Spam represents nearly half of all global email traffic, from obnoxious ads to dire warnings of impending account closures to absurd invitations to join the Illuminati (just ask our podcast producer). It is a constant, annoying part of online life, but does it have to be that way?. Understanding the efforts to address spam in the early 2000s offers lessons for how we might regulate technologies such as artificial intelligence today. Oliver James is a California-based personal trainer, motivational speaker, literacy activist, and influencer. 00:00 Well it's been pretty big news here in the upstate. We've all heard the story about Jay Gilstrap or should we say Emmanuel Jahoo Gilstrap. He was accused of lewd behavior back in the 90s by I guess a former babysitter. was arrested in 2023. He was sentenced 00:26 to a judge, Judge G.D. Morgan Jr. imposed a three-year prison sentence that was suspended upon one day in custody. And we're hearing that Gilstrap actually entered an Alford plea. Let's find out what that is with attorney Rob Inaario. Rob, welcome to the program. Have you been following this very closely? Not very closely. I think mostly upstate it kind of. 00:55 caught me off guard. Yeah, I flew under the radar for a long time, I am aware of what's happened. Okay, so what is an Alfred plea exactly. So it goes back to a case I think from the 60's early 70's North Carolina be Alfred. Alfred was accused of murder and they offered him a plea where they would take the death penalty off the table if he pled guilty. And he. 01:25 said that he would plead guilty. ah He got 30 years and then came back and contested saying that the only reason he was pleading guilty was not because he was guilty, but because he didn't want to risk the death penalty. Okay. case went all the way up to the Supreme Court and the Supreme Court ruled that a defendant does have the opportunity to accept the consequences of a plea and enter a plea without admitting guilt. 01:53 It's similar to a no contest like with a traffic court, where most folks are probably most common with it. But it's a little different in that a judge has to find that there is a strong factual basis for the plea and everybody has to agree that if the case went to trial, more likely than not, the defendant would be found guilty. Which brings me to my next question. How do you defend yourself against something that happened 30 years ago? 02:23 And that might very well be why we have an Alfred plea in this situation. Yeah. Um, there's no or little to no forensic evidence that would be around. It's going to be a, said, she said a recollection from 30 years ago and an allegation can be enough. Uh, usually there needs to be more to it. Yeah. But if you are in somebody in a position that you didn't want, 02:50 all of your dirty laundry aired or you just didn't want even a week-long circus of a trial might be an interesting way to enter an offer plea, do the day, get it over and done, and then deal with the aftermath. Right. And this, and I'm not saying this applies to this case, but this would be like keeping your secret secret instead of all of this being exposed in court. 03:20 Correct. And then also add to it, uh it looks like the plea was to an assault and battery second degree, which can qualify for sex offender registry depending upon the circumstances, but it's not mandatory like a lewd act may be. Right. So another reason to enter the offer plea may very well be to avoid the risk of having to register as a sex offender, which, wow, that's... 03:48 not anything that anybody ever wants to have. Yeah. And it's certainly something that'll follow you around for a long, long time. And there may be reasons. I'm not familiar with any of the facts of the case, but with a 30 year old allegation, I will say that, you know, three years suspended to one day. That's something I would have a talk with my client and say, you know, at least take a 04:14 take a week, think on it, talk it over with family, figure out is this the right option for you because there's a big gamble. Yeah. And it could be a big gamble where you win, but if you lose, you lose big. Yeah. Now, he was originally charged with uh committing or attempting a lewd act upon a child under the age of 16. That is a felony. So that charge was dropped, right? Yes. 04:39 And the assault and battery second degree is a misdemeanor carrying up to three years. So with, even though he's not a convicted felon under federal firearms law, anything tha ...
