Carlos Deluna was convicted of murdering 26-year-old, single mother, Wanda Lopez. He swore he was innocent, and that Carlos Hernandez was the true murderer. This so-called "phantom" was nowhere to be found. 14 years after Carlos was put to death by lethal injection, an investigation was published by Columbia Human Rights Law Review and suggested Carlos was telling the truth. Hernandez was a similar looking man who had done similar crimes with the same weapon used in the murder of Wanda Lopez. Welcome to The Prison Post Podcast! Our guest this week is Tommy DeLuna who was sentenced to Life Without The Possibility of Parole (LWOP). Tommy was charged at the age of 17 for a murder robbery, convicted at 18 and sentenced at 19 to LWOP. Being sentenced to LWOP is essentially giving someone a slow death sentence. He served 25 years and has been out for a little over 2 years, holds two jobs, co-owns a business, and attends Sacramento State University. He's a busy man to say the least and I was honored to have my friend on The Prison Post Podcast. Tommy shares his story, accountability, remorse, and responsibility. Tommy is very remorseful and takes responsibility for the life he took, and although he never had an intention to murder, the results equated to an LWOP sentence. Society expects us to be honest about what we did and what we caused while going through the court system, but why would anyone want to be honest when the results that come from honesty result in sentences like LWOP. We had a detailed conversation about what it was like for him to be incarcerated for over two decades with LWOP. He shares his current values and beliefs about LWOP and the death penalty. He shares what he believes about the punishment model California's prison system utilizes and what's happening around related LWOP laws today. The death penalty. It’s easily one of the biggest debates in America. Even today. Now those who agree with the death penalty like to imagine that the state never gets it wrong. However, that’s just not the case. It is better that ten guilty people go free than one innocent person be killed for a crime he did not commit. The case of Carlos DeLuna is not a lesson in justice, but injustice. It truly lays bare America’s broken “machinery of death.” The term machinery of death comes from Supreme Court Justice Harry Blackmun, who spent 24 years reviewing and often upholding death sentences. On February 4, 1983, Wanda Vargas Lopez was working as a cashier on the 3-10 p.m. shift at the Sigmor Service Station on South Padre Island Drive in Corpus Christi, Texas. A little after 8:00 p.m., a customer entered the store and warned Wanda that there was a man in the parking lot with a knife. Wanda called the emergency line for the Corpus Christi Police Department to summon help and was on the phone with a dispatcher when the suspect came into the store. A second customer saw the struggle going on inside and moved to intervene. He came face-to-face with the suspect, who fled. Within 20-30 minutes, law enforcement officers found Carlos Deluna hiding under a truck in the nearby neighborhood. Deluna claimed that another man, Carlos Hernandez, committed the robbery and murder, but he refused to provide any information to police or his attorneys. Deluna was executed on December 7, 1989. In 2003, Professor James Liebman sent investigators to Corpus Christi to interview various people and gather records, which he shared with the Chicago Tribune in 2006. In 2012, Professor Liebman published “Los Tocayo Carlos” in the Columbia Human Rights Law Review, which concluded that the crime for which Deluna was executed was committed by Carlos Hernandez, a man who was 8 years older than Deluna, with a reputation for carrying a knife and a history of violence against women in his life. This week, we explore the 1989 execution of Carlos DeLuna by the State of Texas with Columbia University Law School Professor James S. Liebman, a 2002 recipient of NACDL's Champion of Justice Award who last week released a groundbreaking investigative report about the Carlos DeLuna case, more than five years in the making by his research team, entitled Los Tocayos Carlos: An Anatomy of a Wrongful Execution. Professor Liebman, who clerked for former U.S. Supreme Court Justice Stevens and spent many years practicing at the NAACP Legal Defense Fund, has focused for decades on a research agenda alternating between capital punishment and public education reform. Among his work, Liebman co-authored treatises on both Habeas Corpus and Evidence as well as a statistical study of error rates in capital cases entitled A Broken System, released in two parts in 2000 & 2002.
