The appellant, Roger Patrick Bilodeau, was found guilty by a jury of two counts of manslaughter for the shooting deaths of two men. He was found liable as a party under s. 21(2) of the Criminal Code, for having formed an intention to carry out an unlawful purpose common with his son, who shot the deceased. He appealed his convictions, arguing that the jury was improperly instructed, including regarding the common unlawful purpose. The majority of the Alberta Court of Appeal dismissed the appeal. It concluded that many errors identified benefited the appellant, often by imposing on the Crown an unduly onerous burden. No substantial wrong or miscarriage of justice occurred: s. 686(1)(b)(iii) should be applied. Pentelechuck J.A., dissenting, would have allowed the appeal and ordered a new trial. In her view, there were additional legal errors in the charge not identified by the majority, one or more of which were not harmless, precluding a route under s. 686(1)(b)(iii). There was a real risk that the common unlawful purpose alleged by the Crown merged into the secondary offence of murder. The dissenting judge was not convinced that the evidence was so overwhelming that, notwithstanding the serious nature of the error, a reasonable and properly instructed jury would inevitably have convicted. Lynn Bilodeau is the self –described “Luckiest Man Alive.” “I am married to an Angel. We have five wonderful kiddos, all of whom are very responsible adults.” Lynn graduated from the University of Central Oklahoma, formerly Central State University, in Edmond and attended the University of Oklahoma School of Law. He raised three children, all of whom live close by, and come over for dinner regularly. He also has two stepchildren and four grandchildren. He has always said the most fun he had at any job was that of being a father. Lynn and his wife Sherri love to host the extended family gatherings at their Guthrie home. Lynn loves to work on classic cars, doing restoration and mechanical work. Lynn & Sherri have become very involved in their Guthrie Community. They are also very involved with Guthrie Tomorrow Coalition, dba State Capital Publishing Museum, a nonprofit formed to acquire the building from the State of Oklahoma (OHS) for purposes of restoring the building and re-opening it as a museum. The new nonprofit now has ownership of the building and is working with a 10-member Board of Directors to begin restoration of the building. Lynn serves as the unpaid CEO of the Corporation. Prior to attending law school, Lynn served as a youth minister for eight years and started and owned an auto repair business for seven years (which his nephew still owns and operates). This week we are talking about barn hunt with special guest Heather Bilodeau. Barn hunt is a relatively new sport and was created in 2012 to give dogs an outlet for their natural scent and hunting skills. Dogs use their natural abilities to sniff out rats that are in protective tubes within a preset course of stacked straw bales. There are several levels for people and dogs to compete at which we break down in detail. The sport can accommodate dogs and people of all ages and abilities. Additionally, there are no breed restrictions when it comes to this sport. This is considered a family sport and is geared to be inclusive of all. The sport takes rat safety and care very seriously and outlines how to make sure rats are safe and comfortable in their rule book. The rats are considered to be important partners in the sport and are respected as such but both competitors and judges.
