not tolerating corrosive behavior and attitudes, be ti from leaders or employees. In this episode, the host discusses the case of Officer Brianne Leath, who was killed in the line of duty in Indianapolis in 2020. The host highlights the high number of police officers being shot and the lack of media coverage on the issue. The host also explores the trial of the suspect, Elias Dorsey, who was found guilty but mentally ill on charges of reckless homicide instead of murder. The host raises concerns about the leniency given to criminals compared to law enforcement officers and the impact on officer recruitment and morale. Takeaways There is a high number of police officers being shot in the line of duty, but there is a lack of media coverage on the issue. The trial of Elias Dorsey, the suspect in Officer Brianne Leath's case, resulted in a guilty but mentally ill verdict on charges of reckless homicide instead of murder. The leniency given to criminals compared to law enforcement officers raises concerns about accountability and sends a negative message to law enforcement. The impact of these cases on officer recruitment and morale is significant, as it becomes harder to attract people to become police officers. --- Send in a voice message: https://podcasters.spotify.com/pod/show/ksamspeakspodcast/message Support this podcast: https://podcasters.spotify.com/pod/show/ksamspeakspodcast/support

In this episode of Occupied Thoughts, FMEP Fellow Yara Asi speaks with Alex de Waal of the World Peace Foundation and Tufts University and author of the January 21, 2024 article in the Guardian entitled “Unless Israel changes course, it could be legally culpable for mass starvation.” In this discussion of widespread hunger and impending famine in Gaza, Drs. Asi & de Waal look at Gaza in relation to other cases of starvation and famine across the world, including comparing the human-made circumstances that lead to famine, the possibility and pace of international intervention to save lives, and the many generations required to face the specific trauma of famine. They discuss the possibilities for international intervention, noting that famine, once it begins, has momentum - and therefore will not stop when the bombing ends. Original music by Jalal Yacquob.

On this week's round table: colonial carbon culpability. Calling it a “first-of-its-kind analysis,” a recent study by Carbon Brief has crunched the numbers on some 170 years of emissions, seen through the lens of climate justice. Entitled, “How colonial rule radically shifts historical responsibility for climate change,” the report adds a critical dimension to addressing the question of what—and who—has brought us to the brink of depleting our cumulative carbon budget, the maximum CO2 our planet can handle before global temperatures rise to dangerous levels. Among those carbon culprits with a gigatonne to answer for: the former British Empire, so vast it's said every week a country somewhere celebrates their independence. So brutal that to factor in its era of extractive violence nearly doubles the UK's contribution to (and thus responsibility for) climate change. On this episode, host/producer Rick Harp and MI regular Candis Callison sit with study co-author Simon Evans to discuss this tally of twin legacies many still struggle to navigate and repair. // CREDITS: Our intro/xtro theme is 'nesting' by birocratic.
