In 2007, Kiriakou blew the whistle on the CIA's torture program, that torture was official U.S. government policy, and approved by then-President George W. Bush. He became the sixth whistleblower indicted by the Obama administration under the Espionage Act — a law designed to punish spies. He served 23 months in prison as a result of the revelation.In 2012 the Ralph Nader family honored Kiriakou with the Joe A. Callaway Award for Civic Courage, he won the PEN Center USA's prestigious First Amendment Award in 2015, the first Blueprint International Whistleblowing Prize for Bravery and Integrity in the Public Interest in 2016, and in the same year the Sam Adams Award for Integrity in Intelligence, given by retired CIA, FBI, and NSA officers. Sean O'Brien is a Visiting Lecturer at Yale Law School, where he teaches Cybersecurity and founded the Privacy Lab initiative. In 1915, Germany wanted to keep the United States from joining World War I. Knute Berger explains how the fight came to the Northwest. In the years leading up to World War I, Germany and its sympathizers tried to prevent the United States from entering the conflict. An intricate network of spies and saboteurs attempted to sway public opinion as well as interrupt shipments of war materiel at U.S. ports. Seattle was not immune to these forces. In the wee hours of May 30, 1915, a scow packed with dynamite near Harbor Island lit up the skies. The blast marked the beginning of an era of anti-German sentiment; the Espionage Act; and, of course, the U.S.'s eventual involvement in both world wars.  Crosscut's resident historian Knute Berger blew open this history in a recent episode of the Mossback's Northwest video series, but there is much more to the story. In this episode of Mossback, Berger joins co-host Stephen Hegg to discuss the murky details of this gigantic explosion in Seattle, the geopolitical context surrounding it, similar efforts by German saboteurs across the U.S. at that time, and the way these pre-war histories are remembered—and forgotten. There were others that had controversial views that were also banned or blocked.After these first steps were made in controlling controversial speech, Julian Assange was arrested and charged with violating the Espionage Act.While many civil libertarians are alarmed at what his prosecution could signal for journalists, national security hawks have been saying Julian Assange got what he deserved. It may be worse than McCarthyism, which was defeated by its own excesses. Today's information war against individuals and media who do not adhere to the Western-government-enforced narrative on Ukraine is part of a long history in the U.S. of officially crushing dissent. With the advances of technology for both surveillance and censorship, we might be in the most chilling atmosphere yet for thought control. Will it too be brought down by its own excesses? The First Amendment has not prevented the U.S. from suppressing speech throughout its history. Just eight years after the adoption of the Bill of Rights, press freedom had become a threat to John Adams, the second president, whose Federalist Party pushed through Congress the Alien and Sedition Laws. They criminalized criticism of the federal government: "To write, print, utter or publish, or cause it to be done, or assist in it, any false, scandalous, and malicious writing against the government of the United States, or either House of Congress, or the President, with intent to defame, or bring either into contempt or disrepute...” was banned. Congress did not renew the Act in 1801. Freedom of the press and speech next came significantly under attack in the lead up to the 1860-65 U.S. Civil War. Newspaper editors who campaigned for the abolition of slavery were attacked by mobs, sometimes directed by elected officials. In 1837 an editor was killed by a mob, one of whose organizers was the Illinois attorney general. During the war numerous editors and journalists were arrested in the North. "Throughout the war, newspaper reporters and editors were arrested without due process for opposing the draft, discouraging enlistments in the Union army, or even criticizing the income tax," according to the First Amendment Encyclopedia. While formal censorship was excluded from the 1917 Espionage Act by just one vote in the U.S. Senate, the 1918 Sedition Act was a two-paragraph amendment that was aimed at Americans who insulted the U.S. government, military or flag and who tried to criticize the draft, military industry or sale of war bonds. This law distilled the essence of enforced loyalty of the population to the symbols and military power of the state. It demolished the idea that America is exceptional as it showed the U.S. enforcing the same state-worship as most nations in history.  The act, with similar federal laws, was used to convict at least 877 people in 1919 and 1920, most infamously the socialist presidential candidate Eugene V. Debs who was sentenced to 10 years in prison for publicly opposing the military draft in a June 1918 speech. Publications such as The Masses were also prosecuted. The Sedition Act was repealed by Congress in March 1921. During the First World War the peculiar American practice of renaming food to erase the enemy began. Sauerkraut became liberty cabbage. During the 2003 invasion of Iraq French fries became freedom fries, because France opposed the war. Today Dostoevsky and Tchaikovsky have been removed from concert programs and living Russian artists have been fired. The Red Scare under Sen. Joseph McCarthy in the 1950s was one of the worst periods of smearing and punishing Americans who were thought to be disloyal. Its end came with the excess of McCarthy trying to find communists in the U.S. army. In the 1971 Pentagon Papers case there was a rare ray of light for free speech, when Justice Hugo Black wrote: "In the First Amendment the Founding Fathers gave the free press the protection it must have to fulfill its essential role in our democracy. The press was to serve the governed, not the governors. The Government's power to censor the press was abolished so that the press would remain forever free to censure the Government.” The 2016 election and the Russiagate fiasco gave the Democrats in Congress an excuse to use social media companies as proxies to shut down speech it did not agree with. It also led to smearing of those who questioned the Russiagate tale as being Russian agents. One of the gravest acts of U.S. repression of press freedom and free speech was the arrest and indictment under the Espionage Act of WikiLeaks publisher Julian Assange, who for three years as been incarcerated in the maximum security Belmarsh Prison in London, awaiting extradition to the United States. The Russian invasion of Ukraine has given the U.S. the excuse it needed to launch an economic war against Russia, which so far is backfiring, to try to bog Russia down in a quagmire with continual arms shipments to Ukraine, and also to launch an information war, not only against Russia, but against U.S. and U.K. domestic dissent. Our guests today have all been either censored or smeared, or both as they are among the leading dissidents in the West today: They are George Galloway, Chris Hedges, Jill Stein and Scott Ritter.

SEASON 2 EPISODE 27: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:43) SPECIAL COMMENT: Uh-oh. Somebody told Trump about the 14th Amendment and he's terrified And we know who terrified him. The Wall Street Journal published a 900-word editorial exactly 77 minutes before Trump's post and it is aptly titled “The 14th Amendment Trump Panic” because while the Journal usually has the confidence and arrogance and factuality of Marie Antoinette apocryphally talking about dessert, this time the lead fascists Chez Murdoch sound really scared. They have resorted to the argument that even if the 14thAmendment doesn't JUST apply to people who literally fired a gun at the flag or those who instructed them to, it can't apply to January 6th because January 6th wasn't a REAL insurrection because… uh… it didn't SUCCEED. 14-3 advocates are quote “willing to put democracy at risk in order to save it. But U-S institutions held up reasonably well despite the strains of the Trump Presidency, even the events of January 6. The transfer of power took place on schedule…the rioters and organizers are being punished, often severely…” In other words: whaddya mean ATTEMPTED murder? What kind of crime is THAT? Either there's murder, and you go to jail, or there isn't murder, and you go free. Am I right? Trump bleated about socialists and democrats and election interference and who will get to tell him? The Disqualification clause was in essence created to keep the Vice President of the confederacy out of the Senate. After he won. As a DEMOCRAT. In 1866. And Alexander Stephens had been convicted of NOTHING. He was arrested for treason on May 11th, 1865, released from prison in October without even going to trial. In 1919, 14/3 was used to keep a Congressman-Elect, Victor Berger of Wisconsin – literally an actual member of the Socialist party – out of the House because he had been convicted of violating the Espionage Act during the 1st World War because he opposed U-S entry into it. And just last year local New Mexico official Cuoy Griffin was bounced by 14/3 after nothing more than a misdemeanor conviction for trespassing. The point of course is that Stephens was kept out even though he was never convicted of anything, never even TRIED for anything, and he was readmitted only after a Congressionally-approved amnesty. Trump doesn't understand these nuances but like the wild animal he is he can smell fear, and there's nothing but fear in the WSJ editorial. Press the point. Plus we knew Mark Meadows had confessed to the Georgia judge last week while trying to get his trial moved to Federal Court. We had no idea how MUCH he had confessed, and how screwed he is, and how his only option may be to cut a deal with Fani Willis. He was arrested, tried and convicted. And then he won a seat in Congress. Twice. Congress, invoking the 14th Section 3, told him that he couldn't be seated. Two year later, he won again. And served another three terms in Congress. Now, in 2023, a Florida barrister has filed a Federal complaint against Donald Trump claiming that under the 14th Amendment he (Trump) is “not eligible to run” for President. The criminal charges against Donald Trump continue to pile up.On July 27, a superseding indictment was filed in the classified documents case against Trump, adding three additional charges to the 37 originally filed in June. Five days later, Special Counsel Jack Smith filed a new indictment over the former president's efforts to overturn the results of the 2020 election.The superseding indictment in the classified documents case alleges that Trump violated the Espionage Act by retaining a classified document described as a “presentation concerning military activity in a foreign country,” at his golf club in Bedminster, New Jersey, and that Trump conspired with two associates, Carlos De Oliveira and Walt Nauta, to obstruct justice by attempting to delete security camera footage at Mar-a-Lago in order to conceal it from the FBI and a grand jury. Joining the show to discuss the additional charges in the classified documents case is David Aaron. David is a Senior Counsel in the Washington, D.C. and New York offices of the law firm Perkins Coie. Before joining private practice, David was a prosecutor in the Justice Department's National Security Division, where he prosecuted Espionage Act violations and saw how the process works from the inside. In June of 2023, Donald Trump was charged with 37 counts of alleged mishandling of classified documents, as well as obstruction of justice. Of those 37 counts, 31 are alleged violations of the Espionage Act. Now, since its passage after World War I, thousands of people have been investigated for violating the Espionage Act, including Julian Assange, Daniel Ellsberg, and Donald Trump. However, only two people have been executed for violating it during peacetime; Ethel and Julius Rosenberg. This episode features Anne Sebba, author of Ethel Rosenberg: A Cold War Tragedy, and Jake Kobrick, Associate Historian at the Federal Judicial Center. It explains the Espionage Act of 1917, the accusations against the Rosenbergs, the twists and turns of their trial, and their execution in 1953.

This week on the Mark Levin Show, Senator Chuck Grassley on the Senate floor announced that the 1023 form confirmed there are 17 secret recordings of Joe Biden, Hunter Biden, and a Burisma executive who allegedly paid Biden. The recordings were kept as an insurance policy by the Burisma executive, whose name was redacted on an unclassified document. This shows why President Trump was indicted on bogus charges; they knew the knowledge of these tapes would come out and covered up for the Biden crime family yet again. Also, Congress passed the presidential records act because they decided presidential records should not belong to a president on their way out the door and have only existed since 1981 and were enacted under President Reagan. Before then, a president could take anything they wanted with them, including classified information. The Espionage Act could have been applied to Lyndon B Johnson and Jimmy Carter, and now Joe Biden for stealing documents while Vice President, but never was and won't be for Biden under this Department of Justice. We know all about Hillary Clinton's classified documents, destruction of records, and perjury, but was never charged despite doing it over and over again. Not a single President or Vice President has been charged with violating the Espionage Act until now with Donald Trump. When President Biden says he had no role in the Donald Trump documents case – he's a liar. On Thursday's Mark Levin show, Bill Barr was Attorney General before and after Hillary Clinton's private server with classified information and her cover-up by destroying documents and smashing cell phones yet chose to do nothing about it. Now his purpose in life is to be a Donald Trump attack dog, and he is welcomed with open arms by the media to cheer on Trump's federal indictment over obstruction charges even though his reasoning goes around in circles. Hillary Clinton, Lyndon B Johnson, and Joe Biden did far worse than Trump but were never investigated under the Espionage Act. There is not any time in the history of the statute, since 1917, that it would ensnare a President, Vice President, or cabinet secretary. Also, President Biden is selling out the United States of America to Iran, whereas Donald Trump was as close as could be to toppling their Islamonazi regime. The Biden Administration is working on another deal with Iran, which is backed by China, Russia, and North Korea; an oral agreement where billions of dollars would be given to Iranians in exchange for a promise for them to stop doing what they're doing. We did the same thing with North Korea, and now they have ICBMs with nuclear warheads. If Iran takes the final step, it will own the Middle East. A deal like this is supposed to be a treaty, which involves the Senate in order to approve, because if we are going to have a treaty with another country the body politic must be involved because it affects all of us. On Friday's Mark Levin show, the Federal indictment of Donald Trump shows just how political the Department of Justice is. The Espionage Act was never intended to apply to a president or ex-president, because the president is the executive branch and determines what is or is not classified and not bound by regulations of any department. Despite Hillary Clinton and her lawyers deleting emails subpoenaed by Congress and destroyed cell phones with a hammer, she was never indicted by the DOJ for actually breaking the law. The Presidential Records Act paves the way for how presidents handle documents, and some presidents used to take all of their documents, but only Trump is being targeted for keeping what belongs to him. The charges against Trump are so outrageous that they carry sentences so long that he would die in prison, which is exactly what Democrats want.
