It's Tuesday on KITM and whether you want it or not (and you want it) David Waldman and Joan McCarter are here to present the latest in news and opinion. Horrible things have been happening in Israel and Palestine, for Israelis and Palestinians, for quite some time now. But in the fog of war, where can you turn for valid, accurate information when even your favorite porn stars can't be trusted? WELL NOT TWITTER. It's no longer ethical nor sensible to share tweets anymore. Also, all the cool people have left. Cut it out. Blue checks are destroying the world, at least the bits they have contact with. Twitter has failed. Speaking of failures, look who's trying to sneak back to work — previous interim House Speaker Kevin McCarthy! Right when Patrick McHenry was getting a feel for the gavel too. It's only been a week but going back to Kev would feel like surrendering to the commies for MAGA. Whether Republicans are looking for MTG or AOC, Nancy Mace has got them covered. Meanwhile, Moms for Liberty is finding its talented clappers to be no match for authentic grassroots clapback. Florida is finally returning to releasing daily COVID-19 information. North Carolina Republicans are creating a “Secret Police Force”, while a St. Louis Cop sabotaged his own cases because he didn't like the prosecutor.

By a 2-0 decision, voting along ideological lines, David Waldman and Greg Dworkin decided on making a Monday KITM: The Supreme Court ended affirmative action. Americans are divided on the court's colorblind decision, literally by shade. Clarence Thomas gifted the US military and penal systems the Black people they need, well, for their own good, and to finally win that argument that he had back in college. Also, to teach Anita Hill, Ketanji Brown Jackson, etc. a thing or two. Justice Jackson saw through all that and let Thomas know. Of course, these dissents are just liberal tears if nothing is done. It's the era of judicial “pretzeling”… if that means lying and omissions to justify decisions. North Carolina Republicans are too extreme for even this Supreme Court and are still planning to burn it all down following the court's decision. The first thing Jack Smith will do is come for the Lawyers. Will Bidenomics both help out people in rural communities… and convince rural voters to vote Democratic?

Biden and members of congress are set to meet today. How close are they to compromise? And if they can't, can Biden just ignore the debt ceiling? Some legal scholars say yes. Then: As we predicated, CNN totally screwed up their Trump town hall. We'll size up the arguments for and against their decision to “platform” Trump — and give you our take. Finally, Elon Musk is under fire for suppressing speech in Turkey on the eve of a critical election. Is this self-proclaimed free speech hero prioritizing his wallet over his values? Did a Walgreens' employee in Nashville, Tennessee call the police in response to shoplifting? No, they followed two women to their car and resorted to shooting them – one was seven months pregnant. This is the type of police activity we should be seeing - responding to crimes being committed. If individuals are allowed to dole out justice on the streets, what's the point of US state and federal court system? Between this and the recent school shooting, will we ever see reasonable gun control? Racism in America and gun violence in America seem to go together, and there's an FBI investigation into Oklahoma officials threatening lynching and murder. Will there be accountability? Justin Parmenter is a CMS teacher and public school advocate. He says the new "Choose Your School, Choose Your Future" bill in the General Assembly offers the wrong kind of choice. "When your choices have a negative impact on the education that others are receiving, it's not just about your own personal choice. And so I think this approach is depleting resources that we really need in our traditional public schools," Parmenter said on WCNC's Flashpoint. On Wednesday, North Carolina Republicans celebrated what would be the largest expansion of the state's private school voucher program since it was created, saying all families should qualify for at least some money regardless of income. Senate Bill 406 would remove the program's current income caps, replacing them with a sliding scale that would let any family get a voucher, called an Opportunity Scholarship, of up to $3,246. North Carolina Republicans scored big last week when Democratic Rep. Tricia Cotham decided to change parties. Her bombshell decision gives Republicans a veto-proof majority in the chamber, making it easier for them to write their agenda into the law books. Cotham vows to hold onto some of the beliefs that got her elected to a deep-blue district in the Charlotte suburbs. That has political observers wondering: Will she flip on any hot-button issues? WRAL State Government Reporter Will Doran discusses her campaign promises on abortion, guns and schools — and whether they might change.

North Carolina Republicans have scrapped the state's long-lived pistol permit requirement, aided by the absence of several Democrats, which gave Republicans the numbers they needed to overturn Governor Roy Cooper's veto for the first time since Republicans lost their veto-proof super majorities in the 2018 elections. In this episode, WRAL’s state government reporter Travis Fain explains what this means for gun purchasers and owners, and how it is shaped by the political landscape of our state.

The US Supreme Court will hear a key case involving redistricting in North Carolina that could have huge implications for the rest of the country, including California. The outcome of this case could overturn California's independent redistricting commission and affect how elections are run, from coast to coast. We are talking about Moore vs. Harper, a case in which the high court will decide whether North Carolina's state Supreme Court was right to overturn gerrymandered district maps drawn by the Republican-controlled state legislature, and whether a widely debunked legal theory known as the “independent state legislature” doctrine is actually legitimate. Four of the justices on the US Supreme Court voted to hear this case presumably the four conservatives who have been supportive of this theory in the past, and if a court majority sides with the North Carolina Republicans and rules that state legislatures have complete control of elections, it could open the door to some serious unintended consequences and really wreak havoc on the future of elections. Audio of Justice Kagan's dissenting opinion in Rucho v. Common Cause (2019). Last episode, I read the 2019 majority opinion Rucho v. Common Cause - a case in which a three-judge District Court ruled that North Carolina's 2016 congressional district map was the product of Republican-directed partisan gerrymandering, enjoining the state from using the map after November 2018. North Carolina Republicans appealed the decision to the Supreme Court. The Court consolidated Rucho with a very similar gerrymandering case out of Maryland - only that case was at the direction of Democrats. In the 5-4 majority opinion, split along their own ideological and partisan lines, the majority held that partisan gerrymandering claims are not justiciable because they present a political question beyond the reach of the federal courts. Today I'll be reading the dissenting opinion in this Supreme Court case which held that - not only is partisan gerrymandering within the Court's reach - ignoring it ultimately robs Americans of their most fundamental constitutional rights: the rights to participate equally in the political process and to choose their political representatives - not the other way around. Access this SCOTUS opinion and other essential case information here. Music by Epidemic Sound.

A three-judge District Court ruled that North Carolina's 2016 congressional district map was the product of partisan gerrymandering, enjoining the state from using the map after November 2018. North Carolina Republicans appealed the decision to the Supreme Court. In a 5-4 opinion, split along their own ideological and partisan lines, the court held that partisan gerrymandering claims are not justiciable because they present a political question beyond the reach of the federal courts. However, the majority opinion is 34 pages long - which seems like an awfully long reach for an argument that is beyond their reach. A significant portion of these pages seem to argue that partisan gerrymandering is simply the way it is in American politics and that, unless such gerrymandering is racial and in violation of Section 2 of the Voting Rights Act, it's all just part of the game. Now, that's a lot of arguing against a claim that the majority holds is simply none of their business. In the next episode I'll be reading the dissenting opinion in this case in which the minority called-out the Court for ignoring the opportunity to address a critical question involving the violation of “the most fundamental of . . . constitutional rights: the rights to participate equally in the political process."
