What did Alexander Hamilton tell the Marquis de Lafayette on July 21, 1780? Probably not that his letter would be the subject of a civil forfeiture case. Yet that came to pass in the First Circuit, and IJ attorney Bob Belden explains why it turns out the family that owned the letter were throwing away their shot. Meanwhile in the Second Circuit a fire on a movie set turns into a First Amendment retaliation claim. Kirby Thomas West joins us not to warn of the dangers of shouting fire, but what a fire chief who is your boss might do to you if you speak up on other topics. Specht v. (33:53) Charles mentions where most insurance agents are focused. (51:51) Tweetable Quotes: “When I got into the business 20 years ago there wasn't a Facebook, there wasn't YouTube, there weren’t smartphones, there weren't those things. It’s a different world  today and you have to be able to market, brand and script yourself completely different. Really begin to attract the insurance buyer that you're looking for. It's just different, you really have to specialize in certain things.” - Charles Specht “Without the broker of record letter, the insurance buyer has nothing. They have to wait until renewal to make that switch. It is the insurance buyer’s power. Those agents who don't like it might say, well, you're stealing my work. No, I'm not stealing your work, I'm just going to go ahead and give them the right service that they need.” - Charles Specht “If somebody is not good at making phone calls, I'm not gonna try and say cold calling is your new thing. It is just not going to work in the long run. So, everybody's different, every agency is different. The services they have are different and their geographic location is different.” - Charles Specht Resources Mentioned: David Carothers LinkedIn Kyle Houck LinkedIn Florida Risk Partners The Extra 2 Minutes Charles Specht LinkedIn ConstructiveRisk.com

Cultivation Podcast

3 Must-Hear Takeaways   Have a voice in your life who can identify your growth. Measure your growth by setting a baseline and being specific about effort. Celebrate your progress to train your mind for motivation.   Season 5 of the Cultivation Podcast is all about words to live by and this episode’s word is “Growth”. Tom explains his passion for growth and why we need to be growing in our lives.   Growth is defined as progressive development; an increase or expansion. Ask yourself how are you growing your mind, soul, skills, purpose, or possibilities? Growth should be happening, you should not be in the same place!   Growth gives us more independence and freedom? What are you dependent on? How do you need to grow and expand your emotions, understanding, and appetite for adventure?   The hard part is that we don’t often see our own growth. We need people close to us who can give us perspective and identify areas where we grew. Find the voice who can identify those areas of growth in your life.   Measure your growth. Identify your current reality to set a baseline for any area you want to grow in. Be specific about how or what effort it will require.   Then, you need to celebrate progress to train your mindset and build motivation. That is a key element because it keeps us motivated to keep growing.   My friend David A. Specht says that our brains are meant to keep growing. Maybe you’re not experiencing the fullness of life because you’ve stopped growing. We have to keep learning and growing.   I ask you, when was the last time you learned something for the first time?  Find More at our Website

The digital age has thrown questions of representation, participation and humanitarianism back to the fore, as machine learning, algorithms and big data centres take over the process of mapping the subjugated and subaltern. Since the rise of Google Earth in 2005, there has been an explosion in the use of mapping tools to quantify and assess the needs of those in crisis, including those affected by climate change and the wider neo-liberal agenda. Yet, while there has been a huge upsurge in the data produced around these issues, the representation of people remains questionable. Some have argued that representation has diminished in humanitarian crises as people are increasingly reduced to data points. In turn, this data has become ever more difficult to analyse without vast computing power, leading to a dependency on the old colonial powers to refine the data collected from people in crisis, before selling it back to them. Mapping Crisis: Participation, Datafication and Humanitarianism in the Age of Digital Mapping (University of London Press, 2020) brings together critical perspectives on the role that mapping people, knowledges and data now plays in humanitarian work, both in cartographic terms and through data visualisations, and questions whether, as we map crises, it is the map itself that is in crisis. Doug Sprecht is a Chartered Geographer (CGeog. FRGS), a Senior Lecturer (SFHEA) and the Director of Teaching and Learning in the School of Media and Communication at the University of Westminster. His research examines how knowledge is constructed and codified through digital and cartographic artefacts, focusing on development issues in Latin America and Sub-Saharan Africa, where he has carried out extensive fieldwork. He also writes and researches on pedagogy, and is author of the Media and Communications Student Study Guide. He speaks and writes on topics of data ethics, development, education and mapping practices at conferences and invited lectures around the world. He is a member of the editorial board at Westminster Papers in Communication and Culture, and the journal Anthropocenes – Human, Inhuman, Posthuman.
