An effort called Insurrection Exposed by the Center for Media and Democracy aims to shed light on what the 2020 fake electors did and how a new crop could do the same four years later.
For this episode of Trump's Trials, NPR voting rights correspondent Hansi Lo Wang takes a look at what have been known as "fake electors" returning for the 2024 election.Four years ago, these Republican electors gathered in seven mainly swing states where Trump lost the popular vote to sign certificates that became part of a scheme by the former president and his allies to try to overturn the election results. This year's return of some of these Republicans as potential electors — confirmed in recent weeks through party filings to state election officials — raises questions about what they will do if Trump loses in their states again. AP correspondent Ed Donahue reports on a change of plea in a fake electors case.
SERIES 2 EPISODE 221: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: Looks like you can build a couple new towers and an extra moat at Kamalot: Morning Consult poll, which Trump still led a week ago today 47 to 45, now shows Vice President Harris AHEAD 47 to 46 and yes it is all within the margin of error; nevertheless it is a 3-point swing in ONE WEEK. Just as importantly: FIFTY PERCENT of voters in that poll view her favorably, 46 percent unfavorably, that's a net of +4 and in our fractured landscape that is landslide territory and nothing Biden OR Trump achieved. As Morning Consult notes her popularity score swung by twelve points since last week, driven mostly by… INDEPENDENTS. A week ago 31 percent of INDEPENDENTS viewed her favorably and now it's 48% percent. Kamala Harris is also killing it in the stodgier polls. FOX surveyed four swing states. Harris up by six in Minnesota. They're TIED in Michigan and Pennsylvania. She trails by a point in Wisconsin. The new Wall Street Journal Poll: she's cut Trump's lead from six to two Harris 47. In short, there's simply not a more CONGENIAL spot. For happily-ever-after-ing than here in Camelot. MEANWHILE TRUMP (WITH A NET FAVORABLE OF -16)? Of COURSE he meant if Christians voted for him now they wouldn't have to vote again in 2028 BECAUSE he meant there wouldn't BE elections - or maybe even more likely, there wouldn't be elections in 2028 that HE COULD LOSE. There are a lot of reasons we can be certain of this, the easiest of which is that we all UNDERSTAND that he is running because if he doesn't win the 2024 election and go to the WHITE HOUSE, he instead WILL go to prison, and he WILL die there. And if that is true in 2024 – guess what – it would ALSO be TRUE in 2028. B-Block (26:40) THE WORST PERSONS IN THE WORLD: RFK says he was rambunctious so yeah there may be more sexual assault charges. A woman named Amy Vandersteel thinks 0.4% is forty percent. And right wing nut job Bill Mitchell explains there's a replacement Joe Biden who is four inches taller and deliberately tanked the debate so the Democrats could complete their intricate scheme to get him out and Kamala in I WISH. C-Block (36:20) THINGS I PROMISED NOT TO TELL: MSNBC didn't make a big deal about it but they just hit their 28th anniversary on the air, and what I believe is the 19th anniversary of the day they fired Rachel Maddow, before I hired her back out of my own pocket.See omnystudio.com/listener for privacy information.

Welcome to Friday, Las Vegas! The news this week is almost as hot as the asphalt. First, at least four county officials are the subject of an ethics probe for accepting free tickets to last year's inaugural Formula 1 Las Vegas Grand Prix — but is that fair? Also, the charges against six prominent Nevada Republicans for submitting fake elector documents in favor of Donald Trump in the 2020 presidential election were dismissed in a Clark County courtroom. So what does this bode? And lastly, the Life is Beautiful festival “hits pause” this year as the company introduces a new format. In this episode Hawk, fresh from his COVID-19 adventure, stumbles through the maze of Donald Trump's immunity claims. Picture this: Trump, the former Commander-in-Chief and convicted felon, is essentially arguing for a "Get Out of Jail Free" card that would make even Monopoly players jealous. The Supreme Court, meanwhile, is busy trying to decide if being President is like having a lifetime supply of legal teflon.Hawk takes us on a whirlwind tour of the oral arguments, where justices pondered such pressing questions such as whether a president could order a military coup (you know, just your average Tuesday in the Oval Office). He predicts that while the Court won't give Trump total immunity, they might invent a new game show called "Is It Official or Personal?" for future presidents to play. As for Trump's other cases, it's like a legal version of Whack-A-Mole - knock one down, and another pops up.Finally, Hawk dives into Jack Smith's indictment, which reads like a political thriller with a cast of characters that would make a soap opera blush. Six unnamed co-conspirators? It's like Clue, but with fewer candlesticks and more subpoenas. Hawk wraps up by hoping for a pre-election trial, because nothing says "democracy" like deciding the fate of a presidential candidate between campaign rallies.Oh, and don't forget to buy some Pride merch at hawkmerchstore.com to support the Kaleidoscope Youth Foundation in Columbus, Ohio (kycohio.org) - all profit from the Pride Collection goes to this amazing non-profit for the month of June.Links to Judge Chutkan immunity decision and Jack Smith's J6 IndictmentJudge Chutkan immunity decision attached to this post - sourced from this article:https://storage.courtlistener.com/recap/gov.uscourts.dcd.258149/gov.uscourts.dcd.258149.171.0.pdfJack Smith's January 6th Indictment (also attached):https://www.justice.gov/storage/US_v_Trump_23_cr_257.pdf SUPPORT & CONNECT WITH HAWK- Support on Patreon: https://www.patreon.com/mdg650hawk- Support Hawk's Merch Store: https://hawkmerchstore.com- Connect on TikTok: https://www.tiktok.com/@mdg650hawk7thacct- Connect on YouTube: https://www.youtube.com/@hawkpodcasts ALL HAWK PODCASTS INFO- Additional Podcasts Available Here: https://www.hawkpodcasts.com- Listen to Hawk Droppings On Your Favorite Platform:Spotify: https://spoti.fi/3RWeJfyApple Podcasts: https://apple.co/422GDuLYouTube: https://youtube.com/@hawkpodcastsiHeartRadio: https://ihr.fm/47vVBdPPandora: https://bit.ly/48COaTBSimplecast: https://hawk-droppings.simplecast.com- Hawk Droppings RSS Feed: https://feeds.simplecast.com/pPVtxSNJ

In 2022, Georgetown University Law Center's Institute for Constitutional Advocacy and Protection and Stafford Rosenbaum filed a lawsuit against ten Wisconsin fraudulent electors, Kenneth Chesebro, and James Troupis for their efforts to subvert the 2020 election. Earlier this year, ICAP reached two settlements with the defendants, which resulted in thousands of pages of text messages, emails, and other correspondence being turned over, providing new insight into how exactly the fake electors scheme was developed and implemented in Wisconsin and across the country. Lawfare Associate Editor for Communications Anna Hickey sat down with ICAP Executive Director Mary McCord to discuss the settlements reached with the Wisconsin fraudulent electors, what new information was revealed in the thousands of pages of documents turned over, and whether the recent criminal charges filed against Kenneth Chesebro, James Troupis, and Mike Roman revealed any new information. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. In the aftermath of President Joe Biden's victory in the 2020 presidential election, Republicans in seven states where he won, including Wisconsin, banded together and cast fake electoral votes for Donald Trump. Correspondent Anderson Cooper reports on Wisconsin's fake presidential electors and interviews Andrew Hitt, an attorney and former GOP state chair, who claims he and his fellow fake electors were tricked into signing the documents. Special Counsel Jack Smith alleges the fake votes were part of a plan, orchestrated by Donald Trump and conspirators, to try to overturn the election. Margaret Brennan conducts the first interview with one of the five American prisoners freed from Iran. With 200 hostages reportedly being held in Gaza, and 13 Americans unaccounted for, Emad Shargi's harrowing story is a stark illustration of the difficulties and perils involved in bringing citizens home. After the 2020 Presidential Election, a plan was hatched in seven swing states that had voted for Joe Biden. Lawsuits challenging the election outcomes in those states continued to fail, but this plan attempted to find another path to keep Trump in office—using the Electoral College process. The idea was to create slates of electors for Trump that would oppose the duly-elected Biden electors, and to send those slates of electors to DC to be counted on Jan. 6. Then, Vice President Mike Pence was supposed to either choose the Trump electors, thereby overturning the 2020 election results, or kick the competing slates back to the states to be sorted out, thereby delaying Congress's certification of the election. It's a plan that the Jan. 6 Committee would later dub "the fraudulent electors scheme." The whole scheme relied on specific individuals in each state—the fake electors themselves. So, three and a half years later, what has happened to them? Lawfare Executive Editor Natalie Orpett spoke with Senior Editor Quinta Jurecic, who has been closely following the issue from the beginning. Last month, she published an article explaining what happened to the fake electors in these seven states with Lawfare Student Contributors Hunter Evans, Adam George, and Emma Plankey. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. The Biden administration is targeting yet another group of Trump electors from 2020, in a bid to criminalize an act that until recently was widely viewed as a legal protection on the elections. During the 2020 elections, dueling electors in several states cast their electoral college votes for Donald Trump instead of Joe Biden. This was because investigations were being carried out into possible fraud in those states, and the dueling electors would allow the vice president to choose which votes to count when the final decision was made. But despite the fact that Democrats have done this historically, the Biden administration is now alleging this was a crime. In this live Q&A with Crossroads host Joshua Philipp, we'll discuss this topic and others, and answer questions from the audience. On Wednesday, April 24th, Arizona Attorney General Kris Mayes shared a video on X, formerly Twitter, announcing that 11 Arizona Republicans and seven others have been charged for falsely certifying that Donald Trump won the state in 2020. Former President Trump was back in a New York courtroom on Monday, as Judge Merchan set a mid-April trial date for the hush money case against him brought by Manhattan District Attorney Alvin Bragg. Veteran prosecutors Andrew Weissmann and Mary McCord set expectations as the countdown to jury selection begins. Then, they turn to the appeals court decision, where Trump's bond payment was reduced to $175 million in the New York civil fraud case. Lastly, Andrew and Mary survey what to keep an eye on at the Supreme Court when it comes to his appeal on presidential immunity.
Delays persist in several of the cases against former president Trump, including in the New York case that was set to begin next week. MSNBC legal analysts Andrew Weissmann and Mary McCord detail what led to the delay in receiving documents from the U.S. Attorney in Manhattan. In a last-ditch effort to delay, delay, delay- Donald Trump's legal team submitted a motion on Monday to pause the New York trial on election interference (a.k.a. the ‘hush money' case) until the Supreme Court decides on immunity. MSNBC legal analysts Andrew Weissmann and Mary McCord break that down, and how it differs from the motion to dismiss the Florida classified documents case. Then, they highlight the $91 million bond posted by the former president in the E. Jean Carroll case, as he appeals that decision. And a look behind the curtain as Special Counsel Robert Hur testifies before the House Judiciary Committee about his report on Biden's handling of classified documents. After the settlement in Wisconsin over the fraudulent electors scheme, veteran prosecutors Andrew Weissmann and Mary McCord analyze the importance of what came to light as a result of the litigation against James Troupis, Kenneth Chesebro and 10 ‘alternate' electors. Mary was part of the team arguing the case and gives expansive context to the ongoing efforts to overturn the 2020 election. They then turn to the Supreme Court's decision on the Colorado ballot issue, and why, despite a unanimous vote, there may be dissension in the ranks. And they wrap up with a look at the timing of the Florida documents case and Trump's former CFO Allen Weisselberg's guilty plea on federal perjury charges.
