What's behind prospective entrustment decisions? In this episode, I feature a paper by Schumacher and colleagues who explored the factors that influence and determine prospective entrustment decisions made by members of such committees. And they found that trainees' ability to know limits and seek help are the foundation of such decision-making. Full citation: Schumacher, D. J., Michelson, C., Winn, A. S., Turner, D. Negligent entrustment is a cause of action in United States tort law which arises where one party ("the entrustor") is held liable for negligence because they negligently provided another party ("the entrustee") with a dangerous instrumentality, and the entrusted party caused injury to a third party with that instrumentality. The cause of action most frequently arises where one person allows another to drive their automobile. General principles. One of the earliest reported cases under this cause of action, the 1915 Mississippi case of Winn v Haliday, concerned the negligence of the father in entrusting a dangerous agency to a son known to be negligent, based on the allegation that the appellant knew his son to be given to 'joyriding'. The key allegation that must be proven in such a case can be described as follows: A plaintiff who invokes that doctrine must present evidence which creates a factual issue whether the owner knew, or had reasonable cause to know, that he was entrusting his car to an unfit driver likely to cause injury to others. Furthermore, in order to impose liability upon the owner, the plaintiff must prove that the negligent entrustment of the motor vehicle to the tortfeasor was a proximate cause of the accident. Negligent entrustment is generally found where the entrustee had a reputation or record that showed his propensity to be dangerous through possession of such an instrumentality. Where the claim is against an employer, the employer will be held liable if the entrustee's record was known to the employer or would have been easily discoverable by that employer, had a diligent search been conducted. For example, suppose a bus company hires a driver who has a record of reckless driving, which the company could have learned of through a search of publicly available records. The company will be liable for the negligent entrustment of the bus to that driver, if the driver is in an accident. Similarly, if A lends his handgun to B, knowing that B has a propensity for violence, A may be held to have negligently entrusted the gun to B when B uses the gun to shoot someone during an argument. However, such cases are often harder to prove than negligent entrustment cases involving employment, because judges and juries are less likely to find that an entrustor had a duty to check on the publicly available records of an entrustee who was merely a friend. Evidence in such cases is usually presented through testimony about the entrustor's knowledge of the entrustee's reputation for violence, and of specific acts of violence committed by the entrustor. In the law of torts, malpractice, also known as professional negligence, is an "instance of negligence or incompetence on the part of a professional". medical professionals lawyers financial professionals architects engineers --- Send in a voice message: https://anchor.fm/law-school/message Support this podcast: https://anchor.fm/law-school/support
The Sutra of Ksitigarbha's Fundamental Vows: A Colloquial Translation
“O Ksitigarbha! Today, I earnestly entrust to you these celestial beings and humans: In the future, if there are celestial beings or virtuous men and women who plant a few virtuous roots according to the Buddha-dharma, even if these virtuous roots are as small as a strand of hair, a particle of dust, a grain of sand or a droplet of water, you will apply your miraculous power to swiftly rescue them and protect them. Be sure that they will gradually make the vows to pursue the Bodhi and follow the unsurpassed path of Mahayana. Do not let them get lost on the path, thus forgetting their original vows because of the regrettable regression.”

FOR FULL SHOW NOTES GO HERE :) Salvation in Christianity, or deliverance or redemption, is the "saving [of] human beings from death and separation from God" by Christ's death and resurrection. In Acts 16:31 it says: They replied, “Believe in the Lord Jesus, and you will be saved—you and your household.”In Acts 4:12 it says: Salvation is found in no one else, for there is no other name under heaven given to mankind by which we must be saved. So we see what a gift our salvation is, we talked about in the last episode the gift of the gospel….well the gospel is what led us to this gift of salvation. It can be put in simpler terms ….The bottom line is that Jesus did for us something that we could never do for ourselves. — “For it is by grace you have been saved, through faith – and this is not from yourselves, it is the gift of God – not by works, so that no one can boast.” (Eph. 2:8-9)Something else we have to remember is because this was a gift given to us by God, it is now an opportunity for a relationship with him. To know him intimately. A relationship to grow, build, and receive the ability of discernment. How do we do this? How do we grow and build a relationship with the Lord? In practical terms, time, effort, an abiding attitude, submission, surrender, faith, ultimately trusting him, putting him OVER every single thing & person, studying his word is how you will get to know his character, his love for you, his will for you but not just for you but for the ultimate plan of His kingdom. Will you understand everything? NO, but you can in James he tells us we can ask for Wisdom for the glory of the Lord, not just for our own personal gain in knowledge. We are called to be women of God, and that means falling so in love with Him that we know his word inside and out. THAT IS NURTURING our salvation. For FULL SHOW NOTES go opt in HERE:WHAT IS THE GOSPEL? - The word Gospel means “Good News” The gospel is profound but simple. The Gospel is the telling of our brokenness (Genesis 3) through our sins and God's goodness and mercy, and this gracious gift he gives through his only son, Jesus that results in an “in awe” response. We are saved by grace only through faith and that means rest in that and in the grave Jesus Christ showed us on the Cross when he was crucified for our sins so that we could have a relationship with God. Ephesians 2:8-10 - who we are is thisNotes here - We have all sinned and fallen short of the Glory of God - Romans 3:23 and for this the wages of our sin is death as it says in Romans 6:23 And so with the sin from the beginning and then the fall, God wanted to buy us back away from the death of sin and so he sent his ONLY son to live here on earth a perfect life to die for us on the cross for our sins to be fully written off. He paid the bill for us. Jesus was tempted in every struggle like we are and he chose righteousness and chose holiness, he lived sinlessly. He was tempted but still chose to resist it all for the sake of us that we would have a relationship with God and a seat at the table of Eternal life in Heaven. LET'S look at Ephesians 2:8-10 this is the gift of God of Jesus Christ dying on the cross for our salvation to be possible.Shop the $5 & $10 sale while it lasts at the Daily Grace Co. here! Part Two: The Lotus Sutra of the Wondrous Dharma.Chapter 22, Entrustment
Negligent entrustment is a cause of action in tort law that arises where one party (the entrustor) is held liable for negligence because they negligently provided another party (the entrustee) with a dangerous instrumentality, and the entrusted party caused injury to a third party with that instrumentality. The cause of action most frequently arises where one person allows another to drive their automobile. Quasi-tort is a legal term that is sometimes used to describe unusual tort actions, on the basis of a legal doctrine that some legal duty exists which cannot be classified strictly as negligence in a personal duty resulting in a tort nor as a contractual duty resulting in a breach of contract, but rather some other kind of duty recognizable by the law. It has been used, for example, to describe a tort for strict liability arising out of product liability, although this is typically simply called a 'tort'. Although it is not to be found in most legal dictionaries, it has been used by some scholars such as Sri Lankan Lakshman Marasinghe. Lakshman proposes that the doctrine provides legal relief that falls outside tort or contract, but with some of the characteristics of tort or contract, as can be found in restitution (including unjust enrichment), equity (including unconscionable conduct), beneficiaries under a trust of the benefit of a promise, people protected by the valid assignment of promise, fiduciary duty, and contracts of insurance. An ultrahazardous activity in the common law of torts is one that is so inherently dangerous that a person engaged in such an activity can be held strictly liable for injuries caused to another person, even if the person engaged in the activity took every reasonable precaution to prevent others from being injured. In the Restatement of the Law 2d, Torts 2d, the term has been abandoned in favor of the phrase "inherently dangerous activity." --- Send in a voice message: https://anchor.fm/law-school/message Support this podcast: https://anchor.fm/law-school/support
The tort of negligent infliction of emotional distress (NIED) is a controversial cause of action, which is available in nearly all U.S. states but is severely constrained and limited in the majority of them. The underlying concept is that one has a legal duty to use reasonable care to avoid causing emotional distress to another individual. If one fails in this duty and unreasonably causes emotional distress to another person, that actor will be liable for monetary damages to the injured individual. The tort is to be contrasted with intentional infliction of emotional distress in that there is no need to prove intent to inflict distress. That is, an accidental infliction, if negligent, is sufficient to support a cause of action. Negligence in employment encompasses several causes of action in tort law that arise where an employer is held liable for the tortious acts of an employee because that employer was negligent in providing the employee with the ability to engage in a particular act. Four basic causes of action may arise from such a scenario: negligent hiring, negligent retention, negligent supervision and negligent training. While negligence in employment may overlap with negligent entrustment and vicarious liability, the concepts are distinct grounds of liability. Negligent entrustment compared. Negligent entrustment arises where the entrustor is held liable for negligence because they negligently provided the entrustee with a dangerous instrument, and the entrusted party caused injury to a third party with that instrument. Where such a claim is brought against an employer, the employer will be held liable if the entrustee's record was known, or would have been easily discoverable, to the employer. For example, if a bus company hires a driver who has a record of reckless driving, of which the company could have learned through a search of publicly available records, the company would be liable for the negligent entrustment of the bus to that driver, should the driver cause an accident. Negligent entrustment differs from negligent hiring, retention, supervision, and training in two key respects. First, negligent hiring and the related torts require the employment itself of the tortfeasor causing the injury, whereas a party can be held liable for negligent entrustment to any person. Second, an employer can be found liable for negligent hiring even without provision of any dangerous instrument to the employee. However, where an employer hires an unqualified person to engage in the use of a dangerous instrumentality, as in the above example with the bus driver, the employer may be liable for both negligent entrustment and hiring. --- Send in a voice message: https://anchor.fm/law-school/message Support this podcast: https://anchor.fm/law-school/support
