Tiffany, Mike and Beau share their thoughts on reports of Kirk Cousins planning to waive his no trade clause after the NFL Draft
According to SI.com's Albert Breer, in order to avoid a similar situation that he found himself in after signing with the Falcons, Cousins will elect to not waive the no-trade clause in his contract until after the 2025 NFL Draft. This makes sense from Cousins' perspective, as he wants to be a starting quarterback in 2025, and does not want to be traded to a team that has drafted a rookie quarterback. On the other hand, this could come back to bite Cousins, as teams may decide not to wait, and draft a rookie quarterback instead of signing one. Andy Bunker and Randy McMichael further explore the 2025 free agency cycle, and what we may end up seeing before and after the 2025 NFL draft.

Your check for arbitration fees gets delayed in the mail. Under a particularly harsh pay-or-waive provision of the California Arbitration Act, if your fee is received on day 31, too bad—your arbitration rights go Poof! Or do they? There's currently a big split among the appellate courts on this.Tim goes solo while Jeff is still in trial, covering several of the recent cases on both sides of the split.Does your arb agreement incorporate the FAA? You might be well-poised to argue it preempts the FAA.Or is the arb agreement silent on FAA, or include only a qualified reference? You're on shakier ground. There's also a separation of powers concern: Can the legislature declare that late arbitration fee payments automatically equal a waiver of arbitration rights, or is that a judicial function? Waiver is a common-law doctrine, and it's discretionary. But clearly that's not how the legislature intends it. And waiver requires fact-finding of the parties' intentions in a particular case—obviously the Legislature doesn't know what some future litigant in some future scenario “intends.”Appellate Specialist Jeff Lewis' biography, LinkedIn profile, and Twitter feed.Appellate Specialist Tim Kowal's biography, LinkedIn profile, Twitter feed, and YouTube page.Sign up for Not To Be Published, Tim Kowal's weekly legal update, or view his blog of recent cases.Other items discussed in the episode:Late payment does not defeat arbitration because that CAA rule is preempted by FAA—but Justice Baker dissents (May 30, 2024)Yet another arbitration preemption case, with 1st Dist. holding CAA's 30-day deadline survivesAnother late arbitration payment case, again holding the FAA preempts the CAAHernandez v. The 2025 Mariners. It seems like a lot of people are ok with the Mariners being “pretty good.” What happened to chasing greatness? We don't hear from Jerry, Justin or John anymore and it seems like they're in hiding. We get not wanting to face criticism, but it's part of the job, especially when you've had an offseason like this one. :30- The Kraken waived Grubauer yesterday and the plan is to send him to Coachella to try and get back on track. Have we seen the last of him in a Kraken uniform? :45- Here comes the Meat Wagon! - The Saints head coaching job is still vacant, but is there any need for them to rush to a decision? Kellen Moore is still coaching, and he seems to be their #1 choice, but nothing is locked down. - Perhaps the one benefit to hiring your head coach early is to get your pick of coordinators.

The Penguins have waived Tristan Jarry. Now this doesn't mean he is completely done with the team because he will likely go unclaimed on waivers. Is it worse than it's almost ever been? Evgeni Malkin got his house broken into over the weekend in what has become a string of burglaries in homes owned by pro athletes. Former Penguin Tyler Kennedy joined the show. TK reacted to the Tristan Jarry news as the Penguins placed their goaltender on waivers earlier today. He said being put on waivers is tough on a player no matter how much they are making. Tyler talked about the mentality of a player like Jarry and how he hasn't recovered from early season struggles. The guys asked Tyler where the Penguins go from here on the ice and at that position.

With precise rules, high stakes, and emotions running even higher, understanding child support is crucial for anyone going through a divorce.Unraveling the Intricacies of Child SupportIn this installment of our season-long look called Your Divorce Case, Seth and Pete break down the complexities of child support, explaining that it has little to do with actual child expenses. Instead, the state uses a mathematical formula based on the combined net income of both parents to determine the amount of support needed. They discuss how factors such as the number of children, parenting time, and additional expenses like health insurance premiums and uncovered medical costs impact the calculation.Questions we answer in this episode:• How is child support calculated?• What factors influence child support payments?• Can the court deviate from the child support guidelines?Key Takeaways:• Child support is based on a formula, not actual child expenses.• The percentage of financial responsibility for each parent is crucial.• Regular recurring income, such as bonuses and vested stock options, counts towards child support calculations.Seth and Pete's in-depth analysis of child support provides valuable insights for anyone navigating the complexities of divorce. By understanding the nuances of the guidelines, parents can better prepare for the financial aspects of co-parenting and ensure the well-being of their children post-divorce.Links & NotesFree Child Support Calculations on Family Law SoftwareSchedule a consult with SethGot a question you want to ask on the show?
