The tort of negligent infliction of emotional distress (NIED) is a controversial cause of action, which is available in nearly all U.S. states but is severely constrained and limited in the majority of them. The underlying concept is that one has a legal duty to use reasonable care to avoid causing emotional distress to another individual. If one fails in this duty and unreasonably causes emotional distress to another person, that actor will be liable for monetary damages to the injured individual. The tort is to be contrasted with intentional infliction of emotional distress in that there is no need to prove intent to inflict distress. That is, an accidental infliction, if negligent, is sufficient to support a cause of action. History. NIED began to develop in the late nineteenth century, but only in a very limited form, in the sense that plaintiffs could recover for consequential emotional distress as a component of damages when a defendant negligently inflicted physical harm upon them. By 1908, most industrial U.S. states had adopted the "physical impact" form of NIED. However, NIED started developing into its more mature and more controversial form in the mid-20th century, as the new machines of the Second Industrial Revolution flooded the legal system with all kinds of previously unimaginable complex factual scenarios. Courts began to allow plaintiffs to recover for emotional distress resulting from negligent physical injuries to not only themselves, but other persons with whom they had a special relationship, like a relative. The first step, then, was to remove the requirement of physical injury to the actual plaintiff while keeping the requirement of physical injury to someone. In the 1968 landmark decision of Dillon v Legg, the Supreme Court of California was the first court to allow recovery for emotional distress alone – even in the absence of any physical injury to the plaintiff – in the particular situation where the plaintiff simply witnessed the death of a close relative at a distance, and was not within the "zone of danger" where the relative was killed. A 2007 statistical study commissioned by the Court found that Dillon was the most persuasive decision published by the Court between 1940 and 2005; Dillon has been favorably cited and followed by at least twenty reported out-of-state appellate decisions, more than any other California appellate decision. The next step after Dillon was to make optional the element of another person (so that the injury could be to anything where it would be reasonably foreseeable that such injury would cause some person emotional distress). The first such case was Rodrigues v State, in which the Supreme Court of Hawaii held that plaintiffs could recover for negligent infliction of emotional distress as a result of negligently caused flood damage to their home. This is generally considered to be the true birth of NIED as a separate tort. Twelve years after Dillon, California expanded NIED again, by holding that a relative could recover even where the underlying physical injury was de minimis (unnecessary medications and medical tests) if the outcome was foreseeable (the breakup of the plaintiffs' marriage as a result of the defendants' negligent and incorrect diagnosis of a sexually transmitted disease). In 1994, the U.S. Supreme Court for the first time recognized NIED as part of federal common law, by holding that railroad workers could pursue NIED claims against their employers under the Federal Employers Liability Act. The Court recognized only the pre-Dillon form of NIED, though, in that the plaintiff had to be within a zone of danger to recover in the absence of physical injury. Jack Thomas Smith made his feature film directorial debut with the psychological thriller “Disorder.” He was also the writer and producer of that film. “Disorder” opened as a limited theatrical release in the United States in the summer of 2006 and was later released on DVD by Universal/Vivendi and Overseas; it screened at the Cannes Film Festival and the Raindance Film Festival in London. Inspired by the films of George A. Romero, Stanley Kubrick, Brian De Palma, and John Carpenter, Smith wrote and directed a handful of short films as a teenager, which led to a career as a film producer and director. He wrote, produced, and directed the dark thriller “Infliction,” which dealt with the horrors of child abuse and its long-term effects. He also created the documentary TV series “War Heroes,” hosted by Benghazi hero Kris Paronto and directed and co-produced the Newsmax documentary, “9/11: The Day That Shook the World.” Mandy Del Rio has worked on feature films, music videos, and artist promotion. Del Rio is also the host and producer of the cable TV talk show “The Indie Lounge” and served as an executive producer of the documentary TV series “War Heroes” and the Newsmax documentary “9/11: The Day That Shook the World,” which premiered on Friday, September 10th, 2021. The tort of negligent infliction of emotional distress (NIED) is a controversial cause of action, which is available in nearly all U.S. states but is severely constrained and limited in the majority of them. The underlying concept is that one has a legal duty to use reasonable care to avoid causing emotional distress to another individual. If one fails in this duty and unreasonably causes emotional distress to another person, that actor will be liable for monetary damages to the injured individual. The tort is to be contrasted with intentional infliction of emotional distress in that there is no need to prove intent to inflict distress. That is, an accidental infliction, if negligent, is sufficient to support a cause of action. Negligence in employment encompasses several causes of action in tort law that arise where an employer is held liable for the tortious acts of an employee because that employer was negligent in providing the employee with the ability to engage in a particular act. Four basic causes of action may arise from such a scenario: negligent hiring, negligent retention, negligent supervision and negligent training. While negligence in employment may overlap with negligent entrustment and vicarious liability, the concepts are distinct grounds of liability. Negligent entrustment compared. Negligent entrustment arises where the entrustor is held liable for negligence because they negligently provided the entrustee with a dangerous instrument, and the entrusted party caused injury to a third party with that instrument. Where such a claim is brought against an employer, the employer will be held liable if the entrustee's record was known, or would have been easily discoverable, to the employer. For example, if a bus company hires a driver who has a record of reckless driving, of which the company could have learned through a search of publicly available records, the company would be liable for the negligent entrustment of the bus to that driver, should the driver cause an accident. Negligent entrustment differs from negligent hiring, retention, supervision, and training in two key respects. First, negligent hiring and the related torts require the employment itself of the tortfeasor causing the injury, whereas a party can be held liable for negligent entrustment to any person. Second, an employer can be found liable for negligent hiring even without provision of any dangerous instrument to the employee. James Stinson And Gerald Donald - Afrofuturist Detroit Electro Special A 1h special from December 2018 on Gerald Donald and James Stinson, the creators of Drexciya, Dopplereffekt, Transllusion, Der Zyklus, Arpanet, Japanese Telecom, and many more cool projects. James Stinson died of heart problems in 2002, but this mix includes Jack People's Laptop Café, which was posthumously released last year on clone's aqualung series sublabel. The mix also includes very good 2015 remasters of Drexciyan classics Wavejumper and Black Sea. Another reason to make the special was the mainstream attention that afrofuturism and black science fiction gathered in 2018 with the release of Marvel's Black Panther. Clinton McCleary wasn't working in games before he started Caustic Reality and his debut game Infliction. In fact it was a redundancy at work that prompted him to start working on his game over 3 years, which lead to award nominations, PAX Australia indie showcase selection and a story that really resonates with people. Infliction is a horror first person narrative exploration game that draws on Clinton's own life experiences to make something both horrifying and deeply relatable. Infliction is available now on Steam.   An Australian Senate standing committee which carried out an inquiry into loot boxes, has just handed down it's report into "Gaming micro-transactions for chance-based items". It looks like loot boxes might soon need stricter guidelines if they are to be allowed in video games in Australia, but the story isn't over yet. Elizabeth Ashford is senior lecturer in moral philosophy at the University of St Andrews. She did her MA at UNC Chapel Hill and her BA and DPhil at Oxford University, and was awarded her DPhil in 2002. Her main research interests are in moral and political philosophy. She has recently finished a contribution to UNESCO Volume I, Freedom from Poverty as a Human Right (OUP forthcoming), and her current research project is to develop a book on utilitarian and Kantian conceptions of impartiality and of rights. During the academic year 2005-6 she was a Visiting Faculty Fellow in Ethics at the Harvard University Edmond J. Safra Center for Ethics, and the following summer she was an H.L.A. Hart Visiting Fellow at the Oxford University Centre for Ethics and the Philosophy of Law. Matty is liking it, but has some reservations and Stevil is sold, and is happy John Carpenter is writing it. Stevil had the chance to speak to Jack Thomas Smith about his new movie Infliction. The movie is a story of two brothers on a heinous crime spree, as told through "assembled footage". This movie is a must-see!  Terry Gilliam is in the news, as casting is announced for the delayed 'Don Quixote'. Our fingers are crossed that the third time will be the charm for Gilliam, and this movie will made.  The Marvel trailer for Avengers:Age of Ultron leaked last week, and the gang from Convicted Cinephiles were giddy like school girls.
