This Day in Legal History: John Jay First SCOTUSOn November 6, 1789, John Jay was sworn in as the first Chief Justice of the United States, marking a foundational moment in the development of the federal judiciary. Appointed by President George Washington, Jay was a prominent figure in the American founding, having co-authored The Federalist Papers and served as President of the Continental Congress. His confirmation by the Senate came just weeks after the Judiciary Act of 1789 formally established the structure of the federal court system, including the Supreme Court. At the time of his appointment, the Court held limited power and prestige, lacking even a permanent home or a defined role within the balance of government.Jay's tenure as Chief Justice lasted from 1789 to 1795 and was characterized more by circuit riding—traveling to preside over lower federal courts—than by Supreme Court rulings. Nonetheless, he helped lay the procedural and institutional groundwork for the Court's future authority. One of his few significant decisions came in Chisholm v. Georgia (1793), which asserted that states could be sued in federal court, a holding that was quickly overturned by the Eleventh Amendment. Jay also took on diplomatic duties, most notably negotiating the controversial Jay Treaty with Great Britain in 1794, which aimed to resolve lingering tensions from the Revolutionary War.Though his judicial legacy on the bench was modest, Jay's influence as the Court's inaugural leader was crucial in legitimizing the judiciary as a coequal branch of government. The Court must assess not just what the statute says, but also how to interpret the silence—IEEPA never mentions “tariffs” or “taxes”—in light of Congress's constitutional power to impose taxes and regulate foreign commerce.From a textualist standpoint, the omission of “tariffs” suggests Congress did not intend to delegate that taxing authority to the executive. Great Is Thy Faithfulness: Morning by Morning, New Mercies #RTTBROS #Nightlight"It is of the LORD'S mercies that we are not consumed, because his compassions fail not. They are new every morning: great is thy faithfulness." — Lamentations 3:22-23Some of the most beautiful songs come from the darkest places. Take the hymn "Great Is Thy Faithfulness." You'd think it was written during some mountaintop experience, some season of overwhelming blessing. But the scripture it's based on, Lamentations 3, was written by Jeremiah while watching Jerusalem burn.Let me paint you the picture: Jeremiah had spent forty years warning God's people to turn from their sin. Nobody listened. Now he's sitting in the rubble of his destroyed city, everything he'd known and loved reduced to ashes. And in the middle of that absolute devastation, he writes these words about God's faithfulness.Thomas Chisholm, who wrote the hymn in 1923, understood something of life's difficulties. He struggled with poor health most of his life and wasn't writing from a place of prosperity or ease. He was writing from lived experience, from having watched God prove faithful morning after morning, year after year, even when circumstances were hard.Here's what I love about this hymn: it's not about dramatic miracles or huge interventions. Look at the words: "Morning by morning new mercies I see." Not once in a lifetime. Not occasionally when things get really bad. Morning by morning. Every single day. It's the faithfulness of God in the ordinary moments, the daily provision, the steady presence that never wavers.I think sometimes we're looking for God to show up in the earthquake, the fire, the mighty wind, and we miss Him in the still small voice. We're waiting for the Red Sea to part when God's already providing manna for today."All I have needed Thy hand hath provided." That's a testimony to God's faithful provision of exactly what we need, when we need it. Not always what we want. Not always what we ask for. But what we need.I'm reminded of God's promise to the Israelites in the wilderness. He gave them manna every morning, enough for that day. God was teaching them to trust Him day by day, morning by morning. That's hard for us, isn't it? We want next week figured out, next month secured, next year planned. But God says, "Trust Me for today."Jeremiah was right when he wrote those words in Lamentations, and Chisholm was right when he turned them into this hymn, and it's still true today. God's faithfulness hasn't diminished one bit. His mercies are still new every morning. His compassions still don't fail. And great, truly great, is His faithfulness.So whatever you're facing today, remember: you don't need strength for next week's trial. You just need what God has for you this morning. And guess what? It's already there, fresh and new, waiting for you like manna on the ground.Prayer:Father, thank You that Your faithfulness never wavers, never fails. Tom and Darlene Chisholm on a Texas trip in 2022. Photo by Carol Nettleton. Darlene Chisholm of Albion, Michigan, is a veteran of many U.S. Lighthouse Society tours, both in the U.S. and abroad. In the course of her travels, she's photographed well over 4,000 lighthouses. Darelene was a longtime librarian in the public school system in Albion. Her husband, Tom, was president of the education association in Albion. They met at a teachers' meeting, and they were soon attending basketball games together. They were married in 1969. Darlene and Tom traveled extensively around the world until Tom passed away in 2023, visiting all seven continents. Darlene continues to travel on her own, carrying with her the memory of so many wonderful trips with Tom. U.S. Lighthouse Society Executive Director Jeff Gales co-hosts this episode. This "coddling," as Sal calls it, is a stark contrast to organizations with a stricter accountability model, and he believes it's the core reason the Yankees consistently fall short of their championship goals.
Send us a textIn previous episodes, we've chatted with some young runners who have taken on ultramarathons like the Leadville Trail 100, something that was unheard of in the ancient days when I began in the sport. While it's become less rare to see this, it's now been taken up a notch. Meet the Chisholm family of Salem, NH. Brothers Ben, Brody, Elliott, and Asher all play hockey, with the three eldest at one time playing on the same line together on their high school team. Led by their parents, the boys started off climbing in New Hampshire's White Mountains, eventually summitting all of its 48 4000-foot peaks, which is no joke in difficulty. This evolved to the family next through-hiking the entire Appalachian Trail, then the Pacific Crest Trail, and the Continental Divide Trail, each of which are thousands of miles long and take months to complete, and definitely at times challenged the limits of family togetherness. While later hiking the Arizona Trail, they learned about this thing called ultramarathoning and on a whim entered the Elden Crest 38-miler, in which second-oldest son Brody led the family to the finish line in fifth-place overall. So the next logical step of course was to return to Arizona to run the 2024 Cocodona 250. Of course. Since races like this include large swaths of hiking, the family leaned heavily on their strong through-hiking skills, a theory that bore fruit. Brody, 17 at the time, boldly had his sights on setting a course record despite having had no prior ultra experience longer than 38 miles, but has 4:30 mile speed on the track, so he could add that running ability to the mix. He learned a lot of ultramarathoning lessons, especially regarding fueling, but still astoundingly finished 12th in 75:42:42, a pace of 18:11 per mile for more than 250 miles. Meanwhile, 18-year-old brother Ben finished 34th in 87:01:50 despite battling lack of sleep and hallucinations, and mom Jennie finished as well in 103:58:03 while overcoming tibial stress fractures. Round two for the family was this year as 16-year-old Elliott attempted to usurp Brody's record as the youngest-ever Cocodona finisher, but a sickness felled his chance, and Brody also DNF'd. However, Jennie chopped more than 14 hours off of her previous time and placed as the 7th female finisher. So Elliott took on a new challenge the day before we recorded this and ran the Back Cove Backyard Ultra in Portland, ME, where he impressively ran 121 miles, running another 4.16-mile loop at the start of every hour for 29 hours, the third-most in the last-man-standing event. With Jennie and the three oldest boys of this super nice family all crammed onto a couch together for this really fun chat, we cover how they logistically pull all of this off with schoolwork and teen life in general, as well as dealing with those who have this idea that teenage boys shouldn't take on epic challenges like they have. Jazz talked about Schlittler having red cheeks last night. The Yankees DFA'd DJ LeMahieu. A Vikings player was scammed out of $240K, making deposits into accounts. In the final segment of the hour, we talked to C-Mac about the terrible callers overnight. Hour 2 - We started the hour with a few calls about callers to the station. We heard from a few young guys that listen and call. We also talked about baseball with the Mets and Yankees and how both teams seem to be back on track. C-Lo returns for an update and starts with the sounds of Jazz Chisholm hitting one of two home runs on the night. Cam Schlittler had a nice MLB debut on the mound. We talked about a scenario where your son becomes the pitcher on a team you hate, like the Red Sox. Do you wear Red Sox gear? In the final segment of the hour, we took calls on whether you would root for your kid on an enemy team. Hour 3 - We started the hour by closing out the calls on whether you would root for your son if he was playing against your team. We talked about sports talk in NY, where there are two teams and fans think you are covering the other team too much. We talked about the Brooklyn Dodgers moving to L.A. and who the fans decided to root for. C-Lo returns for an update and starts with the debut of Yankees pitcher Cam Schlittler last night. Jazz Chisholm hit 2 home runs last night. The Yanks DFA'd DJ LeMahieu. C-Lo has clips of odd sounds and they are all C-Mac. Danielle got a call at 3:30am from a strip club. In the final segment of the hour, C-Mac tells the story of saving a woman's life when he was on vacation in Germany. Hour 4 - The Yankees have made significant changes, moving Jazz Chisholm to second base and designating DJ LeMahieu for assignment, which was described as a "cleansing period." Despite a recent win over the Mariners featuring two homers from Chisholm, Brian Cashman emphasized the ongoing need for bullpen arms and a third baseman, while still expecting big things from Anthony Volpe. Meanwhile, the Mets are preparing for a doubleheader against the Orioles.
