Community Property vs. Common Law Property SystemsSubject: Analysis of Community Property and Common Law Property Systems in Family and Property LawCommunity Property System:Marriage is viewed as an economic partnership.Any asset acquired during the marriage is presumed to be community property, regardless of whose name is on the title.Applies in nine U.S. states: California, Texas, Arizona, Louisiana, Nevada, New Mexico, Washington, Idaho, and Wisconsin.Community property states mandate an equal 50/50 split of marital property in a divorce.Common Law Property System:Property rights are determined by title ownership. Assets acquired by one spouse are presumed to belong solely to that spouse.Property is divided fairly, but not necessarily equally, in a divorce.Courts consider factors like length of the marriage, each spouse's financial and non-financial contributions, future earning capacity, standard of living during the marriage, health and age of the spouses, dissipation of assets, custodial responsibilities for children, and agreements between the spouses regarding ownership or anticipated division of property.Key Comparisons and Additional Considerations:Both systems address property transformation from separate to marital or vice versa through transmutation and commingling. In community property states, real estate acquired during the marriage belongs to both spouses equally. In common law states, ownership is determined by the title deed

Insights: Padideh: "I would say that before you decide to file for a divorce, do everything humanly possible in order to see if you can make the marriage work. Obviously, if there are you know, domestic violence, that's something that you know cannot easily be worked out. But if there's communication problems, if there's resentments, if there are, you know, different expectations. Now, because remember, people grow right every year, somebody is growing and you want to be growing together and not growing apart. And so, I think it's important." Liz: "...turn over every stone. Let's make sure that we have looked at this left, right, upside down, backwards, inside out, to know that we've had [no] doubts there is no other way than divorce. I don't want people to leave or five years down the road say, gosh, looking back. What if? What if I found a better therapist? What if I tried harder? I want us to turn over every, every stumbling stone." If you missed the first episode of our "Character Matters" mini-series, we discussed the differences between Community and Separate Property and why the "character" of your assets matters in estate planning. As a quick recap: Separate Property includes assets owned before marriage or received as gifts or inheritances during marriage, while Community Property consists of assets acquired during the marriage. Now, as we start Part Two, we're delving into the deeper details of property types and how specifically to estate plan for each of them. Join us as we explore important topics such as whether you should consider a pre- or postnuptial agreement, what to consider when signing one, and how the process works. Whether you're single, married, or even remarried, this episode is a treasure trove of valuable information, so don't miss out! Time-stamped Show Notes: 0:00 Introduction 0:45 We're getting straight to the point: Character matters when estate planning because you can't give away what's not yours. Sounds simple, right? 2:55 If you're interested in estate planning for your second marriage, you'll want to listen to this portion as we discuss how the type of asset affects what you can do with it. 4:01 Even though you can't personally choose whether an asset is legally considered Community or Separate Property, you can change its character. Here's how. 5:39 Is a prenuptial agreement right for you? Here's an example of when you might want to consider one and what you can include. 6:41 Postnuptial agreements can also be an option if you're already married. If you're doing your estate planning with us, we'll work with a family law attorney who can help navigate the process.

Did you know that in California, any property acquired while married is considered Community Property? This means that, regardless of who bought it, the ownership is split 50/50 in the case of divorce. It also means that if you die without valid estate planning documents, your spouse automatically receives 100% of the ownership. If we're talking about Separate Property, that's a slightly different story, and of course, there are always exceptions to the rule. This episode of Absolute Trust Talk kicks off our Character Matters series, where we're diving deep into the important distinctions between these two types of property and why you need to understand this for estate planning purposes. Let's get started! Time-stamped Show Notes:  0:00 Introduction 0:38 To start, we're sharing the “celebrity situation” that inspired this new Character Matters series of discussions.  2:26 Before going too far, let's clarify the basic definitions of our terms. Listen in to learn the key differences between Community Property and Separate Property.  4:35 While Community and Separate Property definitions are straightforward, some situations aren't. Here's a great example. 6:33 If you pass away without a valid will or trust, your Community Property automatically goes to your surviving spouse. But what about Separate Property? Here's what you need to know. 8:38 Did you know you can get a higher tax exemption with Community Property than Separate Property? 10:29 We get asked a lot about the pros and cons of getting married, and even though finances and assets probably aren't the main factors in determining your relationship, there may be some circumstances where they influence whether you should officially move forward.

So if your case is running a lengthy amount of time, even if she is out of her jurisdiction, she flat out doesn't care. She doesn't care about a DVRO order that doesn't exist, among other things. Finally, she clarified her orders - that she didn't care either way by the VA Disability that isn't Community Property. Her fraud actions forced Phillip into bankruptcy,  violated the Code of Judicial Ethics and has failed to observe Phillip's Due Process Rights.     Evidence Phillip is seeking within the family law case has been denied to him per his public records request because of the current federal lawsuit pending, officially making the SDCSC an adversary against Phillip. The SDCSC (trial judges) refuses to acknowledge any awareness of the pending federal case and continues to exact revenge and punishment against Phillip while the federal case is still pending. An immediate injunction is needed because the SDCSC (Family Law Division) has ruled against a long standing federally protected statute and now rules Phillip's DISABILITIES are NOW considered COMMUNITY PROPERTY. The SDCSC is using this time to continue to violate Phillip's CIVIL RIGHTS in hopes to take his house away (leaving the veteran BANKRUPT AND HOMELESS) before the USDC, SDC responds to the pending FRAUD UPON the COURT CASE.To Reach Phillip Simon: phillipsimon56@gmail.comThis episode of Slam the Gavel is sponsored by CPSprotect Consulting Services. However, veteran Phillip Simon also has sustained injuries from those efforts that have left him permanently disabled and suffering with PTSD, 100%. PHILLIP DOES NOT HAVE A CRIMINAL RECORD.     There was a "Kick Out" order issued on 7-29-2021 on his ex-wife and her sister who already had Temporary DVRO's against them. However, on 8-3-2021 The San Diego County Superior Court FAMILY LAW DIVISION allowed the two women to move back into Phillip's home just five days after kicking them out despite his attorney's objections. This shows DIRECT PROOF that the SDCSC acted with BIAS and PREJUDICE against THIS VETERAN from then on EVER SINCE.      The San Diego County Superior Court (SDCSC) continues to be prejudice and bias against all of Phillip's attempts to find a redress to end his unnecessarily high divorce conflict case. SDCSC made the VETERAN'S house the NUMBER ONE issue needing to be addressed in the divorce dissolution. For almost THREE YEARS, the SDCSC have fought against Phillip keeping his case, house and/or property FALSELY within their jurisdiction when it has clearly been proven by federal law, statue and official court transcripts that it is not.     Phillip Simon has filed an action in the United States District Court, Southern District of California (USDC, SDC), against the Superior Court: Simon v. Michelle and Amy sit down for a conversation about community property and demystify some concepts and misunderstandings some of you may have about it. Going through a divorce can be a difficult and emotional process, and understanding community property laws can add to the stress. In community property states, any assets or debts acquired during the marriage are considered joint property and must be divided fairly in the divorce settlement. It's important to understand that community property laws don't necessarily mean that everything will be split down the middle. Rather, the goal is to reach a fair and equitable division of assets and debts. Factors such as income, earning potential, and contributions to the marriage will be considered when determining how property will be divided. If you have any questions or concerns about how community property laws apply to your specific situation, it's important to consult with a lawyer who can provide guidance and help protect your rights. Listen to the different stories, situations, and tips that might be useful for you! Tune in, and get all the information, insight, and more

For instance, If parts of a settlement check are awarded based on pain and suffering, then it can be considered personal property and not community property. This is because pain and suffering sustained from an accident can not be shared.

Hines's Water for All Community, Property, and Revolution in Modern Bolivia (University of California Press, 2021) chronicles how Bolivians democratized water access, focusing on the Cochabamba region, the country's third largest city and most important agricultural valley. Covering the period from 1879 to 2019, Hines examines the conflict over control of the region's water sources, showing how communities of water users increased supply and extended distribution through collective labor and social struggle. Through analysis of a wide variety of sources from agrarian reform case records to oral history interviews, Hines investigates how water dispossession in the late nineteenth century and reclaimed water access in the twentieth and twenty-first centuries prompted, shaped, and strengthened popular and indigenous social movements. The struggle for democratic control over water culminated in the successful Water War uprising in 2000, a decisive turning point for Bolivian politics. This story offers lessons in contemporary resource management and grassroots movements for how humans can build equitable, democratic, and sustainable resource systems in the Andes, Latin America, and beyond. Water for All is essential reading for Andeanists and scholars of social and environmental movements in the Americas.
