The tariff fiasco is ramping up in full swing, as some people are finally beginning to realize what this will mean for our economy, and Dump pretends he signed a great new trade deal with the UK (he didn't). SCOTUS lets Dump and Hegseth remove trans people from the military, but the North Carolina Supreme Court finally has to accept the election results and swear in the democrat who won the election six months ago(!).And the Dumpster fire says he doesn't know if he has to uphold the constitution or if all people deserve due process. Seriously...And finally, the federal judge in Vermont who presided over the bail hearing this morning orders that Rumeysa Ozturk, the Tufts University grad student who was abducted by masked goons in Boston, be released from detention "immediately" and on her own recognizance with no travel restrictions. We'll see if they comply...

Breaking Brett Jensen kicks the show off by discussing two unusual but significant North Carolina Supreme Court cases—one involving chickens in a Waxhaw neighborhood and the other concerning Charlotte-Mecklenburg Schools (CMS). In one case, a family argues their chickens are household pets, protected under HOA rules. The HOA disagrees, claiming the number of chickens exceeds what could reasonably be considered pets. The debate centers on how courts should interpret the ambiguous term “household pet,” with justices questioning whether such definitions should be left to juries or clarified by law. The case raises broader concerns about property rights and the power of homeowners associations. And in another case, Charlotte-Mecklenburg Schools (CMS) is facing a lawsuit at the North Carolina State Supreme Court over its refusal to contribute to the 401(k) retirement plans of its school police officers. CMS is the only school district in the state that does not pay the required 5% into these retirement accounts, even as it continues to request millions more in funding each year from county commissioners. The CMS legal team faced tough questioning from justices, who challenged their interpretation of the law and lack of clarity on funding responsibilities. Also, Brett touches on the Carolina Panthers’ strategy heading into the NFL Draft with veteran beat writer Joe Person of The Athletic. Person expects the Panthers to focus on defense, predicting they may select Georgia linebacker Jalen Walker in the first round. Despite questions about Walker’s size as an edge rusher, the Panthers reportedly value his football instincts and versatility. Person also believes the team will likely target additional defensive positions, such as safety, in rounds two and three, given the current lack of depth on the roster. Finally, Jensen dives into Dylann Roof, the convicted Charleston church shooter, has filed an appeal seeking to have his death sentence overturned. Roof's legal team argues that there were significant errors during his trial that impacted his sentencing. They claim that Roof's mental health was not adequately considered, and they assert that his constitutional rights were violated in various ways. It's Hump Day! Sam and Emma speak with Lee Hepner, senior legal counsel for the American Economic Liberties Project, to discuss the recent overturning of net neutrality. Then they speak with Joshua Kaplan, reporter at ProPublica, to discuss his recent piece entitled "The Militia and the Mole." First, Sam and Emma run through updates on the DoJ's release of details related to Trump's Jan 6th- and Stolen Documents-related cases, mass evacuations amid wildfires in LA, Dem's retaining of the Virginia legislature, the North Carolina Supreme Court's anti-democratic move, the House's massive anti-immigration bill, DoJ action over the RealPage rent-fixing scheme and the prior weaponization of the department under Trump, Israel's ongoing slaughter of Gazans in supposed safe zones, and ACA expansion, before unpacking a recent report on the unsurprising misinformation around gender-affirming care for adolescents. Lee Hepner then joins, jumping right into an extensive history of Net Neutrality, stemming from the establishment of the Federal Communications Commission (FCC) under FDR's New Deal to preserve open networks and fair communication, with the 1996 Communications Act expanding its coverage to the internet and contributing to the arguments to expand to full Net Neutrality building under Bush before coming to fruition under Obama, only to be killed and restored by Trump and Biden respectively, all leading to the recent 6th Circuit decision to, once again, kill it. After tackling what Net Neutrality exactly is (the mandate for providers to serve websites equally) and expanding on the particular role the overturning of the Chevron Deference Doctrine played in this decision, Hepner wraps up with tactics to push back against this decision, and whether federalism will help keep these corporations in line. Joshua Kaplan then walks Sam and Emma through his extensive reporting on the far-right militia American Patriots 3% (AP3), tackling their role within the wider extremist militia ecosystem and how they used that to distance the organization from the January 6th insurrection attempt before having a wider discussion on the initial backlash (even internally) to these organizations in the wake of 1/6 before a steady rhetorical pivot from Trump and the GOP reversed the tides completely, and why that should concern us heading into a second Trump Administration with threats of mass pardoning for violent participators and organizers of 1/6. After expanding on AP3's odd “big tent” identity amid right-wing militias, Kaplan touches on his extensive conversations with a mole from AP3 and the role Facebook played in the militia's outreach, before wrapping up with the genuine threat posed by the extensive military training of these groups, both offered by the groups themselves and aided by their extensive connections to police, military, and veteran organizations. And in the Fun Half: Sam and Emma unpack the response from Mexico's President Scheinbaum to Trump's absurd statements on the US' territorial rights, the passage of the GOP's Lincoln Riley Bill with support from myriad Congressional Dems – including John “Manchin 2.0” Fetterman – to hand over immigration enforcement to the states (alongside the right to deport without criminal conviction). Chris Hayes reflects on the short history of Facebook's moderation team, John from Montreal on Trump's antagonization of US allies, and Kowalski from Nebraska parses through the future of farming amid threats to land ownership and more. On December 2, 2000, Eric Miller died in a Raleigh, NC hospital and blood tests revealed that he had been poisoned with arsenic. Police discovered that Eric's wife, Ann, was having an affair with her co-worker, Derril Willard. Derril killed himself after being questioned by police, but before he died he had a confidential conversation with his attorney. In the spring of 2004, the North Carolina Supreme Court ruled that Derril's attorney must reveal what Derril had told him about Ann's role in Eric's murder. “48 Hours" correspondent Troy Roberts reports.
